Sob a abordagem construtivista dos problemas ambientais, centra-se o trabalho na teoria da sociedade de risco, marco teórico desenvolvido pelos sociólogos Ulrich Beck e Anthony Giddens, e que se comunica com aquela perspectiva. Assentes as bases da pesquisa, analisa-se os reflexos para o Direito Ambiental brasileiro da percepção pública dos problemas ambientais, delineando-se a trajetória percorrida por eles, desde o silêncio à crise ambiental. Verifica-se que ao aumento do rol de problemas ambientais legitimados social, política e juridicamente tem correspondido a crescente produção de normas jurídicas sobre a matéria. Na contramão desta proliferação de normas jurídicas, nota-se uma queda no nível de proteção ao ambiente e um aumento da litigância judicial envolvendo conflitos ambientais. A partir daí, delineia-se a importância do palco judicial como mais um nível de negociação social dos problemas ambientais e sua incapacidade de dar respostas a estas demandas, o que implica reconhecer que um aumento da litigância judicial sobre questões ambientais não significa um aumento na pauta de proteção do meio ambiente.
