Dagegen ist das positive Recht, das von einer staatlichen Instanz gesetzte Recht . Über die Jahrhunderte galt das Naturrecht als überlegen, da es dem gesetzten Recht als "Richtschnur" und "Schranke" vorausgeht und somit übergeordnet ist. Die 1576 veröffentlichte Souveränitätslehre Jean Bodins, die die Gesetzgebung durch den Souverän zur zentralen Aufgabe des Staates erklärt, verbunden mit der Säkularisierung im 17./18. Jahrhundert, stellt den Wendepunkt der bis dato vorherrschenden Dominanz des Naturrechts und die Durchsetzung des wertfreien, positiven Rechts dar. "Aus dem vorher einheitlichen wird ein dualistischer Rechtsbegriff." Als Gegenbewegung zum Naturrecht dominierte daher im 19. Jahrhundert der Rechtspositivismus, nach dessen Auffassung allein das positiv gesetzte Recht, unabhängig seines Inhalts, gilt. ... Im Mittelpunkt dieser Seminararbeit soll, auf Grundlage der Anwendung der sog. Radbruch'schen Formel in der Mauerschützen-Judikatur Anfang der 90er Jahre, der Frage nachgegangen werden, inwieweit naturrechtliche Theorien im Rechtsstaat des 21. Jahrhunderts Berücksichtigung finden bzw. finden sollen. Um diese Frage zu beantworten, bedarf es vorher einer historischen Analyse der Entwicklung des Verhältnisses von Naturrecht und Rechtspositivismus. [...] Zurückverfolgen lassen sich die Entwicklungslinien des Naturrechts bis in die Antike, von der aus es sich dann in drei Phasen entwickelt hat. Zu unterscheiden ist hier das Naturrecht der Spätantike, in der dem Recht ein transzendentaler Ursprung nachgesagt wird, das christliche Naturrecht der mittelalterlichen Theologie, das auf einen außerirdischen Schöpfergott Bezug nimmt und das Naturrecht des Zeitalters von Naturwissenschaften, Rationalismus und Aufklärung, also das Vernunftrecht.
