As well as offering the first treatment of the history, philosophy, and politics of the application of the offence of misconduct in office to Members of Parliament in England and Wales, Horder explains how political corruption might be dealt with in future, and how politicians could be held accountable for their actions so that they are deterred from betraying the public's trust. Use of the criminal law should not be the sole or even the main way to remedy all corruption in politics. Nevertheless, for too long the offence of misconduct in a public office has had an ambiguous status in the political realm. If we are to preserve the good health of government it must be seen as a constitutional fundamental. A charge of misconduct provides a way in which corrupt conduct on the part of legislators can be punished with an appropriate label, holding them to account for the misuse of power by reference to the standards of ordinary people. When other - civil law or regulatory - means prove insufficient, it should be possible for ordinary members of a jury, and not for Parliamentarians or other officials, to decide whether, for example, the expenditure of public money on legislators' private income and benefits amounts to a criminal abuse of the public's trust. This book offers an authoritative and accessible account of a 'bottom-up' (jury standards-led), as opposed to a 'top-down' (officials applying their own standards), approach to the role of the criminal law in constitutional contexts.

The Committee scrutinised the Government's proposal for a compensation scheme to help offset some of the future electricity price rises that energy intensive industries will face as a result of the EU Emissions Trading System and the Government's Carbon Price Floor. Across Europe a large surplus of emission allowances in the EU Emissions Trading System worth 4.1 billion Euros had been accrued by large industrial companies as a result of pre-recession overly optimistic forecasts of growth and fierce lobbying by heavy industry. Sales of these allowances had already raised 1.8 billion Euros for these companies. In the UK, the Government's proposed rules do not take the value of these excess allowances into account when calculating compensation. The Committee also calls for an energy intensive industries strategy, as part of a wider UK manufacturing strategy, to set out a path for their maximum feasible decarbonisation and help guide and support companies to reduce their dependence on fossil fuels. Such a strategy should identify by how much these industries can feasibly decarbonise and improve their energy efficiency and how the Government will help to ensure that this is achieved, including through energy consumption reduction measures and incentives, and support for innovation, technological research, development and investment.

The increase will take effect from 1 April 2012. Given the increases in pension contributions in other public service schemes, IPSA has decided that it is appropriate for MPs to pay more into their own pensions. This decision also recognises the vote in House of Commons last year calling on IPSA to increase pension contributions in line with increases in other public service schemes. Unusually, in their current pension scheme, MPs can select the rate at which they accrue benefits - 40ths, 50ths, or 60ths of their annual salary. In recognition of the already high contribution some MPs make to their pensions (11.9%), IPSA has decided to allow MPs to change the rate at which benefits accrue. Should MPs choose to reduce the rate of their accrual, their contributions would be lower but so too the benefits they receive from the taxpayer. The contribution increase is an interim measure as IPSA carries out its longer term review of pay and pensions - a review which will be complete by the end of 2013 and which will make MPs' remuneration sustainable and fair to MPs and taxpayers alike
