Book Synopsis Sentimental Figures of Empire in Eighteenth-Century Britain and France by : Lynn Festa
Download or read book Sentimental Figures of Empire in Eighteenth-Century Britain and France written by Lynn Festa and published by JHU Press. This book was released on 2006-10-15 with total page 311 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this ambitious and original study, Lynn Festa examines how and why sentimental fiction became one of the primary ways of representing British and French relations with colonial populations in the eighteenth century. Drawing from novels, poetry, travel narratives, commerce manuals, and philosophical writings, Festa shows how sentimentality shaped communal and personal assertions of identity in an age of empire. Read in isolation, sentimental texts can be made to tell a simple story about the emergence of the modern psychological self. Placed in conversation with empire, however, sentimentality invites both psychological and cultural readings of the encounter between self and other. Sentimental texts, Festa claims, enabled readers to create powerful imagined relations to distant people. Yet these emotional bonds simultaneously threatened the boundaries between self and other, civilized and savage, colonizer and colonized. Festa argues that sentimental tropes and figures allowed readers to feel for others, while maintaining the particularity of the individual self. Sentimental identification thus operated as a form of differentiation as well as consolidation. Festa contends that global reach increasingly outstripped imaginative grasp during this era. Sentimentality became an important tool for writers on empire, allowing conquest to be portrayed as commerce and scenes of violence and exploitation to be converted into displays of benevolence and pity. Above all, sentimental texts used emotion as an important form of social and cultural distinction, as the attribution of sentience and feeling helped to define who would be recognized as human.
Book Synopsis Masters, Servants, and Magistrates in Britain and the Empire, 1562-1955 by : Douglas Hay
Download or read book Masters, Servants, and Magistrates in Britain and the Empire, 1562-1955 written by Douglas Hay and published by Univ of North Carolina Press. This book was released on 2005-10-12 with total page 607 pages. Available in PDF, EPUB and Kindle. Book excerpt: Master and servant acts, the cornerstone of English employment law for more than four hundred years, gave largely unsupervised, inferior magistrates wide discretion over employment relations, including the power to whip, fine, and imprison men, women, and children for breach of private contracts with their employers. The English model was adopted, modified, and reinvented in more than a thousand colonial statutes and ordinances regulating the recruitment, retention, and discipline of workers in shops, mines, and factories; on farms, in forests, and on plantations; and at sea. This collection presents the first integrated comparative account of employment law, its enforcement, and its importance throughout the British Empire. Sweeping in its geographic and temporal scope, this volume tests the relationship between enacted law and enforced law in varied settings, with different social and racial structures, different economies, and different constitutional relationships to Britain. Investigations of the enforcement of master and servant law in England, the British Caribbean, India, Africa, Hong Kong, Canada, Australia, and colonial America shed new light on the nature of law and legal institutions, the role of inferior courts in compelling performance, and the definition of "free labor" within a multiracial empire. Book Synopsis Essays in the History of Canadian Law by : Christopher English
Download or read book Essays in the History of Canadian Law written by Christopher English and published by University of Toronto Press. This book was released on 2005-12-15 with total page 438 pages. Available in PDF, EPUB and Kindle. Book excerpt: The study of Canadian legal history has seen a remarkable growth in the past decade, nowhere more so than in Atlantic Canada. Given its early settlement and some of the liberties taken with legal procedure there - as well as some creative interpretations of English law – the region is ripe for close study in the legal history field. This new collection examines that history on 'two islands:' Newfoundland and Prince Edward Island. The essays examine legal themes, developments, and disputes, and offer a framework for comparing ways of administering justice through the courts in the eighteenth and nineteenth centuries. The cases examined are particularly interesting for the light they throw on legal process and, especially, on the motives of the parties. Unlike in contemporary England and Upper Canada, the English precedents gave way to local needs as equitable regimes emerged that put family and community interests first, and treated all members of the family in ways tailored to their personal needs and circumstances. This volume, which includes a number of essays examining women's legal status and access to the courts, is a comprehensive and fascinating examination of legal history in two Canadian provinces.

Book Synopsis The First English Detectives by : J. M. Beattie

Available in PDF, EPUB and Kindle. Book excerpt: This is the first comprehensive study of the Bow Street Runners, a group of men established in the middle of the eighteenth century by Henry Fielding, with the financial support of the government, to confront violent offenders on the streets and highways around London. They were developed over the following decades by his half-brother, John Fielding, into what became a well-known and stable group of officers who acquired skill and expertise in investigating crime, tracking and arresting offenders, and in presenting evidence at the Old Bailey, the main criminal court in London. They were, Beattie argues, detectives in all but name. Fielding also created a magistrates' court that was open to the public, at stated times every day. A second, intimately-related theme in the book concerns attitudes and ideas about the policing of London more broadly, particularly from the 1780s, when the detective and prosecutorial work of the runners came to be challenged by arguments in favour of the prevention of crime by surveillance and other means. The last three chapters of the book continue to follow the runners' work, but at the same time are concerned with discussions of the larger structure of policing in London - in parliament, in the Home Office, and in the press. These discussions were to intensify after 1815, in the face of a sharp increase in criminal prosecutions. They led - in a far from straightforward way - to a fundamental reconstitution of the basis of policing in the capital by Robert Peel's Metropolitan Police Act of 1829. The runners were not immediately affected by the creation of the New Police, but indirectly it led to their disbandment a decade later.
