Book excerpt: The long-awaited fourth edition of this classic collection reproduces the texts of conventions, draft conventions and resolutions on the law of armed conflicts which have been adopted since the codification movement started in the nineteenth century. Since the previous edition appeared the number of texts has increased, due to the rapid development of this branch of international law. In order to give the reader access to all conventions and similar texts adopted since the nineteenth century, older conventions that in the course of time were replaced by newer ones (such as the Geneva Conventions adopted before 1949) have also been reproduced. All texts are introduced by a short explanatory note. A list of signatures, ratifications and accessions, as well as the texts of reservations of individual states, are attached to each convention. The book is fully indexed.

Book excerpt: The essays selected for the first part of this volume offer an insight into the development, as distinguished from the history, of international humanitarian law. The focus of the majority of the works reprinted here is on an analysis of the adequacy of the law as it stood at the time of the respective publication and in the light of existing contemporary armed conflicts and military operations. Thus, the reader is afforded an in-depth look at the early roots of international humanitarian law, the continuing relevance of that body of law despite advances in weapons technology and the efforts to progressively develop it. International humanitarian law's development cannot be considered in isolation from its principles. The essays selected for the second part of the volume deal with the two fundamental principles underlying all of international humanitarian law: humanity and military necessity. The articles on the principles of humanity include reflections on the famous Martens Clause, and the analyses of military necessity take no account of 'Kriegsraison'. Moreover, they offer proof of the customary character of the principle of distinction in land, air and naval warfare.

Book excerpt: The wars in Afghanistan and Iraq have highlighted again the precarious situation aid agencies find themselves in, caught as they are between the firing lines of the hostile parties, as they are trying to alleviate the plight of the civilian populations. This book offers an illuminating case study from a previous conflict, the Italo-Ethiopian war of 1935-36, and of the humanitarian operation of the Red Cross during this period. Based on fresh material from Red Cross and Italian military archives, the author examines highly controversial subjects such as the Italian bombings of Red Cross field hospitals, the treatment of Prisoners of War by the two belligerents; and the effects of Fascist Italy’s massive use of poison gas against the Ethiopians. He shows how Mussolini and his ruthless regime, throughout the seven-month war, manipulated the International Committee of the Red Cross (ICRC) – the lead organization of the Red Cross in times of war, helped by the surprising political naïveté of its board. During this war the ICRC redefined its role in a debate, which is fascinating not least because of its relevance to current events, about the nature of humanitarian action. The organization decided to concern itself exclusively with matters falling under the Geneva Conventions and to give priority to bringing relief over expressing protest. It was a decision that should have far-reaching consequences, particularly for the period of World War II and the fate of Jews in Nazi concentration camps.

Book excerpt: The State of Qatar, the Asian-African Legal Consultative Committee (AALCC), in cooperation with the Secretariat of the United Nations and Frère Cholmeley (Paris) organised the Conference on International Legal Issues Arising under the United Nations Decade of International Law in Doha, Qatar on 22--25 March 1994. Around 60 speakers and 200 participants from more than 40 nations freely expressed their views on the progressive development of international law and its codification with a view to States' actions in the future adhering to the principles of international law as enshrined in the Charter of the United Nations. The subjects dealt with by the Conference had one thing in common: they were all topical issues or, in French, `des questions d'actualité', and will remain thus throughout the United Nations Decade of International Law. The various themes were Environmental Law, the Law of the Sea, the Settlement of Disputes, Humanitarian Law, and the Rio Conference, Post-Rio and the New International Economic Order. This book which contains the Conference proceedings will be of great interest to lawyers specializing in international law. The book is not only a photograph of some very important issues as they existed and were perceived in 1994, it will also serve as a reference book and a unique tool which will be indispensable to understanding some of the most crucial legal problems with which the world community is faced today.
