Book excerpt: This book offers a legal understanding regarding the core elements of SGEI (Services of General Interest), and of how the post-Lisbon constitutional framework on SGEI affects the application of the EU market rules by the EU Court of Justice, including procurement rules, to public services. It is built up of three parts, namely Part I: No Exit from EU Market Law for Public Services, Part II: SGEI as a Constitutional Voice for Public Services in EU Law, and Part III: The cost of loyalty, the relationship between EU procurement and state aid legislation on social services and the Treaty rules on SGEI, ending with a case study of Swedish systems of choice. Analyses are also provided on how the EU legislator engages in the Europeanisation of social services through EU procurement and state aid rules that have an ambiguous relationship to the Treaty framework on SGEI. Some explanation to this ambiguity is proposed by studying how the application of EU state aid rules could hinder the development of Swedish systems of choice liberalizing publicly-funded elderly care and school education. Included are propositions on crucial but yet unsettled legal questions, in particular what the legal meaning and relevance of the notion of economic activity in EU market law are and which core elements characterize SGEI. This book is therefore mainly aimed at legal academics and practitioners but may also be of interest to political scientists. Caroline Wehlander studied at Umeå University and holds the title of Doctor of Laws. She lives and works in Sweden.

Available in PDF, EPUB and Kindle. Book excerpt: Media Activism in the Digital Age captures an exciting moment in the evolution of media activism studies and offers an invaluable guide to this vibrant and evolving field of research. Victor Pickard and Guobin Yang have assembled essays by leading scholars and activists to provide case studies of feminist, technological, and political interventions during different historical periods and at local, national, and global levels. Looking at the underlying theories, histories, politics, ideologies, tactics, strategies, and aesthetics, the book takes an expansive view of media activism. It explores how varieties of activism are mediated through communication technologies, how activists deploy strategies for changing the structures of media systems, and how governments and corporations seek to police media activism. From memes to zines, hacktivism to artivism, this volume considers activist practices involving both older kinds of media and newer digital, social, and network-based forms. Media Activism in the Digital Age provides a useful cross-section of this growing field for both students and researchers.

Available in PDF, EPUB and Kindle. Book excerpt: The rapid development of information technology has exacerbated the need for robust personal data protection, the right to which is safeguarded by both European Union (EU) and Council of Europe (CoE) instruments. Safeguarding this important right entails new and significant challenges as technological advances expand the frontiers of areas such as surveillance, communication interception and data storage. This handbook is designed to familiarise legal practitioners not specialised in data protection with this emerging area of the law. It provides an overview of the EU’s and the CoE’s applicable legal frameworks. It also explains key case law, summarising major rulings of both the Court of Justice of the European Union and the European Court of Human Rights. In addition, it presents hypothetical scenarios that serve as practical illustrations of the diverse issues encountered in this ever-evolving field.

Furthermore, the European Union established clear basic principles for the collection, storage and use of personal data by governments, businesses and other organizations or individuals in Directive 95/46/EC and Directive 2002/58/EC on Privacy and Electronic communications. Nonetheless, the twenty-?rst century citizen – utilizing the full potential of what ICT-technology has to offer – seems to develop a digital persona that becomes increasingly part of his individual social identity. From this perspective, control over personal information is control over an aspect of the identity one projects in the world. The right to privacy is the freedom from unreasonable constraints on one’s own identity. Transactiondata–bothtraf?candlocationdata–deserveourparticularattention. As we make phone calls, send e-mails or SMS messages, data trails are generated within public networks that we use for these communications. While traf?c data are necessary for the provision of communication services, they are also very sensitive data. They can give a complete picture of a person’s contacts, habits, interests, act- ities and whereabouts. Location data, especially if very precise, can be used for the provision of services such as route guidance, location of stolen or missing property, tourist information, etc. In case of emergency, they can be helpful in dispatching assistance and rescue teams to the location of a person in distress. However, p- cessing location data in mobile communication networks also creates the possibility of permanent surveillance.

Available in PDF, EPUB and Kindle. Book excerpt: "What, exactly, is 'National Cyber Security'? The rise of cyberspace as a field of human endeavour is probably nothing less than one of the most significant developments in world history. Cyberspace already directly impacts every facet of human existence including economic, social, cultural and political developments, and the rate of change is not likely to stop anytime soon. However, the socio-political answers to the questions posed by the rise of cyberspace often significantly lag behind the rate of technological change. One of the fields most challenged by this development is that of 'national security'. The National Cyber Security Framework Manual provides detailed background information and in-depth theoretical frameworks to help the reader understand the various facets of National Cyber Security, according to different levels of public policy formulation. The four levels of government--political, strategic, operational and tactical/technical--each have their own perspectives on National Cyber Security, and each is addressed in individual sections within the Manual. Additionally, the Manual gives examples of relevant institutions in National Cyber Security, from top-level policy coordination bodies down to cyber crisis management structures and similar institutions."--Page 4 of cover.

Available in PDF, EPUB and Kindle. Book excerpt: One of the most challenging issues facing our current information society is the accelerating accumulation of data trails in transactional and communication systems, which may be used not only to profile the behaviour of individuals for commercial, marketing and law enforcement purposes, but also to locate and follow things and actions. Data mining, convergence, interoperability, ever- increasing computer capacities and the extreme miniaturisation of the hardware are all elements which contribute to a major contemporary challenge: the profiled world. This interdisciplinary volume offers twenty contributions that delve deeper into some of the complex but urgent questions that this profiled world addresses to data protection and privacy. The chapters of this volume were all presented at the second Conference on Privacy and Data Protection (CPDP2009) held in Brussels in January 2009 (www.cpdpconferences.org). The yearly CPDP conferences aim to become Europe’s most important meeting where academics, practitioners, policy-makers and activists come together to exchange ideas and discuss emerging issues in information technology, privacy and data protection and law. This volume reflects the richness of the conference, containing chapters by leading lawyers, policymakers, computer, technology assessment and social scientists. The chapters cover generic themes such as the evolution of a new generation of data protection laws and the constitutionalisation of data protection and more specific issues like security breaches, unsolicited adjustments, social networks, surveillance and electronic voting. This book not only offers a very close and timely look on the state of data protection and privacy in our profiled world, but it also explores and invents ways to make sure this world remains a world we want to live in.

Available in PDF, EPUB and Kindle. Book excerpt: Procedural law is no longer a purely domestic topic. The recent tendencies characterizing the field, such as Europeanization and harmonization, mark the evolution towards a new, cross-border dimension of this area of law. In addition, the growing importance of transnational legal relations in all spheres of civil and commercial dealings make it unavoidable to face the new challenges of procedural law across national borders. The traditional methods of national dogmatics, which have for a long time guided the reflections of scholars operating in the field of civil procedure, are not necessarily able to capture the increased complexity of the present. In light of this, it is particularly important to reflect on the methods (comparison, inter-disciplinary approaches and quantitative and qualitative empirical analysis, among other) which should be adopted in order to guarantee that research in the field of procedural law maintains its comprehensive ex-planatory power. The present book is the outcome of the second edition of the IAPL-MPI Summer-School, which took place in Luxembourg in July 2016 bringing together outstanding young post-doc researchers dealing with European and comparative procedural law, as well as with other relevant dispute mechanisms for civil controversies.

Book excerpt: Written by leading experts in the field, this collection offers a critical and comparative analysis of the existing case law on international investment law. The book makes a topical contribution to the existing literature, showing most notably that: (1) international investment law has a longer history than that generally considered and that this history is fundamental to understanding its development; (2) international investment law is crafted today by a large number of actors. These include not only investment arbitrators, but also a variety of international and national courts and tribunals; and (3) the literature and case law in languages other than English and from different legal cultures is essential to grasp the essence of the development of the topic. This book brings together more than 40 experts from different countries and legal traditions and combines conceptual analysis and archival investigation of landmark case law to provide the reader with a fresh and innovative understanding of the breadth of international investment law.
