Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Short History of Parliament, 1295-1642 This little book is not a history of parliament in the usual sense. No attempt is made to discuss obscure points of origins nor to do justice to certain thorny questions upon which reputable historians still disagree. It does include the main facts to be found in standard constitutional texts, and some of the more technical data, figures, and dates are supplied in notes and appendices for those who want them. It is addressed to students of college age, and may serve as collateral reading for college courses in English history or literature. It is hoped that it may also have some value for a wider reading public, including those interested in parliamentary government wherever it may be found in the world today. The purpose is fivefold: (1) to make available the valuable results of recent research scattered through learned monographs, essays, and review articles; (2) to give something of the flavor and points of view of the eras concerned by some quotation from the contemporary sources; (3) to bridge the division, usually too sharply made, between "medieval" and "modern"; (4) to bring the "men of law" into the picture - the legal historian who illuminates the subject by a special approach and the man of law in parliament who made many a practical as well as theoretical contribution; (5) last but not least, to bring parliaments - even those of "medieval" times - and their members to life, to dramatize, as it were, their personnel and activities. Available in PDF, EPUB and Kindle. Book excerpt: What explains contemporary variations in African legislative institutions – including their strengths and weaknesses? Compared with the more powerful executive branches, legislatures throughout the continent have historically been classified as weak and largely inconsequential to policy-making processes. But, as Ken Ochieng' Opalo suggests here, African legislatures actually serve important roles, and under certain conditions, powerful and independent democratic legislatures can emerge from their autocratic foundations. In this book, Opalo examines the colonial origins of African legislatures, as well as how postcolonial intra-elite politics structured the processes of adapting inherited colonial legislatures to local political contexts and therefore continued legislative development. Through case studies of Kenya and Zambia, Opalo offers a comparative longitudinal study of the evolution of legislative strength and institutionalization as well as a regional survey of legislative development under colonial rule, postcolonial autocratic single-party rule, and multiparty politics throughout Africa.

Available in PDF, EPUB and Kindle. Book excerpt: A scholar of law and religion uncovers a surprising origin story behind the idea of the separation of powers. The separation of powers is a bedrock of modern constitutionalism, but striking antecedents were developed centuries earlier, by Jewish scholars and rabbis of antiquity. Attending carefully to their seminal works and the historical milieu, David Flatto shows how a foundation of democratic rule was contemplated and justified long before liberal democracy was born. During the formative Second Temple and early rabbinic eras (the fourth century BCE to the third century CE), Jewish thinkers had to confront the nature of legal authority from the standpoint of the disempowered. Jews struggled against the idea that a legal authority stemming from God could reside in the hands of an imperious ruler (even a hypothetical Judaic monarch). Instead scholars and rabbis argued that such authority lay with independent courts and the law itself. Over time, they proposed various permutations of this ideal. Many of these envisioned distinct juridical and political powers, with a supreme law demarcating the respective jurisdictions of each sphere. Flatto explores key Second Temple and rabbinic writings—the Qumran scrolls; the philosophy and history of Philo and Josephus; the Mishnah, Tosefta, Midrash, and Talmud—to uncover these transformative notions of governance. The Crown and the Courts argues that by proclaiming the supremacy of law in the absence of power, postbiblical thinkers emphasized the centrality of law in the people’s covenant with God, helping to revitalize Jewish life and establish allegiance to legal order. These scholars proved not only creative but also prescient. Their profound ideas about the autonomy of law reverberate to this day.
