Herman Röchling was prosecuted and sentenced at Nuremberg for war crimes in 1946 but, under American pressure, he was pardoned in 1951 in order to revive Germany quickly and build a strong Europe in the face of the Soviet threat. This shocking book is the implacable account of one man’s deception and the weight of realpolitik. Margaret Manale is an historian and Germanist, and researcher at the CNRS, where she specializes in East Germany and the post-Wall recomposition of German heritage. She was a translator and interpreter in Munich before joining Maximilien Rubel’s team that prepared the edition of Karl Marx’s works in the Bibliothèque de la Pléiade (Gallimard).

Todt was the brilliant builder of the world’s first superhighway system, the Autobahn, and the architect of the German West Wall, the Siegfried Line, that predated the later Atlantic and East Walls. The builder of each of the wartime “Führer Headquarters,” as well as the submarine pens, Todt was killed in a still-mysterious airplane crash that may well have been a Nazi death plot, though he was given a state funeral by Hitler. Todt was succeeded as German Minister of Armaments and War Production by the Führer’s longtime personal architect, Albert Speer, who was described by the Allies after the war as having prolonged the conflict by at least a year. Called a genius by Hitler, Speer designed and built the prewar Nuremberg Nazi Party Congress rally stands and buildings. More importantly, amid the constant rain of Allied bombs and the Soviet advances from the East, Speer managed to keep the German industrial machine running until the spring of 1945, though it was driven ever further underground. He also allocated resources to fortifications and counterattacks, like the V-missile installations, against both West and East, in attempts to stave off defeat. Convicted as a war criminal at Nuremberg, Speer served twenty years at Spandau Prison and remained a Nazi apologist who died in London in 1981 on the anniversary of the German invasion of Poland. Together, Todt and Speer were the pillars that propped up the Third Reich through the vicissitudes of battlefield fortune. With over three hundred photographs, this is the first work that examines their role in history’s most terrible war.

Several instances of war crimes trials are familiar to all scholars, but in order to advance understanding of the development of international criminal law, it is important to provide a full range of evidence from less-familiar trials. This book therefore provides an essential resource for a more comprehensive overview, uncovering and exploring some of the lesser-known war crimes trials that have taken place in a variety of contexts: international and domestic, northern and southern, historic and contemporary. It analyses these trials with a view to recognising institutional innovations, clarifying doctrinal debates, and identifying their general relevance to contemporary international criminal law. At the same time, the book recognises international criminal law's history of suppression or sublimation: What stories has the discipline refused to tell? Book excerpt: This study explores an exemplary instance of the close interaction between private and official interests in planning and executing the programs of the Nazi government, namely the acquisition in 1941 of the Rombach steel works by the German industrialist Friedrich Flick. The industrial concern headed by Flick was among the largest and most influential steel producers and manufacturers of war material in the German economy during World War II. Its activities in the occupied territories of western Europe centered on control of the Rombach works, a large operation established in Lorraine in the late nineteenth-century by German industrialists and expropriated by France, along with the entire region, in the aftermath of the First World War. After successful military operations against France in 1940, the Nazi regime actively sought the collusion of the German industrial community in mobilizing the productive capacity of occupied territories for the war effort, and numerous private German businessmen advanced claims on the lucrative assets in Lorraine and adjacent regions. In his bid to gain control of the Rombach works, Flick was successful for reasons specific to his position within the Nazi German economic system and the character of his interests. This account of his activities, then, serves as a fine example of Nazi economic and occupation policy and its response to party, business, and bureaucratic influences.

However, since the 1940s no defendants have been charged with this crime, with some states actively opposing the notion of punishing aggression. The option of trying an individual for aggression is expressly included in the statute of the International Criminal Court. In 2010 the Assembly of States Parties adopted a definition of the crime of aggression and conditions of the exercise of jurisdiction over this crime by the Court. The Assembly also agreed that the decision on including the crime of aggression within the Court’s jurisdiction would be made in 2017 at the earliest. It is still internationally debatable whether the criminalisation of aggression is an outcome to strive for, or whether its abandonment is more preferable. Among Germany's leading opponents of trade unions, Saar employers were revered for their system of factory organization, which was both authoritarian and paternalistic, stressing discipline and punitive measures and seeking to regulate behavior on and off the job. In its repressive and beneficent dimensions, the Saar system provided a model for state labor and welfare policy during much of the 1880s and 1890s. Dennis Sweeney examines the relationship between labor relations in heavy industry and public life in the Saar as a means of tracing some of the wider political-ideological changes of the era. Book excerpt: At the end of World War II the Allies faced a threefold challenge: how to punish perpetrators of appalling crimes for which the categories of 'genocide' and 'crimes against humanity' had to be coined; how to explain that these had been committed by Germany, of all nations; and how to reform Germans. The Allied answer to this conundrum was the application of historical reasoning to legal procedure. In the thirteen Nuremberg trials held between 1945 and 1949, and in corresponding cases elsewhere, a concerted effort was made to punish key perpetrators while at the same time providing a complex analysis of the Nazi state and German history. Building on a long debate about Germany's divergence from a presumed Western path of development, Allied prosecutors sketched a historical trajectory which had led Germany to betray the Western model. Historical reasoning both accounted for the moral breakdown of a 'civilised' nation and rendered plausible arguments that this had indeed been a collective failure rather than one of a small criminal clique. The prosecutors therefore carefully laid out how institutions such as private enterprise, academic science, the military, or bureaucracy, which looked ostensibly similar to their opposite numbers in the Allied nations, had been corrupted in Germany even before Hitler's rise to power. While the argument, depending on individual protagonists, subject matters, and contexts, met with uneven success in court, it offered a final twist which was of obvious appeal in the Cold War to come: if Germany had lost its way, it could still be brought back into the Western fold. The first comprehensive study of the Nuremberg trials, The Betrayal thus also explores how history underpins transitional trials as we encounter them in today's courtrooms from Arusha to The Hague.
