Available in PDF, EPUB and Kindle. Book excerpt: Allen Steinberg brings to life the court-centered criminal justice system of nineteenth-century Philadelphia, chronicles its eclipse, and contrasts it to the system -- dominated by the police and public prosecutor -- that replaced it. He offers a major reinterpretation of criminal justice in nineteenth-century America by examining this transformation from private to state prosecution and analyzing the discontinuity between the two systems. Steinberg first establishes why the courts were the sources of law enforcement, authority, and criminal justice before the advent of the police. He shows how the city's system of private prosecution worked, adapted to massive social change, and came to dominate the culture of criminal justice even during the first decades following the introduction of the police. He then considers the dilemmas that prompted reform, beginning with the establishment of a professional police force and culminating in the restructuring of primary justice. Making extensive use of court dockets, state and municipal government publications, public speeches, personal memoirs, newspapers, and other contemporary records, Steinberg explains the intimate connections between private prosecution, the everyday lives of ordinary people, and the conduct of urban politics. He ties the history of Philadelphia's criminal courts closely to related developments in the city's social and political evolution, making a contribution not only to the study of criminal justice but also to the larger literature on urban, social, and legal history. Available in PDF, EPUB and Kindle. Book excerpt: "This collection of writings is crucially important, in part, because it reminds us the theoretical paradigms of these and other African American scholars are excluded when crime, its causes, and its control are discussed by criminologists, criminal justice practitioners, and policy makers. To understand crime fully, the perspectives advanced by these scholars must become an integral part of discussions about who is a criminal and which public policies will best control crime." --From the forward by Anne Thomas Sulton, Ph.D, J.D. From W.E.B. Dubois through Lee Brown, this anthology provides a collection of the key articles in criminology and criminal justice written by black scholars. Available in a single volume for the first time, the articles collected in this book reflect the voices of African-American scholars and display the diversity of perspectives sought after in today's academic community. Crime in the African-American community is examined from social, economic and political perspectives, and the historical context of each article is provided by the editors. Spanning the 20th century, these works present a historical chronology of African-American views on crime and its control with theoretical perspectives that have often been tangential to mainstream scholarship. Available in PDF, EPUB and Kindle. Book excerpt: This volume brings together a collection of essays, many of them scholarly classics, which form part of the debates on three questions central to criminal law theory. The first of these questions is: what conduct should be necessary for criminal liability, and what sufficient? The answer to this question has wider implications for the debate about morality enforcement given the concern that the "harm principle" may have collapsed under its own weight. Secondly, essays address the question of what culpability should be necessary for criminal liability, and what sufficient? Here, the battles continue over whether the formulation of doctrines - such as the insanity defense, criminal negligence, strict liability, and others - should ignore or minimize the extent of an offender's blameworthiness in the name of effective crime-control. Or, are methods of accommodating the tension now in sight? Finally, essays consider the question of how criminal law rules should be best organized into a coherent and clarifying doctrinal structure. The structure grown by the common law process competes not only with that of modern comprehensive codifications, such as the America Law Institute's Model Penal Code, but also with alternative structures imagined but not yet tried.

The authors' combined experience of more than 50 years in teaching introduction to criminal justice as well as working in the field -- Bohm as a correctional officer and Haley as a police officer -- come through in their accessible yet comprehensive presentation. They make it easy for readers to understand that much of what the public "knows" about criminal justice in the United States is myth, and help students learn the truth about the U.S. criminal justice system.
