Book excerpt: This book explores the external dimension of the ambitious EU policy on human trafficking. Through this policy the EU institutions and Member States promote the eradication of human trafficking and support, to that end, cooperation with their partners, being third States or international organisations. Analysing the unilateral and multilateral mechanisms the EU uses to achieve these aims, the book questions whether the EU's external response to human trafficking addresses it in all its dimensions, and whether it does so in a coherent way. As a case study, the book explores the cooperation of the EU with countries of the Western Balkans, which constitutes a specific unilateral mechanism. The analysis of the multilateral mechanisms covers the cooperation of the EU with key international and regional organisations combating human trafficking, including but not limited to the Council of Europe or the United Nations Office on Drugs and Crime. The book also examines the impact of the evolution of migration flows and the increasing reliance of military tools on the EU's response to human trafficking.

Book excerpt: Master's Thesis from the year 2011 in the subject Law - European and International Law, Intellectual Properties, grade: 7,5, Tilburg University, course: International Law - Human Rights, language: English, abstract: Trafficking in Human Beings (THB) for sexual and labour exploitation is a severe violation of Human Rights. Yet, while efforts both on a European as well as international level, aim to combat and eradicate this heinous crime, reality depicts a worldwide rise in THB. Trafficking in Human Beings is a truly lucrative business for the perpetrators of organized crime, whilst predominantly targeting the most vulnerable groups in society. The European and international discourse on Trafficking in Human Beings has recognized that the previous criminal law approach to THB in some countries is ineffective in combating this crime. This is evident in the global rise of THB. The criminal law approach, with a narrow focus on the prosecution of perpetrators, disregarded the plight of the victims of THB and their highly vulnerable position. Thus an increased focus has been given to a comprehensive approach to trafficking in human beings, which must implement a human rights based approach, in order to place the victims at the center of focus, whilst aiming to strengthen their position and protection. The 2010 judgment of Rantsev v Cyprus and Russia at the European Court of Human Rights (ECtHR) reflects the discourse on a more comprehensive approach to Trafficking in Human Beings and was a watershed as regards the positive obligations of state parties, in combating THB. In its landmark judgment in Rantsev, the European Court of Human Rights broadly extended the positive obligations of states, party to the European Convention on Human Rights and Fundamental Freedoms (ECHR) under its Article 4.Article 4 provides safeguards against slavery, servitude and forced or compulsory labour.Article 4 does not mention Trafficking in Human Beings but was established to fall within the

Each year, an increasing number of people, the majority of them women and children, fall victim to trafficking for the purposes of sexual or other exploitation, both within and over borders. This phenomenon has hit unprecedented levels, to the extent that it can be considered as a new form of slavery. One of the primary concerns of the Council of Europe is to safeguard and to protect human rights - trafficking in human beings directly undermines the values on which the Council of Europe is based. While other international instruments already exist in this field, the Council of Europe Convention, the first European treaty in this field, is a comprehensive treaty focussing mainly on the protection of victims of trafficking and the safeguard of their rights. It also aims to prevent trafficking and to prosecute traffickers. In addition, the Convention provides for the setting up of an effective and independent monitoring mechanism capable of controlling the implementation of the obligations contained in the Convention. The Convention entered into force on 1 February 2008 (though it has been signed but not yet ratified by the UK).

Its comprehensive scope of application encompasses all forms of trafficking (whether national or transnational, linked or not to organised crime) and covers all victims of trafficking (women, men and children) as well as all forms of exploitation. With an emphasis on the human rights of victims of trafficking, the Convention contains measures to ensure the proper identification of victims, their assistance and protection as well as their compensation. It also contains measures to ensure the effective investigation and prosecution of traffickers. In addition, it sets out measures to promote international co-operation and partnerships with civil society. Finally, it provides for a mechanism to monitor compliance with the obligations it contains.

Book excerpt: Trafficking in human organs is an emerging criminal activity which presents a clear danger to both individual and public health, while breaching human rights and fundamental freedoms. The Council of Europe Convention against Trafficking in Human Organs seeks to protect individual rights by addressing this illegal act from a criminal law perspective. The Convention aims to tackle this crime both at national and international levels by harmonising national legislation, identifying the various offences that constitute trafficking in human organs and laying down the foundation for more efficient cross-border co-operation. It also covers preventive measures and the legal situation of the victims. Wide accession to the Convention is essential in the fight against a crime that is, more often than not, transnational in scope.

Available in PDF, EPUB and Kindle. Book excerpt: In recent decades the international community has focused its attention on trafficking in persons, one of the most worrying phenomena of the 21st century. In Part I, this book examines trafficking in persons in the light of the recent definition of the phenomenon given by the UN Trafficking Protocol, and various other international legal instruments including treaties and 'soft law'. It analyses trafficking causes and consequences, and the most common forms of exploitation related to it. Part II reviews the most important international conventions against slavery and the slave trade, and the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children. It also analyses the most important policy documents setting the basic standards of protection for trafficked victims - namely the United Nations High Commissioner for Human Rights' Recommended Principles and Guidelines on Human Rights and Human Trafficking - and comments on the extension of the jus cogens principle of international law that prohibits slavery, to argue that trafficking in persons ought rightly to be considered a part of it. Part III deals with the Council of Europe and the European Union, and their fight against trafficking in people, arguing that the focus has been placed mistakenly on the prosecution of traffickers rather than on the protection of trafficked victims. The book concludes with a recommendation to shift towards a more balanced approach to trafficking in persons, and the overriding need to conduct further research on specific issues related to the spread of trafficking and the exploitation of its victims.

Book excerpt: This book offers a comprehensive, article-by-article legal commentary on the United Nations Convention Against Transnational Organized Crime and its Protocols on trafficking in persons, smuggling of migrants, and trafficking in firearms and ammunition. The Convention- often referred to by the acronym UNTOC- was approved by the UN General Assembly on 15 November 2000 and made available for governments to sign at a high-level conference in Palermo, the heartland of the Italian Mafia, on 12-15 December 2000. For this reason, UNTOC is sometimes also referred to as the 'Palermo Convention'. The Convention entered into force on 29 September 2003. The purpose of UNTOC is to promote cooperation to prevent and combat transnational organized crime more effectively. UNTOC seeks to promote consistency among national legal systems and set standards for domestic laws so that States parties can effectively combat transnational organized crime. UNTOC is supplemented by three protocols: the Protocol against the Smuggling of Migrants by Land, Air, and Sea, the Protocol to Prevent, Suppress, and Punish Trafficking in Persons, especially Women and Children, and the Protocol against the Illicit Manufacturing of and Trafficking in Firearms, their Parts and Components, and Ammunition. Article by article, this books presents the text of each provision of the Convention and the Protocols, followed by a systematic analysis of their background and negotiating history, their interpretation by the Conference of the Parties and its working groups, in judicial decisions by domestic and international courts, , in the academic literature, and in official material published by international organisations, chief among them the United Nations Office on Drugs and Crime (UNODC), the guardian of UNTOC and the Protocols. The authors offer critical, scholarly commentary. The book serves as a compendium for those using, researching, or studying provisions under UNTOC and the Protocols and as a handbook for those charged with implementing and enforcing them.

Book excerpt: Trafficking in human beings has become one of the most serious problems of the international community. Combating this phenomenon in an effective manner requires a comprehensive international approach of all countries. Being aware of this, several international organizations have launched a number of documents to fight against this phenomenon. The most representative ones are the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, which supplements the United Nations Convention against Transnational Organized Crime (2000), the Council of Europe's Convention on Action against Trafficking in Human Beings (2005), and the EU Directive 2011/36/EU on combating trafficking in human beings and protecting its victims. This book provides a comparative analysis of these legal documents and suggests a number of proposals in order to improve the international and national policies to combat this kind of criminality. Available in PDF, EPUB and Kindle. Book excerpt: The European Convention on Human Rights: A Commentary is the first complete article-by-article commentary on the ECHR and its Protocols in English. This book provides an entry point for every part of the Convention: the substance of the rights, the workings of the Court, and the enforcement of its judgments. A separate chapter is devoted to each distinct provision or article of the Convention as well as to Protocols 1, 4, 6, 7, 12, 13, and 16, which have not been incorporated in the Convention itself and remain applicable to present law. Each chapter contains: a short introduction placing the provision within the context of international human rights law more generally; a review of the drafting history or preparatory work of the provision; a discussion of the interpretation of the text and the legal issues, with references to the case law of the European Court of Human Rights and the European Commission on Human Rights; and a selective bibliography on the provision. Through a thorough review of the ECHR this commentary is both exhaustive and concise. It is an accessible resource that is ideal for lawyers, students, journalists, and others with an interest in the world's most successful human rights regime.

Book excerpt: "This book seeks to determine to what extent the European Union's efforts to promote its approach to combating trafficking in human beings at the external level contribute to their adoption and implementation outside its borders. It is divided in three parts. The first part aims to identify the legal context in which the European Union conducts its externalisation efforts. In the second part, the work done by other actors who are also involved in promoting anti-trafficking activities in the Western Balkans region is analysed, as it also participates to the development of counter-trafficking measures and promote cooperation. The third and final part aims to assess the impact on national legislation and policies of the joint efforts of the European Union and its partners to promote a comprehensive approach to combating trafficking in human beings"--
