Yet, the most effective child welfare system is not the same as, or a substitute for, an effective juvenile justice system and visa versa. And the children/youth, their families and the public are best served when we enact laws and policies, and then design interventions and programs, that reflect this. ... My goal today is to be a resource to you on the recent history of our juvenile justice system in Kansas, and why our system is designed as it is. ... I would offer to you that the juvenile justice system is more effective than it has been in recent decades, and that any path forward for additional improvements must build upon this success. Without turning back to past laws and practices of criminalizing behavior rooted in the circumstances of the child/youth or increasing the use of secure and nonsecure incarceration.

Book excerpt: "In 2016, Kansas enacted Senate Bill (SB) 367, which sought to focus on intensive system responses for juvenile offenders with the highest risk to reoffend, restricted the use of out-of-home placement in detention and Kansas Department of Corrections (KDOC) custody, planned to shift significant resources toward evidence-based alternatives with supervised in-home services, and aimed to decrease the number of youth in the juvenile justice system by creating community-based alternatives to detention centers. The legislation established enhanced data collection and reporting requirements and directed the state to develop a detention risk assessment instrument for pre-adjudication detention decisions. ... Since its enactment, policymakers have heard testimony that implementation of SB 367 might be diverting youth and their families who previously were served by the juvenile justice system to other state agencies, particularly the Department for Children and Families (DCF), for services. In 2019, House Substitute for Senate Bill (SB) 25 included a budget proviso (Appendix A, page A-1) directing DCF to convene a working group in Fiscal Year (FY) 2020 to study the impact of SB 367 on "crossover youth," defined as youth at risk of being placed in foster care due in whole or in part to conduct that has resulted or could result in juvenile offender allegations, and youth placed in foster care engaging in conduct that has resulted or could result in juvenile offender allegations. ... The working group...has diligently been working to identify and gather the best information possible to address the topics outlined in the proviso. This report is intended to document the process thus far, and those involved look forward to presenting the products of their work to the Kansas Legislature in their final report."

"As the Committee reviews this proposal, please consider the impact upon those children who are proposed to be confined in a juvenile detention center for up to 24 hours. ... Research indicates such confinement is more likely to harm the child, contributing to increased risk for suicide and exposure to violence. ... If the will of the Committee is to advance this bill, there are two other areas that should be considered. First, juvenile detention centers are operated by county government, however child welfare services are provided by the State. So, the confinement of a child in a detention center under the child-in-need of care code should address a payment source for our partners in local government who would be impacted by this change in law. Second, while predicting the progress of Congress is difficult, the topic of secure confinement of children in the United States continues to be a subject of Congressional consideration. There is some potential that there will be an amendment to the Juvenile Justice Delinquency Prevention Act (JJDPA) (H.R. 6964) which would prohibit States from the practice proposed in HB2445. If Kansas were not in compliance with the JJDPA, federal funding to Kansas under the Juvenile Justice Delinquency Prevention Act (JJDPA) could be reduced or lost entirely. ... HB2445, as written, does not align with these federal requirements. ... Kansas made policy choices in 2016 which ended the prior practice of detaining this population in juvenile detention centers. While that does present a need for a specific group of children subject to the CINC code, we hope the Legislature will determine a different path forward for their sake."

The Legislative leadership subsequently decided that rather than establish the group contemplated by the resolution, that it would request that the Judicial Council undertake a study of the Kansas Juvenile Offender's Code and the Kansas Code for Care of Children. The Judicial Council agreed to undertake the study and appointed the Juvenile Offender/Child in Need of Care Advisory Committee to conduct the study.

A March 2015 report found Kansas can do more to align its juvenile justice practices with research-based principles for improving recidivism and other outcomes. In a similar vein, a January 2015 Kansas Department of Corrections (KDOC) review of youth discharged from Youth Residential Center (YRCII) group homes found that a majority were still in an out-of-home placement six months later. To address these and other concerns, Governor Sam Brownback, Chief Justice Lawton Nuss, Senate President Susan Wagle, Senate Minority Leader Anthony Hensley, House Speaker Ray Merrick, and House Minority Leader Tom Burroughs charged the Kansas Juvenile Justice Workgroup with developing policy recommendations that advance three goals: 1-- Promote public safety and hold juvenile offenders accountable; 2-- Control taxpayer costs; and 3-- Improve outcomes for youth, families, and communities in Kansas.
