A series of promotion, co-operation and monitoring activities are planned in member states in view of ensuring effective implementation of the guidelines for the benefit of all children.

De 47 lidstaten van de Raad van Europa worden aangespoord hun nationale rechtsstelsels aan te passen aan de specifieke behoeften van kinderen en de kloof te overbruggen tussen internationaal overeengekomen beginselen en de werkelijkheid. In dit verband worden in de toelichting voorbeelden gegeven van goede praktijken en oplossingen aangereikt voor bepaalde wettelijke en praktische tekortkomingen in justitie voor kinderen. Deze richtsnoeren vormen een integrerend onderdeel van de strategie van de Raad van Europa voor de rechten van het kind en van het programma „Bouwen aan een Europa voor en met kinderen“. In de lidstaten zijn promotie-, samenwerkings-en toezichtsactiviteiten gepland die ervoor moeten zorgen dat de richtsnoeren daadwerkelijk ten uitvoer worden gelegd, ten behoeve van alle kinderen.

One podsjećaju na načela najboljih interesa djeteta, skrbi i poštovanja, sudjelovanja, jednakog postupanja i vladavine prava i promiču ih, Smjernice rješavaju pitanja kao što su pravo na obaviještenost, zastupanje i sudjelovanje, zaštita privatnosti, sigurnost, višedisciplinarni pristup i obuka, zaštitna sredstva u svim fazama postupka i lišenje slobode. Četrdeset sedam država članica Vijeća Europe ohrabruju se da prilagode svoje pravne sustave konkretnim potrebama djece, premošćujući jaz između međunarodno dogovorenih načela i stvarnosti. S tim ciljem, obrazloženje nudi primjere dobre prakse i predlaže načine za rješavanje i ispravljanje pravnih i praktičnih praznina u pravosuđu za djecu. Ove su smjernice sastavni dio strategije Vijeća Europe o dječjim pravima i njegovog programa „Izgradnja Europe za djecu i s, djecom“ koji je 2006. godine pokrenuo Monako. Planira se niz promocija, suradnje i aktivnosti praćenja u državama članicama radi osiguranja djelotvorne provedbe smjernica na korist sve djece.

Vzťahujú sa na všetky prípady, keď je pravdepodobné, že sa deti z akéhokoľvek dôvodu a v akomkoľvek postavení dostanú do kontaktu s trestným, občianskym alebo správnym súdnym systémom. Upozorňujú a podporujú zásady záujmu dieťaťa, starostlivosti a rešpektu, účasti, rovnakého zaobchádzania a právneho štátu. Usmernenia sa zaoberajú otázkami, akými sú právo na informácie, zastupovanie a účasť, ochrana súkromia, bezpečnosť, multidisciplinárny prístupu a odborná príprava, ako aj záruky vo všetkých fázach konania a pozbavenia slobody. Štyridsaťsedem členských štátov Rady Európy sa vyzýva, aby svoje právne systémy prispôsobili osobitným potrebám detí, aby premostili medzeru medzi medzinárodne uznanými zásadami a realitou. Na tento účel dôvodová správa poskytuje príklady osvedčených postupov a navrhuje možnosti, ako vyriešiť a odstrániť právne a praktické nedostatky v oblasti súdnictva pre deti. Tieto usmernenia tvoria neoddeliteľnú súčasť stratégie Rady Európy v oblasti práv detí a jej programu „Budovanie Európy pre deti a s deťmi“. V členských štátoch je naplánovaný súbor činností v oblasti propagácie, spolupráce a monitorovania, ktorých cieľom je zabezpečiť účinné vykonávanie usmernení v prospech všetkých detí.

З цією метою, у пояснювальній записці містяться приклади кращої практики, а також пропонуються рішення та засоби задля усунення правових та практичних прогалини у правосудді щодо дітей. Ці принципи є невід’ємною частиною стратегії Ради Європи з прав дитини та її програми «Будуємо Європу для дітей і разом з дітьми». Низка заходів із заохочення, співпраці та моніторингу заплановані в державах-членах з метою забезпечення ефективного здійснення керівних принципів в інтер-есах усіх дітей.

Para tal, a exposição de motivos fornece exemplos de boas práticas e propõe soluções para abordar e colmatar as lacunas jurídicas e práticas na justiça de menores. As presentes diretrizes são parte integrante da Estratégia do Conselho da Europa para os direitos da criança e do programa «Construir uma Europa para e com as crianças». Está planeada uma série de atividades de promoção, cooperação e acompanhamento nos Estados membros, com vista a assegurar a aplicação efetiva das diretrizes em benefício de todas as crianças.

Retningslinjerne er en integrerende del af Europarådets strategi for børns rettigheder og Europarådets program ”Opbygning af et Europa for og med børn”. Šios gairės taikomos visoms aplinkybėms, kuriomis vaikai bet kokiu pagrindu ir bet kokiu vaidmeniu gali susidurti su baudžiamojo, civilinio ar administracinio teisingumo sistema. Šiose gairėse primenami ir remiami vaiko interesų, rūpinimosi ir pagarbos, dalyvavimo, vienodo požiūrio ir teisinės valstybės principai. Gairėse nagrinėjami tokie klausimai kaip informavimas, atstovavimas ir dalyvavimo teisės, privatumo apsauga, saugumas, tarpdalykinis požiūris ir mokymas, apsaugos priemonės visų procesų etapų metu ir laisvės atėmimas. Keturiasdešimt septynios Europos Tarybos valstybės narės raginamos pritaikyti savo teisines sistemas prie specialių vaikų poreikių ir taip sumažinti atotrūkį tarp tarptautiniu mastu suderintų principų ir tikrovės. Tuo tikslu aiškinamajame memorandume pateikiama gerosios patirties pavyzdžių ir siūloma, kaip būtų galima šalinti teisines ir praktines spragas teisingumo sistemoje, pritaikytoje vaikams. Šios gairės yra neatsiejama Europos Tarybos vaiko teisių strategijos ir jos programos „Kurkime Europą vaikams ir su vaikais“ dalis. Siekiant visų vaikų labui užtikrinti veiksmingą šių gairių įgyvendinimą, valstybėse narėse planuojama imtis įvairios skatinimo, bendradarbiavimo ir stebėsenos veiklos.

Veljajo za vse okoliščine, v katerih bi otroci lahko iz kakršnega koli razloga in v kakršni koli obliki prišli v stik s kazenskim, civilnim ali upravnim sodnim sistemom. Opozarjajo na načela otrokovih koristi, skrbi in spoštovanja, udeležbe, enakega obravnavanja in pravne države ter ta načela spodbujajo. Smernice obravnavajo vprašanja, kot so pravica do obveščenosti, zastopnika in udeležbe, varstvo zasebnosti, varnost, multidisciplinarni pristop in usposabljanje, zaščitni ukrepi v vseh fazah postopka ter odvzem prostosti. 47 držav članic Sveta Evrope se spodbuja, da prilagodijo svoj pravni system posebnim potrebam otrok ter premostijo vrzel med mednarodno sprejetimi načeli in dejanskim stanjem. Zato obrazložitveni memorandum vsebuje primere dobrih praks ter predlaga rešitve za obravnavo in odpravo pravnih in praktičnih vrzeli v pravosodju za otroke. Te smernice so sestavni del strategije Sveta Evrope o otrokovih pravicah in njegovega programa „Gradimo Evropo za otroke in z njimi“. V državah članicah je v načrtu niz predstavitvenih, sodelovalnih in spremljevalnih dejavnosti, da bi se zagotovilo učinkovito izvajanje teh smernic v korist vseh otrok.

Rehber Avrupa Konseyinin 47 üye ülkesini, kendi hukuk sistemlerini çocukların belirli ihtiyaçlarına göre uyarlamaya, uluslararası kabul edilmiş prensiplerle aradaki farkı kapatmaya teşvik etmektedir. Bu amaçla, açıklayıcı bildiri iyi uygulama örnekleri vermekte ve çocuklar için adalet sistemindeki hukuk ve uygulama boşluklarının ele alınmasına ve çareler bulunmasına yönelik çözüm yolları önermektedir. Bu rehber, Avrupa Konseyinin çocuk haklarına ilişkin stratejisinin bir parçasıdır. Rehber’in tüm çocukların yararına etkili bir biçimde uygulanması maksadıyla bir dizi teşvik, işbirliği ve izleme faaliyeti üye ülkelerde planlanmaktadır.

Book excerpt: Pokyny o justici vstřícné k dětem a jejich důvodová zpráva byly přijaty Radou Evropy v roce 2010. Na základě stávajících mezinárodních a evropských standardů, zejména Úmluvy OSN o právech dítěte a Evropské úmluvy o lidských právech, jsou pokyny koncipovány tak, aby zaručovaly účinný přístup dětí k justici a vhodné zacházení v rámci justice. Vztahují se na všechny situace, v nichž se děti mohou, z jakéhokoli důvodu a v jakémkoli postavení, dostat do kontaktu se systémem trestního, občanského nebo správního soudnictví. Připomínají a podporují zásady zájmu dítěte, péče a respektu, účasti, rovného zacházení a právního státu. Pokyny se zabývají otázkami, jako jsou práva na informace, zastoupení a účast, ochrana soukromí, bezpečnost, víceoborový přístup a odborná příprava, ochranná opatření ve všech fázích řízení a zbavení svobody. Čtyřicet sedm členských států Rady Evropy se vybízí, aby své právní systémy přizpůsobily konkrétním potřebám dětí a překlenuly propast mezi mezinárodně dohodnutými zásadami a realitou. Za tímto účelem nabízí důvodová zpráva příklady osvědčených postupů a navrhuje možnosti řešení a nápravy právních a praktických nedostatků v justici pro děti. Tyto pokyny tvoří nedílnou součást strategie Rady Evropy v oblasti práv dětí a jejího programu „Budování Evropy pro děti a s dětmi“. V členských státech se plánuje řada činností v oblasti podpory, spolupráce a sledování s cílem zajistit účinné provádění pokynů ve prospěch všech dětí.
