No other book is devoted exclusively to the representation of plaintiffs in helicopter crash cases. These unique cases require a different approach and techniques, which you will learn from accomplished trial lawyer Gary Robb, who has used these same techniques in a brilliant career as a trial lawyer. This indispensable text travels through the different knowledge and skill sets critical in the successful handling of these cases, ranging from the basic elements of helicopter structure and flight, through the preliminary factual investigation, filing the case, discovery, common defenses, damages and trial. Real helicopter case examples are utilized throughout so as to give context to the suggestions and techniques discussed. The author also recommends safety improvements within the helicopter industry for preventing these accidents in the future.

Book excerpt: "Much has happened as affects helicopter crash litigation in the intervening eight years since the publication of the Second Edition of this book in 2015. Highlights of recent developments covered in this Third Edition include: 1. The U.S. Supreme Court clarified the jurisdictional landscape for the better in Ford Motor Co. v. Montana Eighth Judicial District by emphatically rejecting the defendant manufacturer's claim that the litigation must "arise out of" the defendant's contacts with the forum state and re-affirming the stream of commerce doctrine. This unanimous Supreme Court decision is arguably the most significant development in helicopter crash litigation as it substantially minimizes the prospect of culpable manufacturing defendants' securing dismissal on jurisdictional grounds. 2. The "Helicopter Fuel System Safety" Amendment was enacted to require that all helicopters manufactured and delivered for use in the United States after April 5, 2020 must be equipped with crash resistant fuel systems (CRFS). There is no single greater recent safety improvement within the entire helicopter industry than the addition of CRFS to helicopters. 3. The Federal Officer Removal Statute was rejected as a basis for any aircraft manufacturing defendant's removal of a design defect case to federal court. The Ninth Circuit's decision in Riggs v. Airbus Helicopters, Inc. -- which the author briefed and argued - - laid to rest any notion that aircraft manufacturers are "agents of the FAA" as Airbus Helicopters strained to argue. The defendant sought a writ of certiorari before the U.S. Supreme Court which was summarily denied. 4. The global pandemic of 2020-21 engendered the widespread and continued use of virtual or remote depositions in civil discovery and helicopter crash litigation was no exception. 5. The universal social and business usage of electronic media has led to a corresponding explosion in the use of electronically-stored information (ESI) discovery. So-called e-discovery encompasses all manner of electronic communication including e-mails, social media, cell phone data and e- storage, all of which is proving fertile discovery grounds in helicopter crash litigation In addition to addressing in detail the foregoing developments, this Third Edition: Updates and "modernizes" Chapters 1 and 2 dealing with helicopter operation and common failure modes. Updates all of the legal, statutory and regulatory framework applicable to helicopter crash litigation. Continues to expand and (hopefully) upgrade the actual practice techniques and methods recommended for handling helicopter crash litigation including new material on jury selection, opening statement and closing argument. Incorporates material from recent helicopter crash cases handled by the author including the Calabasas, California helicopter crash that caused the deaths of NBA legend Kobe Bryant and his daughter Gianna; the Frisco, Colorado crash that resulted in horrific 90% total body burn injuries to flight nurse David Repsher because of the lack of a crash-resistant fuel system (CRFS); and the Kentucky air ambulance helicopter crash that killed three crew members caused by a defectively manufactured main rotor blade. Updates helicopter accident statistics and reviews ongoing efforts for industry safety improvements. As with the First and Second Editions, the greatest outcome of all would be to render the need for helicopter crash litigation much more infrequent if not all together unnecessary"--

Book excerpt: The president rushes across the South Lawn through a pounding thunderstorm to Marine One to fly to Camp David late at night. His advisers plead with him not to fly, but he insists. He has arranged a meeting that only three people in his administration know about. After fighting its way through the brutal thunderstorm on the way to Camp David, Marine One crashes into a ravine in Maryland, killing all aboard. The government blames the European manufacturer of the helicopter and accuses them of killing the president. Senate Investigations and Justice Department accusations multiply as Mike Nolan, a Marine Corps reserve helicopter pilot and trial attorney in civilian life, is hired to defend the company from the criminal investigations, then from a wrongful death lawsuit brought by the most notorious lawyer in America on behalf of the First Lady. Nolan knows that to prevail in the firestorm against his client, he has to find out what really caused Marine One to crash, and why the president threw caution aside to go to a meeting no one seems to know about. To clear his client, Nolan must win the highest-profile trial of the last hundred years with very little working for him, and everything working against him. Marine One expertly mixes political intrigue with courtroom drama and fast-paced action in the most exciting thriller of the year.

Since then, the book has become the standard work on the intricacies of litigation under the Foreign Sovereign Immunities Act. In the most recent Supreme Court decision applying the Foreign Sovereign Immunities Act, both the majority and the dissent cited the book as the definitive work on the topic.

Available in PDF, EPUB and Kindle. Book excerpt: Economists broadly define financial asset price bubbles as episodes in which prices rise with notable rapidity and depart from historically established asset valuation multiples and relationships. Financial economists have for decades attempted to study and interpret bubbles through the prisms of rational expectations, efficient markets, and equilibrium, arbitrage, and capital asset pricing models, but they have not made much if any progress toward a consistent and reliable theory that explains how and why bubbles (and crashes) evolve and can also be defined, measured, and compared. This book develops a new and different approach that is based on the central notion that bubbles and crashes reflect urgent short-side rationing, which means that, as such extreme conditions unfold, considerations of quantities owned or not owned begin to displace considerations of price.

This book was released on 2012-06-07 with total page 1395 pages. Available in PDF, EPUB and Kindle. Book excerpt: The flying public, airlines, and governments will all agree on one date that changed commercial flying: that was September 11, 2001. The first edition of Aviation Law: Cases, Laws and Related Sources, described early consequences of that event, particularly compensation of victims and early tightening of aviation security. Subsequently laws and regulations affecting all aspects of aviation changed so rapidly that it became difficult to set a cut-off date for the second edition. The rapid flow of events made an update urgent. Several gaps in the materials of the first edition became evident as the book was used. The authors filled those gaps, pruned old materials and added much new material describing not only the later developments, but also evolving economics and flight technology. The objective of the case book is to offer a basic handbook for air law practitioners providing them with a starting point for almost any subject they may encounter. For example, a lawyer specializing in liability law will quickly be able to find basic materials on the International Civil Aviation Organization (ICAO), air carrier licensing, FAA certification, and labor law. The book continues to present aviation law from the American point of view. Thus the book will be valuable for foreign air lawyers who are guiding foreign airlines in service to the very important North American pool of air traffic. The book also explains the international scene to American air lawyers so that they may guide their clients who provide foreign service. New chapters on liability for cargo damage and for ground damages have been added and new materials on the legal rights of lessors, successors, actual carriers and code-shares. A chapter on environmental regulation of aviation noise and emissions is also new. All the main subjects listed in the first edition are significantly updated. The three authors are veteran transportation lawyers and continue their activities in this field.

Available in PDF, EPUB and Kindle. Book excerpt: "The charge of securing corporate America falls upon its business leaders. This book, offered by Ernst & Young and written by Mark Doll, Sajay Rai, and Jose Granado, is not only timely, but comprehensive in outlook and broad in scope. It addresses many of the critical security issues facing corporate America today and should be read by responsible senior management." --Former Mayor of New York, Rudolph W. Giuliani "To achieve the highest possible level of digital security, every member of an organization's management must realize that digital security is 'baked in,' not 'painted on.'" --from Defending the Digital Frontier: A Security Agenda Like it or not, every company finds itself a pioneer in the digital frontier. And like all frontiers, this one involves exploration, potentially high returns . . . and high risks. Consider this: According to Computer Economics, the worldwide economic impact of such recent attacks as Nimda, Code Red(s), and Sircam worms totaled $4.4 billion. The "Love Bug" virus in 2000 inflicted an estimated $8.75 billion in damage worldwide. The combined impact of the Melissa and Explorer attacks was $2.12 billion. Companies were hurt as much in terms of image and public confidence as they were financially. Protecting the "digital frontier" is perhaps the greatest challenge facing business organizations in this millennium. It is no longer a function of IT technologists; it is a risk management operation requiring sponsorship by management at the highest levels. Written by leading experts at Ernst & Young, Defending the Digital Frontier: A Security Agenda deconstructs digital security for executive management and outlines a clear plan for creating world-class digital security to protect your organization's assets and people. Achieving and defending security at the Digital Frontier requires more than just informed decision-making at the top level. It requires a willingness to change your organization's mindset regarding security. Step by step, Defending the Digital Frontier shows you how to accomplish that. With detailed examples and real-world scenarios, the authors explain how to build-in the six characteristics that a world-class digital security system must possess. You must make your system: * Aligned with the organization's overall objectives. * Enterprise-wide, taking a holistic view of security needs for the entire, extended organization. * Continuous, maintaining constant, real-time monitoring and updating of policies, procedures, and processes. * Proactive to effectively anticipate potential threats. * Validated to confirm that appropriate risk management and mitigation measures are in place. * Formal, so that policies, standards, and guidelines are communicated to every member of the organization. An intrusion is bound to occur to even the most strongly defended systems. Will your organization be prepared to react, or lapse into chaos? Defending the Digital Frontier introduces the Restrict, Run, and Recover(r) model that guides organizations in formulating and implementing a clear, enterprise-wide, Agenda for Action to anticipate, detect, and react effectively to intrusions. You will learn how to roll out an effective Security Awareness and Training Program, establish Incident Response procedures, and set in place Digital Security Teams to control damage and manage risk in even worst-case scenarios. The digital threat knows no borders and honors no limits. But for the prepared organization, tremendous rewards await out on the digital frontier. By strengthening collective digital security knowledge from the top down and developing a rock-solid, comprehensive, on-going security agenda, every organization can build a secure future. Defending the Digital Frontier will get you there.
