Book excerpt: A petition seeking the recall of a local officer must be certified by an affidavit by the sponsor who personally circulated the petition. The oath or affirmation required for an affidavit may be administered by a notary public. The fact that an oath or affirmation has been administered may be proved by presence of a valid jurat or by evidence a̲l̲i̲u̲n̲d̲e̲ presented at the time the petition is filed with the county election officer. The jurat must be in one of the forms set forth in K.S.A. 1989 Supp. 53-508 and must include the date of the notarial act. If the jurat fails to meet either of these requirements, the jurat is invalid and the petition will lack the required affidavit. A petition seeking the recall of a local officer which lacks the affidavit by the sponsor who personally circulated the petition will be deemed insufficient. Cited herein: Kan. Book excerpt: Under K.S.A. 1990 Supp. 74-4914(6), a retirant who retired on or after July 1, 1988, and is employed or appointed in or to any position or office for which compensation for service is paid, in an amount equal to $6,000 or more in any one calendar year, by any participating employer for which such retirant was employed or appointed during the final two years of such retirant's participation, may not receive any retirement benefit for any month for which such retirant serves in such position or office. Retirants employed as substitute teachers or officers, employees, appointees or members of the legislature, or any other elected officials are exempt from application of K.S.A. 1990 Supp. 74-4914(6). The classifications set forth in the statute need have only a rational basis to the purpose of the legislation to be deemed valid classifications. Because legislative classifications have a presumption of constitutionality and no evidence which would override such a presumption has been presented, the classifications set forth in K.S.A. 1990 Supp. 74-4914(6) are not deemed to violate the equal protection clauses of the United States constitution and Kansas constitution. Book excerpt: The campus of a community college, at least for its students, possesses many of the characteristics of a public forum. For the board of trustees of a community college to prohibit or restrict speech based on the content of that speech, the board must show that its regulation is necessary to serve a compelling state interest and that it is narrowly drawn to achieve that end. The board may enforce regulations of the time, place and manner of expression if such regulations are content-neutral, are narrowly tailored to serve a significant governmental interest and leave open ample alternatives of communication. The presence of political campaign posters and signs in or on buildings located on the campus of a community college does not jeopardize the tax-exempt status of the community college. Failure to meet this deadline does not invalidate the changed valuations. If notices are mailed late and the hearing/appeal deadlines are not extended, taxpayers who are unable to request or attend a hearing/appeal procedure for this reason are deemed to have had their request for relief denied, and a final determination or order to that effect must be issued so that they may proceed to the next step in the process. Constitutional due process requirements are met if the taxpayer has been given a meaningful notice and opportunity to be heard at some stage in the proceedings.
