Book excerpt: This Dictionary: explains technical Roman legal terms, translates & elucidate those Latin words which have a specific connotation when used in a juristic context or in connection with a legal institution or question, & provides a brief picture of Roman legal institutions & sources as a sort of an introduction to them. The objectives of the work, not the juristic character of available Latin writings, therefore, determined the inclusion or exclusion of any single word or phrase. This dict. is not intended to be a complete Latin-English dict. for all words which occur in the writings of the Roman jurists or in the various codifications of Roman law. The reader must consult a general Latin-English lexicon for ordinary words that have no specific meaning in law or juristic language. Reprinted 1980.

Available in PDF, EPUB and Kindle. Book excerpt: This unique publication offers a complete history of Roman law, from its early beginnings through to its resurgence in Europe where it was widely applied until the eighteenth century. Besides a detailed overview of the sources of Roman law, the book also includes sections on private and criminal law and procedure, with special attention given to those aspects of Roman law that have particular importance to today's lawyer. The last three chapters of the book offer an overview of the history of Roman law from the early Middle Ages to modern times and illustrate the way in which Roman law furnished the basis of contemporary civil law systems. In this part, special attention is given to the factors that warranted the revival and subsequent reception of Roman law as the ‘common law’ of Continental Europe. Combining the perspectives of legal history with those of social and political history, the book can be profitably read by students and scholars, as well as by general readers with an interest in ancient and early European legal history. The civil law tradition is the oldest legal tradition in the world today, embracing many legal systems currently in force in Continental Europe, Latin America and other parts of the world. Despite the considerable differences in the substantive laws of civil law countries, a fundamental unity exists between them. The most obvious element of unity is the fact that the civil law systems are all derived from the same sources and their legal institutions are classified in accordance with a commonly accepted scheme existing prior to their own development, which they adopted and adapted at some stage in their history. Roman law is both in point of time and range of influence the first catalyst in the evolution of the civil law tradition.

For many centuries they had been the familiar textbook of all students of Roman law.

Available in PDF, EPUB and Kindle. Book excerpt: In our globalized era it has become impossible to deal effectively with constitutional law and related subjects such as fundamental rights, administrative law and political science without knowledge of foreign systems. A wealth of literature is available on practically all constitutional systems and the intricacies of their application. This, however, presents the constitutionalist with a formidable problem: Which foreign systems should I explore in order to make relevant comparisons, and how should I go about it? This book addresses the core problems of comparability and appropriate comparative methodology in the realm of contemporary constitutionalism. The outcome is, however, not mere theorizing. Most of the text is devoted to an incisive application of the chosen comparative method to four geographically, historically, and culturally divergent, but thoroughly comparable, constitutional systems. In the course of the comparative exercise, contemporary constitutional dogma and constitutional mechanics are analyzed and explained, in many instances in their historical contexts, making the book itself a useful source of comparative and historical information.

Available in PDF, EPUB and Kindle. Book excerpt: A workshop was held in February 2012 in Madrid to stimulate a debate on textual criticism centred on the analysis of Byzantine texts and their modes of publication, rewriting and diffusion. The main aim was to provide future editors or scholars of the history of texts with a rich typology of concepts to guide their task, such as interpolation, paraphrasis, metaphrasis, quotation, collection, amplification or falsification, among others, but always taking into account that the principles upon which the discipline of textual criticism was founded needed to be reconsidered when dealing with the transmission of Byzantine texts. The present book brings together the different case studies produced by the participants of the workshop into a coherent whole and distributes them into five different sections according to their methodological approaches: 1. Language and style; 2. Virtual libraries and crossed readings; 3. Philosophical treatises and collections; 3.The sources of history; 5. Law texts and their reception. The results of the different approaches put forward by the contributors offer a broad palette of methodological strategies that are, to a great extent, complementary, and will, so we hope, illuminate the task of the future editors with new reflections.

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Latin-English Dictionary: For the Use of Junior Students Abridge From the Larger Work of White and Riddle As the suffix always forms the last portion of a word, and follows the hyphen in simple words and the last hyphen in compound words, it has not been thought necessary to repeat in any instance what it is, inasmuch as it is self-evident. Where no suffix is used, the fact will appear in the state ment given of the origin of the word. Such is the outline of the plan upon which the leading words in this work are printed; a plan which, it is confidently believed, will go far to render an acquaintance with the mode of formation, and the etymological meaning, of words in general, comparatively easy even to persons beginning to study the. Latin language. Should further insight into these matters be desired, it may be obtained from the work already mentioned Latin Suffixes. Much, also, will soon be procurable from the forthcoming Public Schools Latin Grammar, especially with regard to letter-changes, and the construction of the cases of nouns and of the perfect tenses and the supines of verbs. From an examination of that work, which has been courteously conceded to the author of this Dictionary, in common with certain others engaged in educational pursuits, he is enabled to speak of the effort to harmonize grammatical teaching in this country as being, in his judgment, most skilfully carried out, and likely to be hailed as a great boon by all who can appreciate the advantages that cannot but accrue from the general adoption of one standard Grammar for the primary instruction of youth. The Burgundian Code offers historians and anthropologists alike illuminating insights into a crucial period of contact between a developed and a tribal society.
