Book excerpt: Restorative justice is one of the most talked about developments in the field of crime and justice. Its advocates and practitioners argue that state punishment, society's customary response to crime, neither meets the needs of crime victims nor prevents reoffending. In its place, they suggest, should be restorative justice, in which families and communities of offenders encourage them to take responsibility for the consequences of their actions, express repentance and repair the harm they have done. First published in 2002, Restorative Justice: Ideas, Values, Debates is renowned worldwide as an accessible, balanced and invaluable analysis of the argument that restorative justice can provide an attractive alternative to traditional responses to crime. The second edition includes a new chapter identifying and analyzing fundamental shifts and developments in restorative justice thinking over the last decade. It suggests that the campaign for restorative justice has not only grown rapidly in the last decade, but has also changed in its focus and character. What started as a campaign to revolutionize criminal justice has evolved into a social movement that aspires to implant restorative values into the fabric of everyday life. This new edition explores the implications of this development for restorative justice’s claim to provide a feasible and desirable alternative to mainstream thinking on matters of crime and justice. This book provides an essential introduction to the most fundamental and distinctive ideas of restorative justice and will appeal to students of criminology, law or related disciplines or researchers and professionals with an interest in crime and justice issues. In addition it extends the debate about the meaning of restorative justice – pros, cons and wider significance – hence it will also be of interest to those already familiar with the topic.

Available in PDF, EPUB and Kindle. Book excerpt: Internationally, there is now an acceptance of the need to develop new strategies in criminal justice which reflect restorative justice principles. At the same time, theory, research and practice in restorative justice is making rapid advances. This book provides an up to date and critical account of recent developments. It describes the practice of restorative justice with respect to young offenders in a number of jurisdictions - Australia, Canada, England, New Zealand, South Africa, the United States and various continental European countries. Research findings on the three most common formats – conferencing, victims offender mediation and circles – are presented. Critical issues for the future development of restorative justice are identified. Two main themes run through the collection - the potential of restorative processes to transform criminal justice processes and the potential for aboriginal or indigenous communities to impact on conventional processes. Contributors include active researchers and leading theorists from around the world.

Book excerpt: America has made great strides in developing an effective youth policy-thanks, in large measure, to juvenile justice and other youth service professionals who are using what works, developing new approaches, and applying research and evaluation information to control juvenile crime and improve our juvenile justice system. OJJDP's Comprehensive Strategy for Serious, Violent, and Chronic Juvenile Offenders provides an overarching approach to addressing juvenile crime and victimization. The Strategy emphasizes prevention and early intervention and the development of a system of graduated sanctions that holds youth accountable and protects communities. The Balanced and Restorative Justice (BARJ) Model is an effective tool for achieving youth accountability and enhancing community safety. BARJ can be used to combat delinquency in your State, county, or city.

Available in PDF, EPUB and Kindle. Book excerpt: Adolescence is a distinct, yet transient, period of development between childhood and adulthood characterized by increased experimentation and risk-taking, a tendency to discount long-term consequences, and heightened sensitivity to peers and other social influences. A key function of adolescence is developing an integrated sense of self, including individualization, separation from parents, and personal identity. Experimentation and novelty-seeking behavior, such as alcohol and drug use, unsafe sex, and reckless driving, are thought to serve a number of adaptive functions despite their risks. Research indicates that for most youth, the period of risky experimentation does not extend beyond adolescence, ceasing as identity becomes settled with maturity. Much adolescent involvement in criminal activity is part of the normal developmental process of identity formation and most adolescents will mature out of these tendencies. Evidence of significant changes in brain structure and function during adolescence strongly suggests that these cognitive tendencies characteristic of adolescents are associated with biological immaturity of the brain and with an imbalance among developing brain systems. This imbalance model implies dual systems: one involved in cognitive and behavioral control and one involved in socio-emotional processes. Accordingly adolescents lack mature capacity for self-regulations because the brain system that influences pleasure-seeking and emotional reactivity develops more rapidly than the brain system that supports self-control. This knowledge of adolescent development has underscored important differences between adults and adolescents with direct bearing on the design and operation of the justice system, raising doubts about the core assumptions driving the criminalization of juvenile justice policy in the late decades of the 20th century. It was in this context that the Office of Juvenile Justice and Delinquency Prevention (OJJDP) asked the National Research Council to convene a committee to conduct a study of juvenile justice reform. The goal of Reforming Juvenile Justice: A Developmental Approach was to review recent advances in behavioral and neuroscience research and draw out the implications of this knowledge for juvenile justice reform, to assess the new generation of reform activities occurring in the United States, and to assess the performance of OJJDP in carrying out its statutory mission as well as its potential role in supporting scientifically based reform efforts.

Available in PDF, EPUB and Kindle. Book excerpt: This 2002 book addresses one of the most controversial topics in restorative justice: its potential for dealing with conflicts within families. Most restorative justice programs specifically exclude family violence as an appropriate offence to be dealt with this way. This book focuses on the issues in family violence that may warrant special caution about restorative justice, in particular, feminist and indigenous concerns. At the same time it looks for ways of designing a place for restorative interventions that respond to these concerns. Further, it asks whether there are ways that restorative processes can contribute to reducing and preventing family violence, to healing its survivors and to confronting the wellsprings of this violence. The book discusses the shortcomings of the present criminal justice response to family violence. It suggests that these shortcomings require us to explore other ways of addressing this apparently intractable problem.

Available in PDF, EPUB and Kindle. Book excerpt: Advocates of restorative justice question the state's ability to deliver satisfactory justice to the community, both in criminal and other cases. This collaborative 2001 volume looks at the burgeoning restorative justice movement and considers the relationship between restorative justice and civil society, examining debates and exploring ideas about who should 'control' restorative justice, the state or civil society. A diverse range of chapters, written by leaders in the field, engage with different aspects of restorative justice. Genuinely international, the book addresses aspects of civil society including schools, families, churches and private workplaces, the women's movement, victims of crime and indigenous groups. It also considers broader issues such as democracy, human rights, access and equity. A dynamic and provocative volume, this book attempts to bring the ideals of restorative justice to life so that victims, offenders, their families and communities have more of a say in the justice process.

Book excerpt: Past methods of probation and parole supervision have largely relied on caseworkers who monitor their "clients" as well as they can. But, as numbers of "clients" increase, studies indicate that this model is ineffectual. The time has come to significantly rethink the approaches to community supervision. As described in What Is Community Justice?, the aim of the new efforts is to explicitly integrate the community and the criminal justice process in probation programs. There are five key goals that this book addresses to achieve this end: The building of partnerships between community supervision agencies and the community Expanding the "client" definition to include the victim of crime, the family of the offender, and the community itself Focus on places: agencies must take into account important local differences in neighborhoods Preventing problems between the community and the client rather than reacting to them Adding value to community life This book addresses the specific ways of achieving these goals by presenting six case studies of probation programs that represent a practical side of the community justice ideal. What emerges is a provocative and enlightening new approach to the problems of probation and parole.
