Book excerpt: In Filling Regulatory Gaps in High Seas Fisheries, author Yoshinobu Takei investigates the regime of high seas fisheries from the perspective of international law and considers whether there are regulatory gaps in high seas fisheries and, if so, how they should be filled. The book focuses on topical issues such as the management of deep-sea fisheries on the high seas and the protection of vulnerable marine ecosystems. In view of the current state of marine fisheries resources, together with ecosystem concerns, swift and effective action is required to improve fisheries management, in particular for high seas fisheries. Takei thoroughly analyzes the current state of affairs and convincingly suggests steps to be taken in the future.

Book excerpt: This collection addresses the central question of how the current international framework for the regulation of fisheries may be strengthened in order to meet the challenges posed by changing fisheries and ocean conditions, in particular climate change. International fisheries law has developed significantly since the 1990s, through the adoption and establishment of international instruments and bodies at the global and regional levels. Global fish stocks nevertheless remain in a troubling state, and fisheries management authorities face a wide array of internal and external challenges, including operational constraints, providing effective management advice in the face of scientific uncertainty and non-compliance by States with their international obligations. This book examines these challenges and identifies options and pathways to strengthen international fisheries law. While it has a primarily legal focus, it also features significant contributions from specialists drawn from other disciplines, notably fisheries science, economics, policy and international relations, in order to provide a fuller context to the legal, policy and management issues raised. Rigorous and comprehensive in scope, this will be essential reading for lawyers and non-lawyers interested in international fisheries regulation in the context of profoundly changing ocean conditions.

Book excerpt: Essay from the year 2014 in the subject Politics - Environmental Policy, grade: A-, University of Auckland, course: International Environmental Law, language: English, abstract: The crucial role of the oceans in the climate and functioning of the planet is an undeniable fact. Oceans cover over 70 percent of the earth’s surface and house a major part of global biodiversity. Ocean ecosystems support all life on earth: they regulate the global temperature, provide rain, food and oxygen, and they manage a certain amount of human pollutants. Nearly 64 percent of the oceans lie far beyond the coast of individual states. The high seas and the deep seabed, which form the parts of the oceans that are beyond the national jurisdiction of coastal countries, are some of the least protected areas on earth. Because of its very low temperature, lack of light and energy-deprived character, the high seas were long considered hostile to life. For centuries those areas beyond national jurisdiction (ABNJ) were being treated as a virtual desert without any sign of life or resources. Until the later decades of the twentieth century, the deep sea with its rare organisms and unique ecosystems was largely unexplored by humans. This resulted in a collective lack of knowledge about the rich biodiversity and abundant resources of the high seas and the deep seabed. In recent decades, human interest and activities outside the limits of coastal state jurisdiction have increased. Reasons of the sudden interest in those unknown parts of the oceans were inter alia the depletion of fishery stocks within national jurisdiction, the expansion of global maritime trade, the search for new resources and scientific interest in the deep sea. New advances in technology and maritime transport made it possible for scientists to explore the mysterious uncharted parts of the oceans. This essay will focus on one particular part of the global biodiversity, namely the high seas fish stocks. There is a worldwide increasing demand for seafood. Consequently, a global industry is developed with more and bigger ships. The increased pressure on high seas fish stocks has caused a crisis in the current high seas fisheries management. Over 32 percent of the fish stocks are overexploited, depleted or still recovering from depletion. Global fishing activities will have to become subject to sustainable management measures if we want to secure the fisheries' benefits for the long term. Sustainable management of wild fish stocks causes beneficial effects for the economic output, livelihoods and food security.

Book excerpt: This step-wise guide aims to assist with the implementation of relevant international instruments pertaining to deep-sea fisheries and biodiversity conservation in areas beyond national jurisdiction, especially the high seas, into national policy and law. This guide focuses on the incorporation and transposition of international rules, standards, and recommended practices and procedures into national policy and law. It addresses the key measures for making international obligations effective at the national level and suggests possible options for integrating those measures into the national legal framework. Legislative examples are also provided to illustrate how certain provisions have been incorporated into primary or secondary legislation. The guide first addresses the establishment of a national policy, followed by a description and analysis of essential legislative provisions regarding deep-sea fisheries and the conservation of marine biological diversity in areas beyond national jurisdiction. This guide is thus relevant to policy-makers, parliamentary draftpersons, and parliamentarians.

Book excerpt: The marine areas beyond national jurisdiction (ABNJ) comprises 40 percent of the earth’s surface, it covers 64 percent of the surface of the ocean and 95 percent of its volume. The Common Oceans ABNJ Program (2014-2019) was implemented by FAO as a concerted effort to bring various stakeholders to work together to manage and conserve the world’s common oceans. The ABNJ Deep-Sea project, one component of the Common Oceans ABNJ Program, was of great assistance to newly-formed regional fisheries management organization and arrangements (RFMO/As), as well as some long-standing regional fisheries. The project showed positive results in safeguarding vulnerable marine ecosystems, strengthening monitoring, control and surveillance to combat illegal, unreported and unregulated fishing, mitigating bycatch mortality trends, and building awareness of cross-sectoral aspects in effective governance of ABNJ. Through its cooperation with RFMOs, the project has, to some extent, contributed to minimize the negative impacts of bycatch. Results achieved should be capitalized on and upscaled in a second phase.

Book excerpt: This book presents a comprehensive analysis of the legal and policy frameworks for marine fisheries management and examines the efficiency of the institutions responsible for the formulation, implementation and enforcement of marine fisheries laws and policies in Bangladesh. Sustainable management of marine fisheries is a complex, multi-dimensional and multi-stakeholder process that entails sustainable use of marine living resources and conservation of marine biodiversity. Offering a critical analysis to these frameworks that play a crucial role in the conservation and management of fish stocks in areas within and beyond national jurisdiction, this book examines inadequacies and implementation gaps in the legislative, policy and institutional frameworks that contribute to the unsustainable exploitation of marine fish stocks in Bangladesh. It recommends law and policy reform for conservation and sustainable management of marine fisheries in Bangladesh and the Bay of Bengal.

This book was released on 2020-10-14 with total page 303 pages. Available in PDF, EPUB and Kindle. Book excerpt: The publication documents the results of the review of the level of implementation of the FAO Ecosystem Approach to Fisheries (EAF) by the fisheries management bodies in each of the different ABNJ regions. The review was designed to help identify future activities by the ABNJ Deep Sea Project to address gaps and capacity development and make recommendations to strengthen EAF among deep-sea fisheries management bodies and/or their members. The information to complete the EAF reviews was largely obtained from web-based materials. To assist with the accuracy of these desktop assessments, following initial drafting of each EAF background report and associated EAF assessment, both documents were sent to the respective RFMO secretariats. Comments and/or suggestions provided by the secretariats were then addressed with revised versions of the background reports and review assessments generated. Based on these revised reports, the comparative analyses were finalized and a full report was drafted. Being a desk-top assessment of the level of implementation of the EAF approach by each of the RFMO management bodies, the study had a number of caveats including only being able to measure systems and processes, not outcomes. A more complete assessment of EAF adoption and especially the outcomes would require direct involvement of the various stakeholders, including all relevant management, compliance and scientific bodies, contracting parties (CP), non-contracting parties (NCP), vessel owners, crews, non-governmental organizations (NGOs), etc.
