Os direitos humanos são tão importantes que, em última análise, determinam como uma sociedade vive e resolve seus conflitos e a relação entre o Estado e os indivíduos ou grupos. Os direitos humanos podem restringir as ações de um país e também podem exigir que um país exerça prestações positivas para proteger a dignidade humana. Em âmbito internacional, esse conjunto de direitos se intitula “direitos humanos”, ao passo em que, no âmbito interno dos países, esses direitos se intitulam “direitos fundamentais”. A sexualidade, por sua vez, integra a natureza humana e está intimamente relacionada a ela. Os seres humanos podem não se realizar plenamente em situações onde a liberdade sexual é reduzida, atos sexuais são proibidos ou os indivíduos são incapazes de demonstrar sua orientação sexual. Portanto, far-se-á necessário pensar e discutir a sexualidade na perspectiva do preconceito, ou seja, da discriminação e da discriminação de gênero. E, ainda, apontar o fato de que deve ser encarada enquanto um direito da pessoa humana, extremamente necessária para garantia de uma vida digna. Trata-se do direito humano de se posicionar e viver sua sexualidade em plenitude, de se relacionar com uma pessoa do mesmo sexo ou sexo oposto, sem sofre discriminação ou violência física, psicológica ou institucional. Trata-se ainda do direito de se abster de uma vida sexual, tamanha a complexidade da temática em discussão. A metodologia empregada pautou-se na utilização do método dedutivo e, como técnica de pesquisa, optou-se pelo emprego da revisão de literatura sob o formato sistemático. Aliás, as mulheres e minorias sexuais historicamente tiveram sua sexualidade limitada e estigmatizada pela sociedade, igreja e Estado. Nas últimas décadas, pode-se perceber um avanço na discussão envolvendo a garantia plena da sexualidade e questões que se relacionam a mesma, como os direitos sexuais e reprodutivos. O direito humano ao exercício pleno da sexualidade ou, simplesmente, o direito sexual, se traduz na realização da sexualidade sem óbices impostos pela sociedade/Estado. Trata-se do direito à liberdade sexual, onde são ainda estabelecidas garantias de dignidade e igualdade. Pode-se citar como exemplos de direitos sexuais a possibilidade de um indivíduo se relacionar com uma pessoa do mesmo sexo sem sofrer discriminações ou violência física, psíquica ou institucional. Trata-se ainda do direito de não se relacionar sexualmente. O direito à sexualidade abrange de forma indireta uma série de garantias como a união entre pessoas do mesmo sexo, os direitos previdenciários advindos dessa modalidade de união, o direito ao exercício de uma sexualidade plena e a possibilidade de um indivíduo viver, publicamente e sem medos, sua orientação sexual e de gênero. O reconhecimento do direito a sexualidade é fundamental para garantia de uma vida digna as mulheres e minorias sexuais, e ainda a realização de uma série de direitos e princípios como os da igualdade e dignidade humana.

Finally, we hope to open a space whereby the voice of ‘hermaphrodites’ and ‘intersexuals’ themselves could be heard in the past as agents in the construction of their own destiny as figures deemed ‘in-between’ by medicine and society.

Book excerpt: La presente obra pretende ilustrar tanto a legos como a profesionales sobre el fenómeno de la criminalidad sexual, destruyendo mitos e introduciendo realidades estadísticas para que el lector conozca la verdad sobre este tipo de delincuentes. En la misma, se han obviado alusiones a las víctimas por cuanto la pretensión es establecer perfiles delincuenciales y datos acerca del fenómeno. Asimismo, se ha diseñado un plan de prevención de la delincuencia sexual en España basado en experiencias aplicadas en otros países y que aquí quedan aún muy lejanas.
