Available in PDF, EPUB and Kindle. Book excerpt: The European Convention on Human Rights (ECHR) entered into force on 3 September 1953 with binding effect on all Member States of the Council of Europe. It grants the people of Europe a number of fundamental rights and freedoms (right to life, prohibition of torture, prohibition of slavery and forced labour, right to liberty and security, right to a fair trial, no punishment without law, right to respect for private and family life, freedom of thought, conscience and religion, freedom of expression, freedom of assembly and association, right to marry, right to an effective remedy, prohibition of discrimination) plus some more by additional protocols to the Convention (Protocols 1 (ETS No. 009), 4 (ETS No. 046), 6 (ETS No. 114), 7 (ETS No. 117), 12 (ETS No. 177) and 13 (ETS No. 187)). Any person who feels his or her rights under the ECHR have been violated by the authorities of one of the Member States can bring a case to the European Court of Human Rights, established under the Convention. The States are bound by the Court's decisions. The Committee of Ministers of the Council of Europe make sure that the decisions are properly executed. Today the Court receives thousands of petitions annually, demonstrating the immense impact of the Convention and the Strasbourg Court. Professor Grabenwarter's Commentary deals with the Convention systematically, article-by-article, considering the development and scope of each article, together with the relevant case-law and literature.

Available in PDF, EPUB and Kindle. Book excerpt: During the 2000s, the European Union has witnessed a significant change in terms of integration policies for immigrants. This book intends to address the relationship between, on the one hand, cultural diversity resulting from migration, and, on the other hand, social cohesion and social justice within Western societies. In order to do this, the authors examine what can be described as two contradictory trends in recent public policies towards foreign people or people with a foreign origin. A book that aims to provide a trans-disciplinary analysis of the construction of “otherness” in North America and Europe. EXTRAIT In October 2010, in a very polemic context on immigration and immigrant integration, the German Chancellor, Angela Merkel, announced that Germany was to be considered a multicultural failure, words that were soon echoed by the Belgian Prime Minister Yves Leterme. A few months later, the British Prime Minister David Cameron and the French President Nicolas Sarkozy announced the failure of multiculturalism in almost identical terms. These sensational statements, which by and large avoid defining the concept of multiculturalism, are based on a reaffirmation of “Western values” and strengthening of national identity. These statements express the need to review the policies on integration of immigrants, in the sense that they should be more active and voluntarist, more organized by the state and more supported by the EU. In the background, one can see fear for Islamic extremism, but also the idea that the nation states can put some obligations on immigrants, and that for a too long time we have been focusing on “those who arrive”, rather than on “the society that welcomes them”. These speeches are situated in a politico-legal context that in recent years was characterized by an ambivalent attitude towards diversity in Europe. On the one hand, we have seen accusations of racial, ethnic and religious discrimination, based on antidiscrimination legislation boosted by a strong European equality legal framework. On the other hand, we have seen denouncements of the perceived risk posed by Islam in Europe. These policy statements are also a result of numerous publications, often widely discussed in the media that outline the dangers of Islam in Europe (especially in the Netherlands). These political positions have also led to political decisions demonstrating the lack of legitimacy of Islam in Europe, such as the ban on building minarets in Switzerland or the Burqa bans adopted in the name of protecting national values and the “living together”, notably in France and Belgium (2011).

Book excerpt: This edited volume sets out to unravel various dimensions of a particular topical question pertaining to minorities and minority protection, which has not been explored yet, more particularly the socio-economic participation of minorities in relation to their right to (respect for) identity. This interrelation and interaction is studied from a multi-disciplinary perspective, spanning a broad range of disciplines, while drawing on a rich variety of case studies covering various corners of the world. This interrelation manifests itself in distinctive ways for religious minorities, ethnic minorities, and indigenous peoples. As it is impossible to provide a comprehensive coverage, this volume aims to offer a range of articles that reveal the breadth of the theme under review, while combining theoretical analysis with fascinating case studies.

Excerpt: ...is not of our body, but a townsman, and licensed by them to keep an inn. I have complained to the Lords about him, and hope there will be a letter go from the Board to the town to call for an account of the whole business. One of the charges against Laud, made by Prynne, the great Parliamentary lawyer, was that his chaplain, Morgan Owen, had set up images of the Virgin and Child, holding a small crucifix, over the new south porch of St. Marys, which he had built at a cost of 230Z., in lieu, it is said, of a Latin sermon. They still keep at Lambeth the very copy of Prynnes Canterburys Doom which Charles I. read, with the clear bold Bum spiro spero, C.R., written on the fly-leaf by the King himself. Hobbes notes how much the doctrine and method of the University contributed to the troubles, and Prynne had cruel wrongs to remember. In 1635 the Caroline charter confirmed the privileges of the University, and their rights over the city, notwithstanding a protest from the citizens; but Laud kept vigilant watch over the city. His History of his Chancellorship supplies full details. He got a letter from the Council, ordering the demolition of the cottages erected upon the town ditch and the town wall, the back way towards the Castle, and in the middle of the street by Trinity College gate, and near a place called Smithgate. Pulling down the cottages made Smithgate passable for coaches. And by his own proclamation he named a toll-gatherer for the market, which office hath of late times been discontinued; by reason whereof divers citizens, inhabiting in or near the corn market, have taken upon them to keep and set forth on market days public bushels and measures for the measuring of corn and grain, and take toll for the same...
