Now everything Adam took for granted is suddenly threatened, and he’s caught between his newly awakened attachment to Emerald Springs and the career he built with his hands. Available in PDF, EPUB and Kindle. Book excerpt: In this highly original work, Thomas D. Wilson offers surprising new insights into the origins of the political storms we witness today. Wilson connects the Ashley Cooper Plan--a seventeenth-century model for a well-ordered society imagined by Anthony Ashley Cooper (1st Earl of Shaftesbury) and his protege John Locke--to current debates about views on climate change, sustainable development, urbanism, and professional expertise in general. In doing so, he examines the ways that the city design, political culture, ideology, and governing structures of the Province of Carolina have shaped political acts and public policy even in the present. Wilson identifies one of the fundamental paradoxes of American history: although Ashley Cooper and Locke based their model of rational planning on assumptions of equality, the lure of profits to be had from slaveholding soon undermined its utopian qualities. Wilson argues that in the transition to a slave society, the "Gothic" framework of the Carolina Fundamental Constitutions was stripped of its original imperative of class reciprocity, reverberating in American politics to this day. Reflecting on contemporary culture, Wilson argues that the nation's urban-rural divide rooted in this earlier period has corrosively influenced American character, pitting one demographic segment against another. While illuminating the political philosophies of Ashley Cooper and Locke as they relate to cities, Wilson also provides those currently under attack by antiurbanists--from city planners to climate scientists--with a deeper understanding of the intellectual origins of a divided America and the long history that reinforces it.

Available in PDF, EPUB and Kindle. Book excerpt: President Andrew Jackson’s conflict with the Second Bank of the United States was one of the most consequential political struggles in the early nineteenth century. A fight over the bank’s reauthorization, the Bank War provoked fundamental disagreements over the role of money in politics, competing constitutional interpretations, equal opportunity in the face of a state-sanctioned monopoly, and the importance of financial regulation—all of which cemented emerging differences between Jacksonian Democrats and Whigs. As Stephen W. Campbell argues here, both sides in the Bank War engaged interregional communications networks funded by public and private money. The first reappraisal of this political turning point in US history in almost fifty years, The Bank War and the Partisan Press advances a new interpretation by focusing on the funding and dissemination of the party press. Drawing on insights from the fields of political history, the history of journalism, and financial history, The Bank War and the Partisan Press brings to light a revolving cast of newspaper editors, financiers, and postal workers who appropriated the financial resources of preexisting political institutions and even created new ones to enrich themselves and further their careers. The bank propagated favorable media and tracked public opinion through its system of branch offices, while the Jacksonians did the same by harnessing the patronage networks of the Post Office. Campbell’s work contextualizes the Bank War within larger political and economic developments at the national and international levels. Its focus on the newspaper business documents the transition from a seemingly simple question of renewing the bank’s charter to a multisided, nationwide sensation that sorted the US public into ideologically polarized political parties. In doing so, The Bank War and the Partisan Press shows how the conflict played out on the ground level in various states—in riots, duels, raucous public meetings, politically orchestrated bank runs, arson, and assassination attempts. The resulting narrative moves beyond the traditional boxing match between Jackson and bank president Nicholas Biddle, balancing political institutions with individual actors, and business practices with party attitudes.

Available in PDF, EPUB and Kindle. Book excerpt: To understand our current world crises, it is essential to study the origins of the systems and institutions we now take for granted. This book takes a novel approach to charting intellectual, scientific, and philosophical histories alongside the development of the international legal order by studying the philosophy and theology of the Scientific Revolution and its impact on European natural law, political liberalism, and political economy. Starting from analysis of the work of Thomas Hobbes, Robert Boyle and John Locke on natural law, the author incorporates a holistic approach that encompasses global matters beyond the foundational matters of treaties and diplomacy. The monograph promotes a sustainable transformation of international law in the context of related philosophy, history, and theology. Tackling issues such as nature, money, necessities, human nature, secularism, and epistemology which underlie natural lawyers' thinking, Dr García-Salmones explains their enduring relevance for international legal studies today.

Book excerpt: A Federalist Notable Book “An important contribution to our understanding of the 14th Amendment.” —Wall Street Journal “By any standard an important contribution...A must-read.” —National Review “The most detailed legal history to date of the constitutional amendment that changed American law more than any before or since...The corpus of legal scholarship is richer for it.” —Washington Examiner Adopted in 1868, the Fourteenth Amendment profoundly changed the Constitution, giving the federal judiciary and Congress new powers to protect the fundamental rights of individuals from being violated by the states. Yet, the Supreme Court has long misunderstood or ignored the original meaning of its key Section I clauses. Barnett and Bernick contend that the Fourteenth Amendment must be understood as the culmination of decades of debate about the meaning of the antebellum Constitution. In the course of this debate, antislavery advocates advanced arguments informed by natural rights, the Declaration of Independence, and the common law, as well as what is today called public-meaning originalism. The authors show how these arguments and the principles of the Declaration in particular eventually came to modify the Constitution. They also propose workable doctrines for implementing the amendment’s key provisions covering the privileges and immunities of citizenship, due process, and equal protection under the law.
