There are two methods of teaching the Roman Law, both of which have dis tinguished supporters. One is to present it as a thing apart, without reference to the present. The student is left to make any applications which he may see fit. The other method is to Show the way in which the Roman Law has grown into the modern Civil Law. In a country like England the former method is the more natural, because the Roman Law and the English Law are essentially different systems. In a country of the Civil Law, like the Province of Quebec, the latter method is, I think, the more useful. Between the ancient and the modern law, there is no breach of continuity; the one has grown out of the other. Whichever method we adopt, the law cannot be made intelligible to the student. Book excerpt: Excerpt from Historical Introduction to the Roman Law The facts that another edition of this book has been called for, and that the second edition has been translated into Portuguese indicate that it makes an appeal to students who are attending lectures upon the Institutes. It does not pretend to be a systematic history of the Roman law, nor is it intended in any way to take the place of a commentary on the Institutes of Justinian. It is rather a series of chapters on problems, mainly historical, which confront the student who is beginning the Roman law. Its aim is to be complementary to a course of lectures, and to supply a historical background. The historical notices contained in the Institutes of Justinian are so fragmentary that without more information the student does not see the law in its true perspective. He has to be reminded that the law of Justinian is the culmination of a long history, and that the Romans started with a little body of Aryan customs, out of which their extraordinary genius was able by slow degrees to shape a legal system of the greatest refinement. Unfortunately the pressure of other subjects renders it impossible for most students to make a detailed study of the history of Roman law. If the "introduction" is not to encroach upon the time assigned to the practical law it must be kept within narrow limits. The difficulty is largely one of selection.
