Book excerpt: The Children Act 1989 emphasizes the importance of effectively meeting a child's needs through a partnership between the parents, the child and the local authority responsible for his or her welfare. This guide provides a framework for local authorities to help them achieve this aim. It highlights the importance of family links and the participation of parents in the decision-making process where this is possible, with a veiw to achieving a safe and stable environment for the child to return to. It gives information on fostering, the promotion of contact between the child and his family and the placement of children in care with parents where this is considered in the child's best interests. It will be useful to all social services personnel responsible for the welfare of children.

This guidance outlines the responsibilities of social services departments (SSDs) under the Act, stating that they have a clear duty to provide services to children with disabilities. Treating disabled children as children first is of paramount importance. However, there is a need for all staff who may be involved in providing a service to a child with a disability to be aware of legislation, and SSDs should ensure that advice, expertise and resources are available for their staff when needed.

Book excerpt: In recent decades, advances in biomedical research have helped save or lengthen the lives of children around the world. With improved therapies, child and adolescent mortality rates have decreased significantly in the last half century. Despite these advances, pediatricians and others argue that children have not shared equally with adults in biomedical advances. Even though we want children to benefit from the dramatic and accelerating rate of progress in medical care that has been fueled by scientific research, we do not want to place children at risk of being harmed by participating in clinical studies. Ethical Conduct of Clinical Research Involving Children considers the necessities and challenges of this type of research and reviews the ethical and legal standards for conducting it. It also considers problems with the interpretation and application of these standards and conduct, concluding that while children should not be excluded from potentially beneficial clinical studies, some research that is ethically permissible for adults is not acceptable for children, who usually do not have the legal capacity or maturity to make informed decisions about research participation. The book looks at the need for appropriate pediatric expertise at all stages of the design, review, and conduct of a research project to effectively implement policies to protect children. It argues persuasively that a robust system for protecting human research participants in general is a necessary foundation for protecting child research participants in particular.

Book excerpt: In Massachusetts, a 12-year-old girl delivering newspapers is killed when a car strikes her bicycle. In Los Angeles, a 14-year-old boy repeatedly falls asleep in class, exhausted from his evening job. Although children and adolescents may benefit from working, there may also be negative social effects and sometimes danger in their jobs. Protecting Youth at Work looks at what is known about work done by children and adolescents and the effects of that work on their physical and emotional health and social functioning. The committee recommends specific initiatives for legislators, regulators, researchers, and employers. This book provides historical perspective on working children and adolescents in America and explores the framework of child labor laws that govern that work. The committee presents a wide range of data and analysis on the scope of youth employment, factors that put children and adolescents at risk in the workplace, and the positive and negative effects of employment, including data on educational attainment and lifestyle choices. Protecting Youth at Work also includes discussions of special issues for minority and disadvantaged youth, young workers in agriculture, and children who work in family-owned businesses.

This book provides a practical guide to the Children Act 1989, its subordinate legislation, case law and social work practice, including equal opportunities. The European Convention on Human Rights and the UN Convention on the Rights of the Child are discussed, and this third edition has been fully updated to cover the consequences of the Human Rights Act 1998 on child law in the UK. The Law Society's new Children Panel will cover representation of children, adults and local authorities and has extended the qualifying course to include a wider range of relevant sociological, psychological and practice issues. This book is written with the Children Panel provisions in mind, and will prove useful as a basic reference for new applicants and members.
