Book excerpt: Apenas se lee el título de este texto es inevitable pensar que se está, nuevamente, ante un escrito altamente dogmático que no tendrá ningún efecto en la realidad jurídica. Otro texto más que, a manera de manual, reseña las diferentes posturas acerca de un tema doctrinal específico sin solucionar un problema en particular. Algo que, quizás, no le generará un aporte real al Derecho ni a su ejercicio. Ahora bien, esa primera opinión que se hace el lector acerca de este texto, la cual es perfectamente lógica y consecuente, es justo lo que queremos abatir. Así entonces, aunque, por supuesto, se hará un amplio recorrido teórico por diferentes escuelas y diferentes autores, dado que la investigación, por su naturaleza, lo exige, se aterrizará tal elaboración dogmática al ejercicio del Derecho y, más específicamente, a la práctica jurídica en Colombia. Siguiendo lo anterior, lo que da origen a esta investigación es, precisamente, la búsqueda de una respuesta a un problema teórico para ofrecer una guía a la interpretación y a la aplicación de preceptos legales en la realidad social. Sentado esto, el problema escogido nace de un debate que se ha planteado en la doctrina y la jurisprudencia durante años y que, a ciencia cierta, no parece tener una única respuesta, lo que genera diversas aproximaciones a la hora de juzgar los casos donde se presenta.
