Book Synopsis The Law of Possession by : William Sturman Sax

Available in PDF, EPUB and Kindle. Book excerpt: Rituals combining healing with spirit possession and court-like proceedings are found around the world and throughout history. For example, a person suffers from an illness that cannot be cured, and in order to be healed he performs a ritual involving prosecution and defense, a judge and witnesses. Divine beings give evidence through human oracles, spirits possess their human victims and are exorcized, and local gods intervene to provide healing and justice. Such practices seem to be the very antithesis of modernity and many modern, secular states have systematically attempted to eliminate them. Why are such rituals largely absent from modern societies, and what happens to them when the state attempts to expunge them from their health and justice systems, or even to criminalize them? Despite the prevalence of rituals involving some or all of these elements, The Law of Possession represents the first attempt to compare and analyze them systematically. The volume brings together historical and contemporary case studies from East Asia, South Asia, and Africa, and argues that, despite consistent attempts by states to discourage, eliminate, and criminalize them, such rituals persist and even thrive because they meet widespread human needs.

Download or read book Possession of Land written by Mark Wonnacott and published by Cambridge University Press. This book was released on 2006-10-26 with total page 170 pages. Available in PDF, EPUB and Kindle. Book excerpt: Nothing is more important in English land law than 'possession'. It is the foundation of all title, rights and remedies. But what exactly is it, and why does it still matter? This book, first published in 2006, is about the meaning, significance and practical effect of the concept of possession in contemporary land law. It explains the different meanings of possession, the relationship between possession and title, and the ways in which the common law and equity do, and do not, protect possession. The rights and remedies of freeholders, tenants and mortgage lenders, between themselves and against third parties, are all to some extent dependent on questions of status and possession. This book shows how. It is designed to provide an understanding of the basic principles for the student, and answers to difficult, real problems for the practitioner.
Book Synopsis Possession, Relative Title, and Ownership in English Law by : Luke Rostill
Download or read book Possession, Relative Title, and Ownership in English Law written by Luke Rostill and published by Oxford University Press. This book was released on 2021-02-10 with total page 192 pages. Available in PDF, EPUB and Kindle. Book excerpt: This monograph is concerned with two foundational principles of English property law: the principle of relativity of title and the principle that possession is a source of title. It is impossible to understand the relationship between possession and ownership in English law unless one has a sound understanding of these principles. Yet the principles have been interpreted in different ways by judges, practitioners, and academics. The volume seeks to illuminate this area of law by addressing four questions. What is possession? What is the nature of the title acquired through possession? What are the grounds of relativity of title? And, what is the relationship between relativity of title and ownership? Drawing on the analysis of the law concerning relativity of title and the acquisition of proprietary interests through possession, the author also implies that the architecture of land law and the law of personal property have many similarities.

Book Synopsis An Expressive Theory of Possession by : Michael JR Crawford
Download or read book An Expressive Theory of Possession written by Michael JR Crawford and published by Bloomsbury Publishing. This book was released on 2020-07-09 with total page 208 pages. Available in PDF, EPUB and Kindle. Book excerpt: Possession is a foundational concept in property law. Despite its undoubted importance, it is poorly understood and a perennial source of confusion. Indeed, there is a widely held view amongst lawyers that possession is an irredeemably ambiguous and amorphous concept. This book aims to challenge this conventional wisdom and to demonstrate that possession is in fact far simpler than generations of lawyers have been led to believe. In viewing possession as a knotty problem for the philosopher or legal theoretician, scholars are apt to overlook the important truth that possession is a concept that laymen routinely and, for the most part, effortlessly apply as they navigate through the countless property interactions that shape everyday life. The key to understanding the nature and function of possession in the law is to appreciate that the possession 'rule' is, first and foremost, a spontaneously emergent phenomenon. Possession describes those acts that, as a matter of an extra-legal convention, constitute the accepted way in which members of a given population stake their claims to tangible things. Fusing traditional legal analysis with insights from philosophy and economics, An Expressive Theory of Possession applies this central claim to both theoretical and doctrinal problems in property law and, in doing so, provides a coherent explanation of possession and its role in law and life.

Book Synopsis Property and the Law of Finders by : Robin Hickey
Download or read book Property and the Law of Finders written by Robin Hickey and published by Bloomsbury Publishing. This book was released on 2010-01-20 with total page 196 pages. Available in PDF, EPUB and Kindle. Book excerpt: Are finders keepers? This most simple of questions has long evaded a satisfactory legal answer. Generally it seems to have been accepted that a finder acquires a property right in the object of her find and can protect it from subsequent interference, but even this turns out to be the baldest statement of principle, resting on obscure and confused authority. This first full-length treatment of finders sets them in their legal-historical context, and discovers a fascinating area of law lying at the crossroads of crime, obligations, and property. That on the same facts a finder might be thief, bailee, and/or property right holder has clouded our conceptual analysis, and prevented us from stating simply our rules about finding. Nonetheless, when the applicable doctrines and policies of our property law (particularly the central concept of possession) are explored and understood in the light of countervailing rules of crime and tort, we can argue confidently that, despite centuries of doubt and confusion, English law has succeeded in producing a body of law that is theoretically and practically coherent. Property and the Law of Finders makes this argument, and will appeal to anyone specifically interested in the law of personal property, and also to those with broader concerns about the evolution of common law concepts and their ability to yield workable, practical solutions.
