Book excerpt: “This series will be a significant, valuable contribution to the history and literature of gay cinema. Each of these works will be valuable additions for academic and popular students of film and gay culture.”—Library Journal Law of Desire, one of three inaugural titles in Arsenal Pulp Press' new film book series Queer Film Classics, focuses on the 1987 homoerotic melodrama by Pedro Almodóvar, Spain's most successful contemporary film director. The film Law of Desire is a grand tale of love, lust, and amnesia featuring three main characters: a gay film director (played by Eusebio Poncela); his sister, an actress who was once his brother (Carmen Maura); and a repressed, obsessive stalker (a young Antonio Banderas). In the twenty-plus years since its first release, Law of Desire has been acknowledged as redefining the way in which cinema can portray the difficult affective relationships between homosexuality, gender, and sex. Taking his cue from the golden age of Latin American, American, and European melodrama, Almodóvar created a sentimental yet hard-edged film that believes in the utopian possibilities for new relationships that redeem people from their despair. Since its release, Almodóvar has become an Oscar-winning filmmaker who regularly delves into issues of sexuality, gender, and identity. This book examines the political and social context in which Almodóvar created Law of Desire, as well as its impact on LGBT cinema both in Europe and around the world.

Book excerpt: As an Iranian Muslim woman and a granddaughter of a well-known ayatollah, Shahla Haeri was accepted into the communities where she conducted her fieldwork on mut'a, temporary marriage. Mut'a is legally sanctioned among the Twelver Shi'ites who live predominantly in Iran. Drawing on rich interviews that would have been denied a Western anthropologist, the author describes the concept of a temporary-marriage contract, in which a man and an unmarried woman (virgin, widow, or divorcee) decide how long they want to stay married to each other (from one hour to ninety-nine years) and how much money is to be given to the temporary wife. Since the Iranian revolution of 1979, the regime has conduction an intensive campaign to revitalize this form of marriage, and Shi'i ulama (religious scholars) support it as positive, self-affirming, and cognizant of human needs. Challenged by secularly educated urban Iranian women, and men and by the West, the ulama have been called upon to address themselves to the implications of this custom for modern Iranian society, to respond to the changes that mut'a is legally equivalent to hire or lease, that it is abusive of women, and that it is in fact legalized prostitution. Law if Desire thus makes available previously untapped and undocumented data about an institution in which sexuality, morality, religious rules, secular laws, and cultural practices converge. This important work will be of interest to cultural anthropologist, religious scholars, scholars of the Middle East, and lawyers as well as to those interested in the role of women in Islamic society.

Book excerpt: This book offers the first comprehensive discussion of Lacan’s Kant with Sade, an essay widely recognised as one of his most important and difficult texts. Here, the reader will find a detailed roadmap for each section of the essay, including clarifications of the allusions, implicit borrowings and references in Lacan’s text, unique insights into the essay’s publication history, and a critical assessment of its reception. The author expertly defines key terms, explains complex theoretical arguments, and contextualises the work within a larger philosophical discourse. No prior knowledge of Lacan, Kant or Sade is assumed, allowing both newcomers and those who are well-versed in psychoanalysis, philosophy, and literary criticism to benefit from the book. This engaging book clears the path for a long overdue re-discovery and a proper appreciation of one of Lacan’s most challenging works, inspiring a renewed debate on the significance of Lacanian psychoanalysis for moral philosophy and literary theory.

Book excerpt: The act of reproduction, and its variants, never change much, but our ideas about the meaning of sex are in constant flux. Switch a decade, cross a border, or traverse class lines and the harmless pleasures of one group become the gravest crimes in another. Combining meticulous research and lively storytelling, The Boundaries of Desire traces the fast–moving bloodsport of sex law over the past century, and challenges our most cherished notions about family, power, gender, and identity. Starting when courts censored birth control information as pornography and let men rape their wives, and continuing through the "sexual revolution" and into the present day (when rape, gay rights, sex trafficking, and sex on the internet saturate the news), Berkowitz shows how the law has remained out of synch with the convulsive changes in sexual morality. By focusing on the stories of real people, Berkowitz adds a compelling human element to what might otherwise be faceless legal battles. The law is made by people, after all, and nothing sparks intolerance – on the left and right –– more than sex. Ultimately, Berkowitz shows the emptiness of sanctimonious condemnation, and argues that sexual questions are too subtle and volatile for simple, catch–all solutions.

Available in PDF, EPUB and Kindle. Book excerpt: Since the Asian financial crisis of the late 1990s, Indonesia has undergone a radical program of administrative decentralization and neoliberal reforms. In Methods of Desire, author Aurora Donzelli explores these changes through an innovative perspective—one that locates the production of neoliberalism in novel patterns of language use and new styles of affect display. Building on almost two decades of fieldwork, Donzelli describes how the growing influence of transnational lending agencies is transforming the ways in which people desire and voice their expectations, intentions, and entitlements within the emergent participatory democracy and restructuring of Indonesia’s political economy. She argues that a largely overlooked aspect of the Era Reformasi concerns the transition from a moral regime centered on the expectation that desires should remain hidden to a new emphasis on the public expression of individuals’ aspirations. The book examines how the large-scale institutional transformations that followed the collapse of the Suharto regime have impacted people’s lives and imaginations in the relatively remote and primarily rural Toraja highlands of Sulawesi. A novel concept of the individual as a bundle of audible and measurable desires has emerged, one that contrasts with the deep-rooted reticence toward the expression of personal preferences. The spreading of foreign discursive genres such as customer satisfaction surveys, training sessions, electoral mission statements, and fundraising auctions, and the diffusion of new textual artifacts such as checklists, flowcharts, and workflow diagrams are producing forms of citizenship, political participation, and moral agency that contrast with the longstanding epistemologies of secrecy typical of local styles of knowledge and power. Donzelli’s long-term ethnographic study examines how these foreign protocols are being received, absorbed, and readapted in a peripheral community of the Indonesian archipelago. Combining a telescopic perspective on our contemporary moment with a microscopic analysis of conversational practices, the author argues that the managerial forms of political rationality and the entrepreneurial morality underwriting neoliberal apparatuses proliferate through the working of small cogs, that is, acts of speech. By examining these concrete communicative exchanges, she sheds light on both the coherence and inconsistency underlying the worldwide diffusion of market logic to all domains of life.

Book excerpt: Containing the best interdisciplinary work in international law, this book offers an intelligent and thought-provoking analysis of the genealogy of Western capitalist ‘development’. Putting forth ground-breaking arguments and challenging the traditional boundaries of thinking about the concept of development and underdevelopment, it provides readers with a new perspective on the West's relationship with the rest of the world. With Jennifer Beard’s departure from the common position that development and underdevelopment are conceptual outcomes of the Imperialist era, The Political Economy of Desire positions the genealogy of development within early Christian writings in which the Western theological concepts of sin, salvation and redemption are expounded. Drawing upon legal theory, anthropology, economics, historiography, philosophy of science, theology, feminism, cultural studies and development studies the author explores: the link between the writings of early theologians and the processes of modern identity formation – tracing the concept of development to a particularly Christian dynamic how the promise of salvation continues to influence Western ontology. An innovative and topical work, this volume is an essential read for those interested in international law and socio-legal theory.

Available in PDF, EPUB and Kindle. Book excerpt: Description Can a woman choose whom to marry if her father disapproves of the match? Does sex remain sex when it becomes work? Can a man become a woman because he feels like one? Is it the law's task to ensure heterosexuality? Does reproduction need to be regulated? The State attempts, with law as its instrument, to answer these questions for us, through legislation and, when contested, through court judgments. This brilliantly insightful and superbly argued book calls into serious question the wisdom-indeed, the intent-of our lawmakers and the judiciary. Though India's laws and courts claim to know what they mean when they declare an expression of desire immoral or criminal, obscene or unnatural, upon inquiry, they turn out to be building on very weak and often casteist and patriarchal assumptions. Thus we have the law struggling to 'rescue' 'fallen women', for sex work cannot be work, but a sign of immorality; a Supreme Court judge can exonerate the artist M.F. Husain on charges of obscenity, but also claim that 'obscenity lies in the eyes of the beholder', leaving us wondering how, then, the law can ever define what's obscene; and while a court may declare that the 'third gender' has fundamental rights, no one really knows what fundamental rights have to do with gender in the first place. Teacher and queer theorist Madhavi Menon-author of Infinite Variety, a celebrated study of desire in India-shows us the 'conundrums and paradoxes' that result when the law is entangled with sex and sexuality-and why we 'need to play with, rather than stay with, the Law of Desire'.

Book excerpt: Feminine Law: Freud, Free Speech, and the Voice of Desire explores the conjunction between psychoanalysis and democracy, in particular their shared commitments to free speech. In the process, it demonstrates how lawful constraints enable an embodied space or "gap" for the potentially disruptive but also liberating and novel flow of desire and its symbols. This space, intuited by the First Amendment as it is by Freud's free association, enables personal and collective sovereignty. By naming a "feminine law," we mark the primacy a space between the conceivable and the inconceivable, between knowledge and mystery. What do political free speech and psychoanalytic free association have in common, besides the word "free"? And what do Sigmund Freud and Justice Louis Brandeis share besides a world between two great wars? How is the female body a neglected key to understanding the conditions and contradictions of free discourse? Drs. Jill Gentile and Michael Macrone take up these questions, and more, in their wide-ranging, often passionate exploration of the hidden legacy of Freud and the Founding Fathers.

Book excerpt: Thomas Armstrong vows only the loss of his faculties could ever convince him to take Amelia Bertram under his care during her father’s absence from England. Sadly, that loss does occur… the moment Lady Amelia publicly states that rumors of his exalted sexual prowess are more fable than fact. Responding like any man with an ounce of pride would, he picks up the gauntlet she threw down on the ballroom floor. After the death of her mother, Amelia Bertram is further devastated by the withdrawal of her father’s love. To survive the double heartbreak, she walls off her emotions. Now, her social faux pas finds her sharing a roof with the very man who took her place in her father’s affections…the man her father hopes one day to call son. In the seclusion of his country estate, Thomas glimpses in Amelia a vulnerability buried beneath a mountain of jealousy and pain. In turn, she discovers the ton’s ‘golden Greek god’ is more than the sum of rumor and innuendo. Soon a fire ignites between them not even a deluge from the Thames can extinguish. Can they set aside their plans—his for revenge, hers to escape—to forge a love powerful enough to surmount his pride and crumble the walls surrounding her heart? *Reissue.
