Book excerpt: One of the more innovative aspects of the Trans-Pacific Partnership Agreement (TPP) negotiations has been an emphasis on granting full market access to member countries with 'no exceptions'. This statement has been made repeatedly from the earliest days of the negotiations in March 2010 and reiterated often throughout the talks. Even if - in the end - there are modest levels of protection remaining in a very limited number of agricultural sectors, the promises to open the market fully remain striking. A willingness to open markets with no exceptions means putting the most sensitive areas up for discussion. For nearly all countries, this means agricultural products. For a variety of reasons, including history, culture, and politics, agriculture usually holds special significance to states. As this chapter highlights, unlike industrial goods, neither repeated commitments in multilateral fora like those created by the General Agreement on Tariffs and Trade (GATT) or the World Trade Organization (WTO) nor promises made in regional or bilateral preferential trade agreements (PTAs) have resulted in similar low levels of protection for agricultural products. Yet officials have pledged in the TPP to put these highly sensitive areas up for liberalisation to the other partners. Why are officials so prepared to take on this task in the TPP when they have been unwilling to do so in other venues?

U.S. agricultural exports to the region will be 5 percent, or about $3 billion higher, and U.S. agricultural imports from the region in 2025 will be 2 percent, or $1 billion higher in value compared with the baseline.

For example, decisions on key market access issues on auto, dairy, sugar, and textiles and apparel may depend on the outcome of rules negotiations involving intellectual property rights or state-owned enterprises, among other issues. Over 20 chapters are under discussion in the negotiations. The United States is negotiating market access for goods, services, and agriculture with countries with which it does not currently have FTAs: Brunei, Japan, Malaysia, New Zealand, and Vietnam. Negotiations are also being conducted regarding disciplines on intellectual property rights, trade in services, government procurement, investment, rules of origin, competition, labor, and environment, among other issues. In many cases, the rules being negotiated are intended to be more rigorous than comparable rules found in the WTO. Some topics, such as state-owned enterprises, regulatory coherence, and supply chain competitiveness, may break new ground in FTA negotiations. As the countries that make up the TPP negotiating partners include advanced industrialized, middle income, and developing economies, the TPP, if implemented, may involve restructuring and reform of the economies of some participants. It also has the potential to spur economic growth in the region. As a leading trade policy initiative of the Obama Administration, the TPP serves several strategic goals. It is a manifestation of the Administration's “rebalance” to the Asia-Pacific, and if concluded, may serve to shape the economic architecture of the region. It has the potential to harmonize existing agreements with U.S. FTA partners, attract new participants, and establish regional rules on new policy issues facing the global economy—possibly providing impetus to future multilateral liberalization under the WTO. As the negotiations proceed, a number of issues important to Congress have emerged. One is whether the United States can balance its vision of creating a “comprehensive and high standard” agreement with a large and expanding group of countries, while not insisting on terms that other countries will reject. Another issue is how Congress will consider the TPP, if concluded. The present negotiations are not being conducted under the auspices of formal trade promotion authority (TPA)—the latest TPA expired on July 1, 2007—although the Administration informally is following the procedures of the former TPA. Different views exist regarding the appropriate timing of potential TPA legislation relative to the possible conclusion of the TPP.

Even though the share of Japan's food consumption provided by Japanese production has gradually fallen, Japan's farm sector remains the second-largest among the countries negotiating the Trans-Pacific Partnership (TPP). Japan's food industry is increasingly integrated with TPP economies, although the TPP share of Japan's agri-cultural imports has fallen over time. The proposed TPP agreement would lead to more agricultural exports to Japan from TPP partners, likely dominating the total agricultural trade impact of such an agreement. Despite potentially large import increases, espe-cially in the rice, beef, and dairy sectors, the proposed agreement would only margin-ally reduce Japan's output. Intrinsic strengths of Japanese agricultural production and constraints to the growth of supply in the rest of the TPP countries may limit the impact of the agreement on Japan's agriculture. Nevertheless, U.S. exports would be well posi-tioned to meet Japan's new import demand.

Book excerpt: The challenges to meeting the growing global food demand—population and income growth and supply uncertainties complicated by climate change, environmental pressures, and water scarcity—all point to the increasing importance of trade and the need for a more, not less, open trading system. Growth in agricultural trade has been facilitated in part through the rules-based system established under the World Trade Organization (WTO), particularly the Uruguay Round Agreement on Agriculture (AoA). The AoA was implemented in 1995 and brought substantial discipline to the areas of market access, domestic support, and export competition. However, progress since the Uruguay Round has been limited. While the Doha Development Agenda (DDA) was launched with much anticipation in 2001, members failed to reach agreement in July 2008 and the trade agenda in Geneva has since advanced slowly. Despite the best efforts of many, the negotiating intensity seen in late 2007 and 2008 has largely dissipated, in part due to the global recession and the inevitable changes in governments that sometime shift the focus of negotiations. Serious efforts were made to renew the negotiations, but in the end, members have had to be content with harvesting the low-hanging fruit, such as trade facilitation and export competition. Although there have been significant accomplishments, they represent but a small portion of what was on the table during the DDA negotiations. In addition, negotiated settlements on the tougher issues, such as market access and domestic support, have become more difficult to obtain in isolation. The recent experience at the WTO’s Eleventh Ministerial Conference in Buenos Aires highlights the difficulties of reaching a negotiated settlement on domestic support in isolation from, say, market access. Given the increasing importance of trade in addressing food security needs and its critical role in efforts to eliminate malnutrition and hunger by 2030, achieving further progress in the liberalization of world trade is of paramount importance.
