Available in PDF, EPUB and Kindle. Book excerpt: The office of Lord Chancellor is one that has frequently been questioned. However, the extent and diversity of the questioning seldom attained the proportions reached in the final years of the twentieth century, when they drew attention to the deficiencies of the position of Lord Chancellor, the inherent tensions within that position and the incongruity of such a role in a modern democracy. This book examines these questions. It analyses the development and current position of the Lord Chancellor as head of the judiciary, member of the Cabinet, judge and Speaker in the House of Lords and considers his role in relation to judicial appointments. It also looks at the LCD, the development of which acts as an indicator of the changes in the office of Lord Chancellor. It concludes by making proposals for reform, the most far-reaching of which is the abolition of the office.

Available in PDF, EPUB and Kindle. Book excerpt: This book comprises a definitive collection of papers on administrative justice, written by a set of very distinguished contributors. It is divided into five parts, each of which contains articles on a particular aspect of administrative justice. The first part deals with the impact of 'contextual changes' on administrative justice and considers the implications of changes in governance and public administration, management and service delivery, information technology, audit and accounting, and human rights for administrative justice. The second part deals with conceptual issues and describes a number of competing approaches to the administrative justice. The third part deals with the application of administrative justice principles to private law disputes while the fourth part deals with the distinctive characteristics of administrative justice in three other jurisdictions. The final part deals with current developments in administrative justice and the book concludes with a discussion of legislative and policy developments in the UK. The general approach of the book is socio-legal and interdisciplinary. The chapters adopt a variety of disciplinary perspectives, including those derived from political science, public policy, social policy, accounting and information technology as well as from law. Although most of the contributors are academics, some are practitioners. For these reasons, the book should be of interest to lawyers, particularly those with interests in administrative law, and to social scientists, particularly those with interests in public administration, public policy and public management.

Available in PDF, EPUB and Kindle. Book excerpt: Drawing on a three-year multidisciplinary study of children of divorced parents, the authors, leading academics in their fields, present a much-needed guide to understanding the experience of children who are experiencing parental separation. This book provides an in-depth account of how children are actively involved in the process of divorce and how they shape that experience. The topics discussed include how children find out that their parents are separating; how children tell other people about what is happening to them and their family; how parent-child relationships change after separation and ways in which children adapt and cope during and immediately after their parents' divorce. The authors show what children want and need to know as the process of divorce unfolds and how professionals can respond appropriately to help them to understand and adjust to their changing circumstances. Divorcing Children addresses the weaknesses of current legislation in family justice and suggests ways of improving the skills and knowledge of all professionals who work with children during this difficult period in children's lives.

Available in PDF, EPUB and Kindle. Book excerpt: This book is concerned with the regulation of family relationships,in particular the issue of openness and contact in the many different family situations in which it may arise. The shift towards a presumption of contact, and its articulation within diverse fields of family law and practice raises a whole series of questions which this book seeks to explore. For example: Why has the contact presumption emerged? What is meant by contact, and with whom. What is the value and purpose of it? What makes it work or not work? What is the role of law and other forms of external intervention in promoting, regulating or facilitating contact and to what extent should 'familial' relationships be subject to state regulation? More broadly, what can we infer about current conceptualisations of family, parenting (and the relative importance of social and biological parenthood) and childhood from policy and practice towards contact? These and other questions were explored in a series of seminars organised by the Cambridge Socio-Legal Group in 2002. The book is the product of these seminars.
