In some situations, however, military health professionals can face unique ethical tensions between responsibilities to individual patients and responsibilities to military operations. This book summarizes the one-day workshop, Military Medical Ethics: Issues Regarding Dual Loyalties, which brought together academic, military, human rights, and health professionals to discuss these ethical challenges. The workshop examined two case studies: decisions regarding returning a servicemember to duty after a closed head injury, and decisions on actions by health professionals regarding a hunger strike by detainees. The workshop also addressed the need for improvements in medical ethics training and outlined steps for organizations to take in supporting better ethical awareness and use of ethical standards.

The Military Health System (MHS) is a global, comprehensive, integrated system that includes combat medical services, peacetime health care delivery to Service members and eligible beneficiaries, public health services, medical education and training, and medical research and development. MHS personnel provide a continuum of health services from austere operational environments through remote, fixed military treatment facilities (MTFs), to major tertiary care medical centers distributed across the United States. Military health care professionals are also expected to care for detainees, enemy combatants, nonstate actors, local nationals, and coalition forces. In addition, U.S. military personnel are often deployed to assist in humanitarian missions, such as natural disasters or to provide care to local citizens in combat zones. Directly applying ethical principles from civilian medical ethics may not be appropriate in military medicine. The basic discrepancy between the two settings involves their goals and how these goals can be achieved. This book examines the ethical guidelines, practices, and issues for U.S. military medical professionals.

Book excerpt: This dissertation presents a prima facie case for the usefulness of applying Bernard Gert's theory of moral rules to American professional military ethics. Gert's moral theoretical goal is to describe the common moral system that all moral agents implicitly use to make moral decisions the way competent speakers of a language implicitly use a grammatical system to speak a language. Gert describes the key features of the common moral system and attempts to justify that description as accurate. Gert's moral theory also provides an explicit decision procedure to guide moral decision-making in concrete cases. Gert has already argued in many articles and books that his moral decision procedure can be effectively used to make complex moral decisions in professional medical ethics. I use Gert's work in medical ethics as a springboard for investigating whether similar success is possible in American Professional Military Ethics. I argue that similar success is possible but limited. This dissertation is organized into an introductory chapter, four main chapters, and a concluding chapter. In chapter 2 I review the diverse literature that American military professionals have at their disposal to guide their moral decision-making in concrete cases. This literature is divided into two convenient categories, official documents and the literature of evaluation and aspiration. In chapter three I present a concise discussion of Gert's theory of moral rules, explaining key concepts he deploys and describing the moral decision procedure that is consistent with those concepts. In chapter four I review and assess Gert's important work in medical ethics in order to explore how and how effectively he has deployed his theory to make moral decisions in concrete medical ethics cases. Finally in chapter five, I apply Gert's moral theory to several concrete cases of varying complexity in American professional military ethics.

This is achieved by examining the professional, ethical, and legal conflicts in British Military healthcare practice that occur in three distinct military environments. These are (i) the battlefield, (ii) the operational environment and (iii) the non-operational environment. As this conflict is exacerbated by the need to achieve Operational Effectiveness, this book also explores the dual loyalty conflict that Military Health Care Professionals (MHCPs) encounter between following military orders and professional codes of practice. The method used to challenge the WMA’s statement and explore these conflicts is the use of real-life problem-solving vignettes, which mirror actual ethical and professional conflicts and dilemmas that may occur in the three environments. The areas of law analysed similarly reflect the difficulties that MHCPs face when caring for the sick and wounded in violent locations when under attack. In particular, the book questions whether it is right for a MHCP to owe their patients a duty of care in hostile environments. This leads on to questioning if any MHCP could be protected by combat immunity where no duty of care is owed to fellow soldiers in the battlefield. The book also questions whether the standard of care should be variable in hostile environments. It also explores the dual loyalty conflict of a wounded senior officer refusing treatment from a junior officer. In addition, it examines the difficulties of a doctor maintaining patient confidentiality when a soldier refuses treatment for a psychological injury but wishes to redeploy to the battlefield. The book successfully challenges the WMA’s statement. It also concludes by suggesting that neither a military-focused approach nor a professional healthcare-focused approach towards military healthcare is the best way to solve the dual loyalty conflict.
