Book Synopsis Enterprise and Social Rights by : Adalberto Perulli
Download or read book Enterprise and Social Rights written by Adalberto Perulli and published by Kluwer Law International B.V.. This book was released on 2017-06-15 with total page 450 pages. Available in PDF, EPUB and Kindle. Book excerpt: Globalization has led to growing labour fragmentation and widening of gaps in social protection. Although the enterprise is increasingly expected to be socially responsible, in actuality extreme worker inequalities and social dumping have become ubiquitous worldwide. This volume – the first to focus attention on the ‘theory of the firm’ as it reveals itself in today’s world from a multidisciplinary perspective – underscores the necessity to rebuild a new scientifically controlled paradigm that acknowledges and regulates the dimension of power in the functioning of the organization. In their contributed essays, nineteen renowned scholars in labour law and industrial relations rethink the firm, its conception, its value, and its regulation, analysing such aspects as the following: – labour-management relations issues that arise when companies go global but workers remain local; – the firm as a social construction; – the continuing necessity for collective bargaining; – concealment of the employment relationship under the guise of self-employment; – concealment of the real employer behind figureheads and shell companies; – social welfare effects of outsourcing; – the company’s interaction with the network of suppliers and with local education processes; – determining who actually carries responsibility towards workers; – overcoming companies’ drive to enter the global market in response to national regulation; – realizing the notion of ‘duty of care’; – mechanisms of participation of workers in the management of the enterprise; and – the persistent limitations that women face in the workplace, even when worker participation is advocated. With attention to innovative developments in Germany, Italy, Japan, and other countries, analyses include case studies of specific companies as well as case law, in particular the European Court of Justice’s jurisprudence in matters of collective dismissals, seconded workers, and public contracts. In their head-on tackling of the fragmentation and blurring of social responsibility in enterprise organization, these important essays propose a view of the enterprise as a factor in a new ‘constitutionalisation’ of labour that shifts employment protection from single legal entities to the network’s economic activity, thus realigning the legal boundaries of the enterprise with its economic reality. As a compelling investigation of how a satisfactory implementation of labour standards in the fragmented enterprise can be guaranteed, this book will be studied by entrepreneurs, managers, consultants, corporate lawyers, judges, human rights experts, and trade unionists, and will be welcomed by academics and researchers in industrial relations and labour law.

Proposals for more effective natural resource governance emphasize the importance of institutions and governance, but say less about the political conditions under which institutional change occurs. Governing Extractive Industries synthesizes findings regarding the political drivers of institutional change in extractive industry governance. It analyses resource governance from the late nineteenth century to the present in Bolivia, Ghana, Peru, and Zambia, focusing on the ways in which resource governance and national political settlements interact. The authors focus on the ways in which resource governance and national political settlements interact, exploring the nature of elite politics, the emergence of new political actors, forms of political contention, changing ideas regarding natural resources and development, the geography of natural resource deposits, and the influence of the transnational political economy of global commodity production.

Second, the report confirms that these three countries together make up an incredibly complex, dynamic, and interconnected ecosystem in which humans play a dominant and decisive role. Book excerpt: Through his voluminous and in?uential writings, editorial activities, organi- tional leadership, intellectual acumen, and strong sense of history, Clifford - brose Truesdell III (1919–2000) was the main architect for the renaissance of - tional continuum mechanics since the middle of the twentieth century. The present collection of 42 essays and research papers pays tribute to this man of mathematics, science, and natural philosophy as well as to his legacy. The ?rst ?ve essays by B. D. Coleman, E. Giusti, W. Noll, J. Serrin, and D. Speiser were texts of addresses given by their authors at the Meeting in memory of Clifford Truesdell, which was held in Pisa in November 2000. In these essays the reader will ?nd personal reminiscences of Clifford Truesdell the man and of some of his activities as scientist, author, editor, historian of exact sciences, and principal founding member of the Society for Natural Philosophy. The bulk of the collection comprises 37 research papers which bear witness to the Truesdellian legacy. These papers cover a wide range of topics; what ties them together is the rational spirit. Clifford Truesdell, in his address upon receipt of a Birkhoff Prize in 1978, put the essence of modern continuum mechanics succinctly as “conceptual analysis, analysis not in the sense of the technical term but in the root meaning: logical criticism, dissection, and creative scrutiny.

Book Synopsis The Informal Economy by : Alejandro Portes
Download or read book The Informal Economy written by Alejandro Portes and published by . This book was released on 1989-03 with total page 344 pages. Available in PDF, EPUB and Kindle. Book excerpt: A New York roofer requests payment in cash. A Bogota car mechanic sets up "shop" on a quiet side street. Four Mexican immigrants assemble semiconductors in a San Diego home. A Leningrad doctor sells needed medicine to a desperate patient. All are part of a growing worldwide phenomenon that is widely known but little understood. The informal or underground economy is thriving today, not only in the Third World countries where it was first reported and studied but also in Eastern Europe and the developed nations of the West. The Informal Economy is the first book to bring together studies from all three of these settings and to integrate them into a coherent theoretical framework. Taking an international perspective, the authors dispel a number of misconceptions about the informal economy. They make clear, for instance, that it is not solely a province of the poor. Cutting across social strata, it reflects a political and economic realignment between employers and workers and a shift in the regulatory mission of the government. Throughout, the authors' theoretical observations serve not only to unify material from diverse sources but also to map out directions for further research.
