Despite a deep history of labor activism, Latin American scholarship has had scant presence in these debates. This book introduces to an English-language audience another approach: principled labor law, based on Latin American perspectives, using a jurisprudential method focused on worker protection. The authors apply this methodology to the least likely case of labor-protective jurisprudence in the industrialized world: the United States. In doing so, Gamonal and Rosado focus on the Thirteenth Amendment as a labor-protective constitutional provision, the National Labor Relations Act, and the Fair Labor Standards Act. Without our history of effective collective bargaining there would be no mutual understanding, no industrial peace, no constructive cooperation between social partners. Yet there is a feeling today that this history has drawn to a close; that our post-industrial world demands something different, something our tradition of collective bargaining and collective agreements cannot give us. What information and insight can we gather to verify or challenge this feeling? This was the first major question addressed by the distinguished delegates to the twenty-seventh World Congress of Labour and Social Security Law held at Montevideo, 2'5 September 2003. The aim of the conference was to discover current problems regarding the existing structures and functions of collective bargaining in industrialized countries today'problems readily identifiable in the context of economic globalization, falling union density, the increase in atypical and knowledge-based workers, and the 'tertiarization' or declining economic importance of manufacturing-based industry. This bulletin contains some of the most important papers devoted to this major theme of the conference. It presents twenty national reports, each written by a scholar well-versed in the law and practice of collective bargaining in the country covered. Two introductory reports deal with such general issues as the varying competences of representatives under different legal systems, labor union representation within the public sector, the development of collective bargaining in EC law, the levels and structures of collective bargaining practice, and the widening gap between the relevant legal norms and real situations. The national reports were drafted on the basis of a questionnaire, which appears as an annex. This allows the reader to easily compare the solutions set forth for consideration in the various countries under review. Book excerpt: Youth have always had higher unemployment rates – about twice or more than the average – as they are usually the last to be hired in an expansion and the first to be let go in a recession. In addition, young people engage in extensive job searching in their early years, and this can imply considerable job churning as both youth and employers look for a good match. This highlights the importance of facilitating the school-to-work transition and having early interventions to assist such youth before negative conditions set in. It also highlights the potential importance of determining those young people most “at risk” of long-term unemployment, and of targeting or streaming them into programmes that will yield the largest incremental net benefits given their characteristics. Unemployed youth without previous work experience often are not eligible for unemployment insurance benefits when they first enter the labour market. When they do receive job search assistance, they often face a bewildering array of programmes that are available to assist them, often with little guidance to help them select the programs that best meet their needs. Consequently, ensuring that today’s youth do not become a “lost generation” is an urgent matter. George Bernard Shaw once said that it is too bad that “youth is wasted on the young”, implying that youth do not realize the opportunities they have as youth and only see them as they get older. There is a danger, however, that many of today’s youth may be never have those opportunities and hence not even see them with hindsight. This book and others in the ADAPT Labour Studies Book-Series are intended to deal with these challenges, to make sure that youth is not wasted on the young.

The main focus of Workers Before the Tribunal is to overcome traditional binary oppositions between corporativist and contratualist models of labor relations, the former representing a view in which the working class would have more autonomy in struggling for better labor conditions, the latter meaning the protagonism of the State in promoting labor rights. Teixeira da Silva presents three main arguments. First, he shows that the Brazilian labor justice system created during the Getúlio Vargas dictatorship (1930-1945), although inspired by Mussolini's legal order in Italy, is very different from the Fascist Magistratura del Lavoro. Second, in his comparative analysis with other national cases, such as the United States, France, Germany and Australia, the author argues that there was a large circulation of ideas and practices, resulting in a more complex dynamic of appropriation of international ideas on labor rights and institutions in Brazil. Third, Teixeira da Silva demonstrates that litigation in labor courts was one strategy of the working-class movement in Brazil, together with strikes and other means of confrontation. Therefore, he questions historiographical and political approaches that see labor justice as a weak substitute for class action. The "jurisdictionalization" of labor relations became a constitutive element in the making of the Brazilian working class. The book is anchored in the research of hundreds of labor litigation cases during the dramatic months preceding the 1964 civil-military coup d’état that inaugurated a quarter century of dictatorial rule in Brazil.
