After an informative general introduction, the book proceeds to an in-depth discussion of the sources and instruments of family and succession law, the authorities that adjudicate and administer the laws, and issues surrounding the person as a legal entity and the legal disposition of property among family members. Such matters as nationality, domicile, and residence; marriage, divorce, and cohabitation; adoption and guardianship; succession and inter vivos arrangements; and the acquisition and administration of estates are all treated to a degree of depth that will prove useful in nearly any situation likely to arise in legal practice. The book is primarily designed to assist lawyers who find themselves having to apply rules of international private law or otherwise handling cases connected with Germany. It will also be of great value to students and practitioners as a quick guide and easy-to-use practical resource in the field, and especially to academicians and researchers engaged in comparative studies by providing the necessary, basic material of family and succession law.

Available in PDF, EPUB and Kindle. Book excerpt: This book is one of the first to link company law to the law of succession by concentrating on family businesses. It shows that, to understand the legal framework underlying the daily operations of family businesses, one needs legal analysis, empirical data, psychological and sociological knowledge. The book works on the premise that, since many businesses have been founded by families, practitioners need to develop an understanding of the legal background of such businesses and build up experience to be able to create contracts, trusts, foundations and other legal mechanisms to give shape to systems and procedures for the transfer of shares and control within the family. Comparing the national legal order, techniques, and mechanisms in a range of countries, the book examines parallel developments in these fields of law across the world. Finally, it demonstrates the room for companies, shareholders and the members of a family to develop individual solutions within the legal framework for transferring businesses and shares to the next generation.

Book excerpt: This book analyses the legal approach to personal data taken by different fields of law. An increasing number of business models in the digital economy rely on personal data as a key input. In exchange for sharing their data, online users benefit from personalized and innovative services. But companies’ collection and use of personal data raise questions about privacy and fundamental rights. Moreover, given the substantial commercial and strategic value of personal data, their accumulation, control and use may raise competition concerns and negatively affect consumers. To establish a legal framework that ensures an adequate level of protection of personal data while at the same time providing an open and level playing field for businesses to develop innovative data-based services is a challenging task. With this objective in mind and against the background of the uniform rules set by the EU General Data Protection Regulation, the contributions to this book examine the significance and legal treatment of personal data in competition law, consumer protection law, general civil law and intellectual property law. Instead of providing an isolated analysis of the different areas of law, the book focuses on both synergies and tensions between the different legal fields, exploring potential ways to develop an integrated legal approach to personal data.

Book excerpt: German Limited Liability Company Edited by Rüdiger Volhard and Arndt Stengel Pünder, Volhard, Weber & Axster The German limited liability company (GmbH) is the most common business form in Germany - over 600,000 GmbH companies compared with just 3,000 stock corporation companies. To run a successful operation in Germany, foreign investors must understand the GmbH. Recognising this need, the authors of German Limited Liability Company have drawn on years of experience advising domestic and international clients to produce a practical and comprehensive guide. Through a combination of the lawyer's grasp of company law and a commercial understanding of corporate finance, the authors not only anticipate common questions and problems facing potential investors but also tackle numerous unforeseen legal and business considerations vital to understanding the German marketplace. German Limited Liability Company covers the following key areas: * nuts and bolts overview of German corporate law - choice of entity, formation, shareholders' and directors' duties, articles of association, registration formalities * corporate finance and corporate law - debt and equity financing, capital measures, mergers and reorganisations, rescue restructures * tax - introduction to German tax law, tax-efficient structuring of an acquisition, thin capitalization, non-resident directors The most frequently raised issues on employment law, directors' liabilities, social insurance and residence and work permits are also dealt with. Dual language versions of the key documentation together with a comprehensive list of terminology provide the reader with practical support. With its breadth of coverage and problem solving advice, German Limited Liability Company is essential reading for all investors, directors, lawyers and consultants serious about doing business in Germany.

Available in PDF, EPUB and Kindle. Book excerpt: Increasing numbers of people have connections with one country, but live and work in another, frequently owning property or investments in several countries. As such, international aspects arise in an increasing number of estates. Different countries may have separate arrangements for ownership, taxation, and succession. International Succession equips practitioners with the information necessary to navigate problems involving these different systems. Although lawyers would often advise only on the law of the jurisdictions in which they are based, seeking advice from lawyers in other countries, this book will save the practitioner the time - and expense - of ascertaining the basics concerning the inheritance systems in different countries, offering clear and easy to use information on the laws of inheritance and succession. Each country's report is based on responses to a comprehensive questionnaire that considers the practical issues arising from the jurisdiction's individual laws, making it easy for users to make specific comparisons between the laws of one country and another. The book covers over fifty countries with entries written by experts from each country, making it an invaluable resource for the busy practitioner. This title is an improved and expanded version of International Succession, edited by Louis Garb and published by Kluwer Law International, 2004. This edition, published in hardback form, will also be supplemented annually in between editions to update the individual country entries.

Available in PDF, EPUB and Kindle. Book excerpt: At the start of a new century, poverty remains a global problem of huge proportions. Of the world's 6 billion people, 2.8 billion live on less than $2 a day and 1.2 billion on less than $1 a day. Eight out of 100 infants do not live to see their 5th birthday. Nine of 100 boys and 14 of 100 girls who reach school age do not attend school. Poverty is also evident in poor people's lack of political power and voice and in their vulnerability to ill health, economic dislocation, personal violence and natural disasters. The scourge of HIV/AIDS, the frequency and brutality of civil conflicts, and rising disparities between rich countries and the developing world have increased the sense of deprivation and injustice for many. 'World Development Report 2000/2001: Attacking Poverty' (which follows 2 other 'World Development Reports' on poverty, in 1980 and 1990) argues that major reductions in all these dimensions of poverty are indeed possible--that the interaction of markets, state institutions, and civil societies can harness the forces of economic integration and technological change to serve the interests of poor people and increase their share of society's prosperity. Actions are needed in 3 complementary areas: promoting economic opportunities for poor people through equitable growth, better access to markets, and expanded assets; facilitating empowerment by making state institutions more responsive to poor people and removing social barriers that exclude women, ethnic and racial groups, and the socially disadvantaged; and enhancing security by preventing and managing economywide shocks and providing mechanisms to reduce the sources of vulnerability that poor people face. But actions by countries and communities will not be enough. Global actions need to complement national and local initiatives to achieve maximum benefit for poor people throughout the world. A copublication of the World Bank and Oxford University Press.
