Book excerpt: The Committee's report examines the main policy proposals by the Government to replace the three separate Service Discipline Acts for the armed forces with a single Tri-Service Act (TSA) A Bill is planned for introduction into Parliament during the 2005-06 session. The Committee's report examines the case for a single Act; the proposals for a single system of Service law, including disciplinary measures and court martial, human rights issues, redress of complaints and Boards of Inquiry. Findings include broad support for proposed changes to the current court martial system, including the creation of a standing court and a single prosecuting authority, although more work is needed on the detailed provisions. The Committee disagrees with the MoD position regarding the attendance of next of kin at Boards of Inquiry, arguing that there should be a presumption in favour of their attendance. To ensure sufficient provision for parliamentary scrutiny of the Bill, the Committee also recommends the need for a select committee and a standing committee stage examination of the Bill.

However, the requirement for full and detailed investigations of every death resulting from an armed conflict is putting a significant burden on the MoD and the Armed Forces. Secondly, there has been a failure of the accepted principle of combat immunity, most recently evidenced in the Supreme Court majority judgment in June 2013 allowing families and military personnel to bring negligence cases against the MoD for injury or death. This seems to us to risk the judicialisation of war and to be incompatible with the accepted contract entered into by Service personnel and the nature of soldiering.
