During the criminal trial, evidentiary material is tightly regulated; it is formally regarded as part of the court record, and subject to the rules of evidence and criminal procedure. However, these rules and procedures cannot govern or control this material after proceedings have ended. In its ‘afterlife’, criminal evidence continues to proliferate in cultural contexts. It might be photographic or video evidence, private diaries and correspondence, weapons, physical objects or forensic data, and it arouses the interest of journalists, scholars, curators, writers or artists. Building on a growing cultural interest in criminal archival materials, this book shows how in its afterlife, criminal evidence gives rise to new uses and interpretations, new concepts and questions, many of which are creative and transformative of crime and evidence, and some of which are transgressive, dangerous or insensitive. It takes the judicial principle of open justice – the assumption that justice must be seen to be done – and investigates instances in which we might see too much, too little or from a distorted angle. It centres upon a series of case studies, including those of Lindy Chamberlain and, more recently, Oscar Pistorius, in which criminal evidence has re-appeared outside of the criminal process. Presenting these previously inaccessible documents along with expert context and analysis, Taner Akçam's most authoritative work to date goes deep inside the bureaucratic machinery of Ottoman Turkey to show how a dying empire embraced genocide and ethnic cleansing. Although the deportation and killing of Armenians was internationally condemned in 1915 as a "crime against humanity and civilization," the Ottoman government initiated a policy of denial that is still maintained by the Turkish Republic. The case for Turkey's "official history" rests on documents from the Ottoman imperial archives, to which access has been heavily restricted until recently. It is this very source that Akçam now uses to overturn the official narrative. The documents presented here attest to a late-Ottoman policy of Turkification, the goal of which was no less than the radical demographic transformation of Anatolia. To that end, about one-third of Anatolia's 15 million people were displaced, deported, expelled, or massacred, destroying the ethno-religious diversity of an ancient cultural crossroads of East and West, and paving the way for the Turkish Republic. By uncovering the central roles played by demographic engineering and assimilation in the Armenian Genocide, this book will fundamentally change how this crime is understood and show that physical destruction is not the only aspect of the genocidal process.

In developing its findings and recommendations, the Commission held three national conferences, conducted five national surveys, held hundreds of meetings, and interviewed tens of thousands of individuals. Separate chapters of this report discuss crime in America, juvenile delinquency, the police, the courts, corrections, organized crime, narcotics and drug abuse, drunkenness offenses, gun control, science and technology, and research as an instrument for reform. Significant data were generated by the Commission's National Survey of Criminal Victims, the first of its kind conducted on such a scope. The survey found that not only do Americans experience far more crime than they report to the police, but they talk about crime and the reports of crime engender such fear among citizens that the basic quality of life of many Americans has eroded. The core conclusion of the Commission, however, is that a significant reduction in crime can be achieved if the Commission's recommendations (some 200) are implemented. The recommendations call for a cooperative attack on crime by the Federal Government, the States, the counties, the cities, civic organizations, religious institutions, business groups, and individual citizens. Book excerpt: After World War II, tracing and documenting Nazi victims emerged against the background of millions of missing persons and early compensation proceedings. This was a process in which the Allies, international aid organizations, and survivors themselves took part. New archives, documentation centers and tracing bureaus were founded amid the increasing Cold War divide. They gathered documents on Nazi persecution and structured them in specialized collections to provide information on individual fates and their grave repercussions: the loss of relatives, the search for a new home, physical or mental injuries, existential problems, social support and recognition, but also continued exclusion or discrimination. By doing so, institutions involved in this work were inevitably confronted with contentious issues—such as varying political mandates, neutrality vs. solidarity with those formerly persecuted, data protection vs. public interest, and many more. Over time, tracing bureaus and archives changed methods and policies and even expanded their activities, using historical documents for both research and public remembrance. This is the first publication to explore this multifaceted history of tracing and documenting past and present.
