Book excerpt: A multidisciplinary text, considering both general issues and principles of water law and administration at national and international level, dealing with current legal and institutional aspects of water resources management. New information has been added in this latest edition, including the situation in countries previously a part of the former Soviet Union. Added emphasis is given to areas of growing topical importance, such as stakeholders' influence on decisions, the need to maintain a minimum flow in water bodies and the necessity for legislation in support of water resource monitoring. There is new material on the European Union Water Framework Directive which is referenced heavily in the work. The book is aimed at those who carry out functions in water resources administration and those who deal with legal issues raised by water management. The book will be particularly useful to academics and graduate students of law, engineering, hydrology, hydrogeology, sanitary engineering and planners, as well as national and international water resources managers.

Available in PDF, EPUB and Kindle. Book excerpt: Markets for Water: Potential and Performance dispels many of the myths surrounding water markets and gives readers a comprehensive picture of the way that markets have developed in different parts of the world. It is possible, for example, for a water market to fail, and for the transaction costs in water markets to be excessive. Too often water trading is banned because the water resources have been developed with public funds and the water agencies do not want to lose control over water. There is also a concern that poor farmers or households will be disadvantaged by water trading. These concerns about public resources and the poor are not very different from those that have been voiced in the past about land sales. The problem is that in many cases the poor already have limited access to resources, but this limit is not due to water trading. In fact, water trading is likely to expand the access to water for many small-scale farmers. Markets for Water: Potential and Performance provides an analytical framework for water market establishment. It develops the necessary conditions for water markets and illustrates how they can improve both water management and economic efficiency. Finally, the book gives readers an up-to-date picture of what we have learned about water markets in a wide range of countries, from the US to Chile and India.

Available in PDF, EPUB and Kindle. Book excerpt: The governance of natural resources used by many individuals in common is an issue of increasing concern to policy analysts. Both state control and privatization of resources have been advocated, but neither the state nor the market have been uniformly successful in solving common pool resource problems. After critiquing the foundations of policy analysis as applied to natural resources, Elinor Ostrom here provides a unique body of empirical data to explore conditions under which common pool resource problems have been satisfactorily or unsatisfactorily solved. Dr Ostrom uses institutional analysis to explore different ways - both successful and unsuccessful - of governing the commons. In contrast to the proposition of the 'tragedy of the commons' argument, common pool problems sometimes are solved by voluntary organizations rather than by a coercive state. Among the cases considered are communal tenure in meadows and forests, irrigation communities and other water rights, and fisheries.

This book was released on 2006-01-01 with total page 187 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Ibaloi village of Kabayan Poblacion combines a subsistence agricultural economy with a market economy that has grown up as a result of subsequent waves of colonization. The Spanish arrived in the sixteenth century, following the trail of gold and slave-bearing Chinese trade junks, and were followed in 1898 by the Americans. The Ibaloi, who were gold miners and traders, cattle barons and vegetable producers, have since then come to be known as an Hispanicized uplands people, acculturated to Western ways and struggling to come to grips with new economic realities. This book examines the Ibaloi property system and demonstrates that the changes which have taken place since the Spanish arrival were complex and had numerous directions and relationships, many of them steered by the nature of Ibaloi society itself, others by the Spanish, and still others by the resources of Benguet Province. What began as a study of the Ibaloi property system rapidly became an exercise in understanding developments over time in social stratification, ritual and law. Wiber’s research has led her to challenge the dependency theory of legal pluralism, whereby peripheral zones are forced into economic dependency by having to exist within two legal structures, their own and another imposed by a central power zone, in favour of the social science view of legal pluralism. Thus all heterogeneous societies experience legal pluralism, but in different and individual ways, as people have a tendency to manipulate the law to their own advantage. She also takes issue with the narrowness of current anthropological terms relating to property systems and whether they are applicable to non-Western societies and argues for a reorientation of anthropology to end the tendency to generate simplistic models of property, kinship and law.

Available in PDF, EPUB and Kindle. Book excerpt: This paper seeks to answer a number of basic questions. First of all just what are land tenure rights and water rights? Second, how do the respective regimes compare? Third what linkages, if any, are there between land tenure rights and water rights and, if there are none, does this matter, either in general or as regards specific aspects of the interface? A key objective of the paper is to examine which aspects of the rights interface merit further research. In comparing the two regimes a final subsidiary objective of this paper is to try and identify which areas, if any, in one sector can shed light on areas for future research in the other.

Book excerpt: This volume, number 15 in the Studies in Water Policy and Management Series and joins two other volumes (8 and 10) that collectively summarize a significant part of the post-World War II experience of Western experts and donors with the development and management of irrigation in Third World countries. The evolution of understanding of Third World irrigation issues has been toward a greater appreciation of the potential for augmenting traditional production and water allocation systems with improved institutional arrangements for achieving allocative efficiency and equity. The need for local inputs for planning, system operation, and system maintenance is now widely recognized, as is the need for providing proper motivation for system administrators. The authors of this volume offer improved conceptual frameworks and analytic techniques applied to specific country and regional problems in hopes of edifying future experts and donors.

Available in PDF, EPUB and Kindle. Book excerpt: This book describes challenges in the policy and practices of the various water sectors in the Philippines that have led to water conflicts. Such conflicts arise in the nature of rural-urban competition, trans-administrative boundary issues, and inconsistencies between customary and state rules, and even within state rules. Using inter-, multi- and trans-disciplinary approaches, and analysing from various scales - community, local and national governments - the book discusses policies and strategies needed towards achieving water security especially for the poor. Reflective of the complex and urgent water policy and governance issues in many developing countries, the book offers valuable lessons and insights to policy makers, water sector managers, planners and regulators as well as to academics, researchers and students.
