Book excerpt: This book presents a navigating framework of legal culture and legality to facilitate a comprehensive understanding of the English and Australian determination of the grounds of judicial review. This book facilitates tangible process of how and why jurisdictional error, jurisdictional fact, proportionality and substantive legitimate expectations are debatable in English law, while they are either completely rejected or firmly entrenched in Australian law. This book argues that these differences are not just random. Legality is not just a fig-leaf, but is profoundly rooted in legal systems’ legal culture; hence, it dictates the way in which courts empower, justify, constrain or limit the scope of judicial review. This book presents evidence that courts differ in legal systems and apply diverse ways to determine the scope of judicial review based on their deep understanding of legality, which is embedded in the legal culture of their legal system. This book uses comparative methodology and develops this framework between English and Australian law. Although obvious and important, this book presents a kind of examination that has never been undertaken in this depth and detail before.

Book excerpt: Dealing with critical issues of ownership, control and use of water as a resource, AUSTRALIAN WATER LAW offers practical and up-to-date guidance in an increasingly important area. Interconnected with property law and environmental law, water poses special regulatory challenges because of its character and potential; it also poses opportunities for disputes and litigation. A complex web of state and federal legislation seeks to manage and protect water and water rights, challenging practitioners who are advising on matters like access rights, statutory water entitlements, water planning and resource protection. Commercially, water law affects a widening range of infrastructure development and management projects, while the development of a national water market offers opportunities in trading of water rights, and risks and controls. Kate Stoeckel, Romany Webb and Luke Woodward bring to bear their considerable legal experience in matters involving water rights as well as regulation of the water and sewerage industry and Amy Hankinson offers her significant expertise in environmental law and water management.

Book excerpt: Nauru is a small island in the Pacific which was endowed by nature with some of the richest phosphates in the world. Phosphate mining began on the island in 1906, when Nauru was still part of the German empire. Following Germany's defeat in 1918, Nauru was entrusted by the League of Nations to the care of the United Kingdom, Australia and New Zealand. It was a fiduciary relationship which, after the Second World War, continued under the trusteeship system of the United Nations. During this period Nauru's idyllic landscape was disastrously transformed, reducing much of the island to a lunar waste fringed in tropical splendour. Nauru: Environmental Damage under International Trusteeship summarizes part of the ten-volume 'Report of the Commission of Inquiry on the Rehabilitation of Phosphate Lands in Nauru', which was presented to the Government of Nauru in 1988. The report covered the responsibilities of the powers which controlled Nauru for rehabilitation of the lands which had been devastated by phosphate mining. It also inquired into the feasibility and manner of rehabilitation. Professor Christopher Weeramantry, the Chairman of the Commission, has written a fascinating and accessible summary of the portion of the report dealing with international responsibility. The issues include a number of areas of international law relating to mandate and trusteeship, environmental law, abuse of power, unjust enrichment, acquired rights, and permanent sovereignty over natural resources. Nauru is probably the most detailed practical study of an international mandate and trusteeship ever written. The issues explored in the book are of far-reaching importance. The story of Nauru has a significancereaching well beyond the tiny coral island.

Available in PDF, EPUB and Kindle. Book excerpt: A History of Australian Legal Education examines the history and development of legal education in Australia by tracing the establishment of university law schools and other forms of legal education in the States and Territories from the time of European settlement in 1788 to the present day. While early Australian legal education was founded on historic practices adopted in England and Wales over many centuries, the circumstances of the Australian colonies, and later States, have led to a unique historical trajectory. The book considers the critical role played by legal education in shaping the culture of law and thus determining how well the legal system operates in practice. In addition, it examines a major challenge for legal educators, namely, the tension between 'training' and 'educating', which has given rise to a plethora of inquiries and reports in Australia. In the final analysis, it argues that legal education can satisfactorily meet the twin objectives of training individuals as legal practitioners and providing a liberal education that facilitates the acquisition of knowledge and transferable skills.

Book excerpt: Leading Cases in Australian Law provides, in essence, a summary of the 200 most cited cases in Australian law. Each case note contains an outline of the facts, issues and decision, an extract of the most frequently cited portions of the judgment, commentary incorporating later decisions on the topic, and cross-references to the leading texts on the legal area of the case. Finally, under each case heading there is a single-sentence proposition for which the case stands as authority, and these are later collated in a table for easy reference. This is the first book of its kind published in Australia, and it is intended to serve as a portrait of Australian law as currently practised. Appendices are included to complete this picture, providing further information such as lists of top cases by subject area, and a ranking of the most cited judges. This book will be useful to law students, who will likely encounter most of these cases during the course of their degree, as well as to legal practitioners, who will find it a useful reference for the cases that have faded from memory since law school as well as the cases cited in daily practice.
