Available in PDF, EPUB and Kindle. Book excerpt: Jeremy Bentham's law of marriage is firmly based on the principle of utility, which claims that all human actions are governed by a wish to gain pleasure and avoid pain, and on the proposition that men and women are equal. He wrote in a late eighteenth century context of Enlightenment debate about the status of women, marriage and the family, as did his contemporaries Wollstonecraft and More. Bentham responded particularly to the thought of Milton, Locke, Hume, Paley and to the French thinkers Montesquieu, Diderot and Rousseau. These were the turbulent years leading to the French Revolution and it is in this milieu that Mary Sokol seeks to rediscover the 'historical' Bentham. Instead of regarding his thought as 'timeless', she considers Bentham's attitude to the reform of marriage law and plans for the social reform of marriage, placing both his life and work in the philosophical and historical context of his time.

Available in PDF, EPUB and Kindle. Book excerpt: A renowned Harvard professor's brilliant, sweeping, inspiring account of the role of justice in our society--and of the moral dilemmas we face as citizens What are our obligations to others as people in a free society? Should government tax the rich to help the poor? Is the free market fair? Is it sometimes wrong to tell the truth? Is killing sometimes morally required? Is it possible, or desirable, to legislate morality? Do individual rights and the common good conflict? Michael J. Sandel's "Justice" course is one of the most popular and influential at Harvard. Up to a thousand students pack the campus theater to hear Sandel relate the big questions of political philosophy to the most vexing issues of the day, and this fall, public television will air a series based on the course. Justice offers readers the same exhilarating journey that captivates Harvard students. This book is a searching, lyrical exploration of the meaning of justice, one that invites readers of all political persuasions to consider familiar controversies in fresh and illuminating ways. Affirmative action, same-sex marriage, physician-assisted suicide, abortion, national service, patriotism and dissent, the moral limits of markets—Sandel dramatizes the challenge of thinking through these con?icts, and shows how a surer grasp of philosophy can help us make sense of politics, morality, and our own convictions as well. Justice is lively, thought-provoking, and wise—an essential new addition to the small shelf of books that speak convincingly to the hard questions of our civic life.

Available in PDF, EPUB and Kindle. Book excerpt: Marriage globally is undergoing profound change, provoking widespread public comment and concern. Through the close ethnographic examination of case studies drawn from Africa, Asia, Europe and North America, Marriage in Past, Present and Future Tense places new and changing forms of marriage in comparative perspective as a transforming and also transformative social institution. In conditions of widespread socio-political inequality and instability, how are the personal, the familial and the political co-produced? How do marriages encapsulate the ways in which memories of past lives, present experience and imaginaries of the future are articulated? Exploring the ways that marriage draws together and distinguishes history and biography, ritual and law, economy and politics in intimate family life, this volume examines how familial and personal relations, and the ethical judgements they enfold, inform and configure social transformation. Contexts that have been partly shaped through civil wars, cold war and colonialism – as well as other forms of violent socio-political rupture – offer especially apt opportunities for tracing the interplay between marriage and politics. But rather than taking intimate family life and gendered practice as simply responsive to wider socio-political forces, this work explores how marriage may also create social change. Contributors consider the ways in which marital practice traverses the domains of politics, economics and religion, while marking a key site where the work of linking and distinguishing those domains is undertaken.

Book excerpt: Drawing upon original manuscripts and The Collected Works of Jeremy Bentham, this collection represents the latest scholarship on Bentham's late and mature thought on constitutional law. The contributions cover a diverse range of major topics, from official aptitude or competency to the interests of women, and explore Bentham's writings on courts, codification, and cosmopolitanism. Together, its chapters challenge the received notion, based on early jurisprudential writings, that Bentham's constitutional thought is authoritarian, and show that Bentham, as a constitutional theorist, offers a distinctive liberal perspective. Freeing Bentham's theories from their long sentences and unfamiliar terminology, these essays make accessible Bentham's subtle and important ideas on liberal democracy. By shining a light on Bentham's mature thought, this volume offers a refreshingly comprehensive, detailed, and authentic account of Bentham's theory of democracy.
