Book excerpt: The present volume reproduces with slight changes the course of lectures given at The Hague in 1972 under the title of "The General Principles of Private International Law". The substance of these lec tures has remained unaltered, but a number of insertions serve to cor rected some formal mistakes and misprints, added references to literature, some older, some more recent, without attempting to be exhaustive, and modified and supplemented the former exposition in two respects, where subsequent criticisms called for a review. The first concerns the place of public policy in Public International Law, the second deals with spatially-

Book excerpt: In the aftermath of sixth-century barbarian invasions, the legal profession that had grown and flourished during the Roman Empire vanished. Nonetheless, professional lawyers suddenly reappeared in Western Europe seven hundred years later during the 1230s when church councils and public authorities began to impose a body of ethical obligations on those who practiced law. James Brundage’s The Medieval Origins of the Legal Profession traces the history of legal practice from its genesis in ancient Rome to its rebirth in the early Middle Ages and eventual resurgence in the courts of the medieval church. By the end of the eleventh century, Brundage argues, renewed interest in Roman law combined with the rise of canon law of the Western church to trigger a series of consolidations in the profession. New legal procedures emerged, and formal training for proctors and advocates became necessary in order to practice law in the reorganized church courts. Brundage demonstrates that many features that characterize legal advocacy today were already in place by 1250, as lawyers trained in Roman and canon law became professionals in every sense of the term. A sweeping examination of the centuries-long power struggle between local courts and the Christian church, secular rule and religious edict, The Medieval Origins of the Legal Profession will be a resource for the professional and the student alike.

This book was released on 2014-05-12 with total page 457 pages. Available in PDF, EPUB and Kindle. Book excerpt: Early in the eighth century, the current of the Muslim movement that inundated northern Spain crept over the Pyrenees to spread across a portion of the French Midi. From the north the tide of Carolingian conquest forced the Muslims back and took in these same southern French and northern Spanish provinces. During the same era the Vikings raided intermittently and with varying degrees of intensity along the seacoasts and up the inland waterways, sometimes controlling considerable areas for extended periods. These raids and conquests inevitably affected the way of life of the people of southern France and Catalonia. Contemporary travelers and later scholars have noted that the feudal traditions and obligations that were so strong in the north seemed very weak or nonexistent in the south. They found that the land seemed to be held largely as allods, not as feudal fiefs; they saw that women held positions of surprising power, that throughout the area there was great emphasis on money, and that the traditions of Roman and Visigothic law still survived. Although scholars have noted these differences, no one has made a comprehensive study of southern French and Catalan society as a whole. It is to fill this void that Archibald Lewis provides this volume. In a detailed and scholarly study, based largely upon original records and chronicles, he examines the familial, social, economic, governmental, military, and religious life of the area from 718 to 1050 A.D. Lewis gives as comprehensive a picture as the records will permit of the society that existed in the early eighth century, describes and discusses the major changes which took place during the next three centuries, and analyzes their causes and effects. This study, which includes careful and detailed notes and an extensive bibliography, provides a reliable and long-needed reference tool.

Available in PDF, EPUB and Kindle. Book excerpt: Fully modern corporations appeared in fourteenth-century Toulouse, much earlier than previously believed Germain Sicard proves that Europe's first corporations were fourteenth-century mill companies operating in Toulouse, rather than seventeenth-century English and Dutch trading companies as commonly believed. He shows that the corporate form derives from a unique ownership contract from Medieval Europe called pariage, and a culture of strong property rights and municipal self-governance. Based on archival research, Sicard's 1952 thesis has been translated into English with an introduction that places the work in the context of new institutional economics and legal theory. It is an important contribution to research on the history and legal origins of the corporation.
