These category-formations everywhere pursue a cogent analytical program, addressing diverse subjects, treated systematically, a single set of questions of definition and analysis. Is Scripture the origin of the Halakhic system, which defines the norms of Judaism? At stake is not the starting point of discrete bits of legal data. At issue is the origin of the comprehensive structure comprised by the Halakhic category-formations, by these topics and no others. Scripture forms the natural starting point for any inquiry into the origins of Judaism. So it is quite natural to treat Scripture as the base-line and the Halakhic category-formations as the variable when seeking the origin of the system. But what happens when, as in this project, we treat the system as the base-line and Scripture as the variable? Then we see that the Halakhic system viewed as a coherent statement does not originate in Scripture. Important parts of that statement do, important parts do not. But the system viewed whole does not.

Until the modern period, Jews viewed the Rabbinic traditions as the authoritative contents of their covenant with God, and scholars debated the meanings of these ancient Sages words. Even after the eighteenth century, when varied denominations emerged within Judaism, each with its own approach to the tradition, the literary legacy of the talmudic Sages continued to be consulted. In this book, Michael S. Berger analyzes the notion of Rabbinic authority from a philosophical standpoint. He sets out a typology of theories that can be used to understand the authority of these Sages, showing the coherence of each, its strengths and weaknesses, and what aspects of the Rabbinic enterprise it covers. His careful and thorough analysis reveals that owing to the multifaceted character of the Rabbinic enterprise, no single theory is adequate to fully ground Rabbinic authority as traditionally understood. The final section of the book argues that the notion of Rabbinic authority may indeed have been transformed over time, even as it retained the original name. Drawing on the debates about legal hermeneutics between Ronald Dworkin and Stanley Fish, Berger introduces the idea that Rabbinic authority is not a strict consequence of a preexisting theory, but rather is embedded in a form of life that includes text, interpretation, and practices. Rabbinic authority is shown to be a nuanced concept unique to Judaism, in that it is taken to justify those sorts of activities which in turn actually deepen the authority itself. Students of Judaism and philosophers of religion in general will be intrigued by this philosophical examination of a central issue of Judaism, conducted with unprecedented rigor and refreshing creative insight.

Any compelling, contemporary Judaism must cohere as much as possible with traditional Judaism and everything else we believe to be true about our world. The challenge is that over the past two centuries, our understandings of both the Torah and nature have radically changed. Nevertheless, much Jewish wisdom can be translated into a contemporary idiom that both coheres with all that we believe and enriches our lives as individuals and within our communities. Coherent Judaism explains why pre-modern Judaism opted to privilege consensus around Jewish behavior (halakhah) over belief. The stresses of modernity have conspired to reveal the incoherence of that traditional approach. In our post-Darwinian and post-Holocaust world, theology must be able to withstand the challenges of science and history. Traditional Jewish theologies have the resources to meet those challenges. Critical study of the Babylonian Talmud is founded on the distinction between two literary strata: traditions attributed to named sages (the Amoraim, c. 200-450 CE) and setam hatalmud, the unattributed or anonymous material. The conclusion of modern scholars is that the anonymous stratum postdates the Amoraic stratum and should be attributed to the Talmudic redactors, also known as Stammaim (c. 450-700 CE.) The contribution of the Stammaim to the aggadic (non-legal) portions of the Talmud - to midrash, narratives, ethics and theology - has received minimal scholarly attention. The articles in this book demonstrate that the Stammaim made a profound contribution to the aggadic portions of the Babylonian Talmud and illustrate the processes by which they created and composed many aggadic traditions.
