Book excerpt: The system of public international law has reached a major turning point in its history and is confronting serious challenges generated by a variety of developments unfolding in the structure of the international society. This Dictionary acquaints legal and other professionals, students, and interested general readers with the basic tenets of public international law, combining the features of both a brief encyclopedic dictionary and a textbook in clear, understandable language. A list of acronyms and abbreviations; a glossary of Latin phrases; a chronology that offers a historical perspective by listing major developments relating to international law throughout the centuries; a table of cases with references to entries; and a list of the 373 entries precede the main text. The survey of international law is organized into nine chapters. Chapter I contains the usual introductory topics found in international law textbooks: the nature of this law, its sources, the relationship between international and national ("municipal") law, and some other general problems. Chapters II-VIII deal with matters coming within the scope of the "law of peace," organized according to the framework consisting of: states, individuals, spatial context, and interaction. Chapter IX, whose subject unfortunately becomes ever more relevant, describes the rules governing the conduct of warfare, that is, international humanitarian law. Numerous cross-references in bold lead the reader to appropriate entries, and the abundant references to primary sources, mostly treaties and court cases, enable the reader to locate the materials needed for research. The selective bibliography includes books, research aids, textbooks, and casebooks, as well as recent books on special international law topics. This Dictionary is a useful addition to both public and academic libraries, including, in particular, libraries of law schools. The format of the book allows it to be used as a reference guide for legal professionals, scholars inter

Book excerpt: This dictionary of 368 key terms in international law--concepts, major treaties, international conventions, and theories--clarifies a broad range of issues in this field. Organized thematically, its 12 chapters bring together terms on topics such as jurisdiction and jurisdictional immunities, treatment of aliens, the law of the sea, and laws of war and neutrality. The two-part entries first define the term and then explain its significance and implications through historic and current examples. Most of the "see also" references within the definitions refer to other terms within the same chapter. The index not only identifies entry terms but also analyzes the entries' contents, thus allowing thorough retrieval on any topic. ISBN 0-87436-406-X: $37.50 (For use only in the library).

Available in PDF, EPUB and Kindle. Book excerpt: As knowledge of Latin continues to diminish, its frequent use in cases, textbooks, treaties, and scholarly works baffles law students, practitioners, and scholars alike. Many of the Latin terms commonly used by international lawyers are not included in some of the more popular law dictionaries. Terms and phrases included in modern dictionaries usually offer nothing more than a literal translation without sufficient explanation or context provided. The Guide to Latin in International Law provides a comprehensive approach and includes both literal translations and definitions with several useful innovations. Included is not only the modern English pronunciation but also the classical or "restored" pronunciation. Its etymology is more complete than the leading law dictionary on the market, and the definition for each term includes examples used in context whenever helpful. Each entry is also cross-referenced to related terms for ease of use. This updated edition is the quintessential desktop reference for understanding Latin terms and phrases across all areas of international law.

This branch of law aims to regulate the means and methods of warfare as well as to provide protections to those who do not, or who no longer, take part in the hostilities. It is one of the oldest branches of international law and one of enduring relevance today. The Oxford Guide to International Humanitarian Law provides a practical yet sophisticated overview of this important area of law. Written by a stellar line up of contributors, drawn from those who not only have extensive practical experience but who are also regarded as leading scholars of the subject, the text offers a comprehensive and authoritative exposition of the field. The Guide provides professionals and advanced students with information and analysis of sufficient depth to enable them to perform their tasks with understanding and confidence. Each chapter illuminates how the law applies in practice, but does not shy away from the important conceptual issues that underpin how the law has developed. It will serve as a first port of call and a regular reference work for those interested in international humanitarian law.

This book was released on 2019-09 with total page 257 pages. Available in PDF, EPUB and Kindle. Book excerpt: If the term were given its literal meaning, international law would be law between 'nations'. It is often described instead as being primarily between states. But this conceals the diversity of the nations or state-like entities that have personality in international law or that have had it historically. This book reconceptualizes statehood by positioning it within that wider family of state-like entities. In this monograph, Rowan Nicholson contends that states themselves have diverse legal underpinnings. Practice in cases such as Somalia and broader principles indicate that international law provides not one but two alternative methods of qualifying as a state. Subject to exceptions connected with territorial integrity and peremptory norms, an entity can be a state either on the ground that it meets criteria of effectiveness or on the ground that it is recognized by all other states. Nicholson also argues that states, in the strict legal sense in which the word is used today, have never been the only state-like entities with personality in international law. Others from the past and present include imperial China in the period when it was unreceptive to Western norms; precolonial African chiefdoms; 'states-in-context', an example of which may be Palestine, which have the attributes of statehood relative to states that recognize them; and entities such as Hong Kong.
