Topics covered include types of contract in civil engineering, general conditions of contract, insurances, and tender procedures. The powers, duties, and functions of the engineer and his representative are also considered. This book is comprised of 14 chapters and begins with an overview of the philosophy underlying the contract system in civil engineering, followed by a discussion on the promotion of civil engineering works. The reader is then introduced to types of civil engineering contracts; contract risk and contract responsibility; the application of contract documents; and general conditions of contract. The remaining chapters focus on contract specifications; bill of quantities and methods of measurement; principles and types of insurance; procedures for competitive bids or tenders; cost estimates, methods of pricing, and rate fixing; and claims on civil engineering contracts. The final chapter is devoted to arbitration and related procedure for the settlement of contract disputes. This monograph will be useful to practicing civil engineers who are involved with contract administration and to younger engineers who are aspiring to obtain professional qualifications.

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Elements of Specification Writing: A Text-Book for Students in Civil Engineering This book is a text-book on the art of specification writing, not a collection of specifications. While intended primarily for the classroom, it should prove of value to the young engineer in practice. The book is the outgrowth of a series of lectures delivered by the author annually for the past six years before the senior class in Civil and Sanitary Engineering in the Sheffield Scientific School of Yale University. The following features are worthy of note here: (1) The fundamentals of a contract - particularly of a construction contract with its attendant plans and specifications - are concisely brought out. (2) A chapter is devoted to the Advertisement and one to the Proposal. (3) The General Clauses (Chapters VI to XI inclusive) are given thorough exposition, from an Engineer's viewpoint. Many interesting cases illustrating their application to actual construction work are cited and discussed. Numerous and varied model clauses are quoted. (4) Chapter XII contains practical suggestions touching the Specific (or technical) Clauses. Outlines of such clauses for nine simple construction projects (Chapter XIII) will assist the student as he essays for himself the composition of specifications. The outlines cover work with which the average student is more or less familiar - a manifest advantage to the beginner. (5) The classified list of references (largely to recent articles in the more readily accessible technical Journals) in the Appendix will furnish student and instructor a fund of commentary and illustration. Book excerpt: For the past 25 years, Joe Goldbloom and I have conducted a running debate over whether specifications writers engage in the unlawful practice of law. Joe's position is that lawyers have no business writing specifications, that being the designer's province. Having been given the honor to write this foreword, I have the opportunity for the last word, at least for now. Joe Goldbloom and I first met in 1964, while serving together on the ASCE Committee on Contract Administration. Joe became my teacher, mentor, and friend. Underlying our good natured debate was the serious issue of the technical qualifications required of a specifications writer. As a matter of fact, specifi cations writing traditionally has fallen in a crack between the two professions. Specifications writing typically is neither taught in engineering school nor in law school. Engineers are taught how to design; lawyers are taught how to draft contracts. Specifications writing requires mastery of the technical elements of design as well as the skills of contract drafting. Specifications writing is neither glamorous nor sexy; it is often viewed as a necessary evil of the designer's job.

This book was released on 2012-12-06 with total page 314 pages. Available in PDF, EPUB and Kindle. Book excerpt: 1. HISTORICAL BACKGROUND In the late 1950s many members of the design professions-Engineers as well as Ar chitects-became concerned about their exposure to claims for professional malprac tice and particularly about the increasing number of claims that had been successfully brought against them arising out of their Construction Phase activities. This led to special studies sponsored by the American Institute of Architects and the Engineers joint Counsel. The outcome was twofold: the development of a policy of professional liability insurance to insure Engineers and Architects against errors and omissions in the performance of their professional services, and the review and development of the customary contractual arrangements defining the design profeSSional's undertakings vis a vis his client (the Owner), the Project to be designed, and the Contractor who was to implement that design. At the outset, the AlA's Owner-Architect Agreement (No. B131), General Conditions (No. A201) and the Owner-Contractor Agreements (Nos. A101 & 111) were the documents most frequently used by design professionals, and these received particular attention. In the early 1960s it became apparent that there was a need for a separate series of documents prepared to address these relationships when the Project to be designed involved primarily engineering considerations. The number of Projects for which the Engineer was employed by the Owner as the prime professional to handle the Project design and construction administration was increasing.
