Book excerpt: The Committee shares the Commission's concerns about the risk that these substances pose to all EU citizens, and supports the EU's work towards common definitions and information-sharing assisted by the European Monitoring Centre for Drugs and Drug Addiction, as well as Europol's efforts to fight drug trafficking more generally. However, it does not agree that the best place to take decisions to ban new psychoactive substances is at EU level. They do not allow the requisite level of flexibility for Member States to respond rapidly to local situations and to make their own decisions about the threats posed by new psychoactive substances and the appropriate response. The Committee considers that the proposed Regulation and Directive do not comply with the principle of subsidiarity, which means that decisions should be made at the lowest appropriate level - in this case, by each Member State

Available in PDF, EPUB and Kindle. Book excerpt: In recent years the pace of reform in health policy and the NHS has been relentless. But how are policies formed and implemented? This fully updated edition of a bestselling book explores the processes and institutions that make health policy, examining what constitutes health policy, where power lies, and what changes could be made to improve the quality of health policy making. Drawing on original research by the author over many years, and a wide range of secondary sources, the book examines the role of various institutions in the formation and implementation of health policy. Unlike most standard texts, it considers the impact of devolution in the UK and the role of European and international institutions and fills a need for an up-to-date overview of this fast-moving area. It features new case studies to illustrate how policy has evolved and developed in recent years. This new edition has been fully updated to reflect policies under the later years of New Labour and the Coalition government. Although written particularly with the needs of students and tutors in mind, this accessible textbook will also appeal to policy makers and practitioners in the health policy field.

Book excerpt: This book is about tax and social policy and how they interact with each other. The impact of taxation as an instrument of social policy is central in influencing redistribution and behaviour. This broad-based edited collection fills a significant gap in both literatures, bringing together disparate debates in this emerging area of analysis. It guides readers through the key interactions of tax and social policies and the central debates and challenges posed by their effect on each other. It examines how analyses might be combined and policy options developed for more effective delivery and impact in both areas.

This book was released on 2013-12-10 with total page 26 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report is a follow up to the March 2012 report on the European Commission's proposals for a Financial Transaction Tax (HL paper 287, session 2010-12, ISBN 9780108475771). Now the Commission has given the green light to a sub-group of 11 Member States to move forward with a significantly revised tax proposal, under a process known as enhanced cooperation - a move which the European Union Committee condemns as being divisive, significantly detrimental to the UK's interest and deliberately contentious in such a controversial area. The report finds serious flaws with the Commission's use of enhanced cooperation, namely: the tax would have an adverse impact on institutions in the non-participating Member States, such as the UK; the legislation could see the UK unfairly being required to collect the tax on behalf of other Member States, such as Germany and France; this use of enhanced cooperation fails to meet the requirements of EU law, including in respect of the Single Market; the flawed process by which the Commission has allowed enhanced cooperation to be used risks undermining its use in the future. The Committee criticises the UK Government for their slowness to appreciate the potential damage to the UK that such a tax could present. However they welcome the Government's belated decision to launch a legal challenge in a bid to annul the decision.

Available in PDF, EPUB and Kindle. Book excerpt: The euro area sovereign debt crisis has been the greatest threat to the euro since its inception, but the consequences of the crisis go well beyond the realm of macroeconomics: the crisis has cast doubt on the viability of a mechanism of integration such as the one envisaged in Economic and Monetary Union (EMU), and on the future of the European Union as a political project in the face of citizens' growing disaffection. The various responses to the crisis have not only altered the principles underlying EMU; they have also had a profound impact on the constitutional orders of the EU and its Member States. This book focuses on the euro area crisis and its aftermath from a constitutional perspective. It provides a critical analysis of the workings and evolution of Economic and Monetary Union, the changes brought by the crisis and their broader effects, and the constitutional obstacles to integration in this area. Looking forward, it tackles the uncertain future of economic and fiscal integration and the challenges posed. This is a compelling and incisive account of some of the most significant developments and dilemmas facing the European Union since its creation.

Available in PDF, EPUB and Kindle. Book excerpt: This timely and accessible book is the first to provide a thorough analysis of the 2008 Constitution of Myanmar (Burma) in its historical, political and social context. The book identifies and articulates the principles of the Constitution through an in-depth analysis of legal and political processes and practises, particularly since the 1990s. The core argument of this book is that the 2008 Constitution is crucial to the establishment and maintenance of the military-state. The military-state promotes the leadership role of the military in governance based on a set of ideological commitments and a centralised form of organisation based on the concept of the Union. The book develops this argument by demonstrating how the process of constitution-making and the substance of the 2008 Constitution contribute to its lack of credibility and fuel demands for reform. The vision offered by the 2008 Constitution and its associated institutions has been the subject of fierce contestation, not least, for example, due to concerns over the militarisation of the state. This book is animated by debates over fundamental ideas such as the nature of democracy, the possibility of peace and federalism, the relationship between the executive and the legislature, relations between the Union government and sub-national governments, debates over judicial independence and the oversized role of the Tatmadaw (armed forces). Central to the future of the Constitution and the military-state is the role of the Tatmadaw, which will be a key determinant in any potential shift from the present highly centralised, partly-democratic Union to a federal or decentralised democratic system of governance.

Book excerpt: The BBC did a good job in completing the move to Salford on time, within budget and without disruption services. However, the scale of some of the allowances paid to staff to relocate to Salford is difficult to justify. There were 11 cases where the cost of relocating staff exceeded £100,000 per person, with one costing £150,000. The BBC also failed to make a proper record of the exceptions it made to its allowance policy. The longer term success of the move to Salford depends on the BBC achieving the wider benefits it promised. These include reducing the gap between Northern and Southern audiences in the BBC's market share and stimulating economic and other regional benefits, including creating up to 15,000 jobs. The BBC should set clearly defined expectations for its relationships with its commercial partners and make clear that they must pay their fair share of tax. The BBC's decision to enter into a 10-year contract with the Peel Group for studio space at Salford seems to take little account the fast pace of change in the broadcasting industry. The BBC could end up having to pay for studio services it no longer needs and become overly dependent on them. There is also dismay at the abandonment of the BBC's Digital Media Initiative at a cost to the licence fee payer of £100 million. There have been conflicting reports from the BBC and the BBC Trust on what the project did or did not deliver

Book excerpt: About the first edition: "School governors will find this a sound and practical guide to the nature of their responsibilities and the process of managing their workload. It is well researched, based on vast experience, illustrated from the best practice, free from jargon – and always interesting." Joan Sallis. Described by the National Association of Governors and Managers as "definitely a ‘must’ for your bookshelf"; reviewed in the Times Educational Supplement as an "essential guide to help governors". This book is about governing schools – about how a governing board made up largely of ‘ordinary’ people with no professional educational experience, working in partnership with professional leaders, can help to make schools better. It is intended for governors in schools in England and Wales, in other parts of the world where lay people engage in school leadership, and for people who work with governors. Improving School Governance examines: How school governors got to be where they are today How governing boards do their jobs How individual governors can best contribute to their schools Governors’ accountability The nature of governors’ meetings The rights that governors have The relationships between governors and the headteacher The role of governing boards in school inspection Governors’ relationships with parents and the wider community How to evaluate the performance and impact of governing boards What the future might hold for state-funded schools and their governance What national strategic issues will need to be addressed by governing boards in the next five to ten years

Book excerpt: Consideration of harmful short-termism in capital markets is prevalent amongst legal and business academics. It is also garnering increased attention in corporate board rooms and executive suites, and from the investing public. As a result, correcting perceived short-termism in capital markets has become a rationale for reform used by regulators across the globe. Despite the considerable attention given to this phenomenon, there has not yet been a comprehensive book analyzing the perceived short-termism problem, its sources and causes, and reform efforts undertaken to date. This book fills this gap by documenting the rise of the short-termism discussion, analyzing the significance of the problem, and considering the proposed legal remedies. Based on this analysis, a framework for effective short-termism reform is offered.

Book excerpt: In this book, Katarzyna Granat analyses and evaluates Europe's experience with the Early Warning System (EWS) which allows national parliaments to review draft legislative acts of the European Union for their compatibility with the subsidiarity principle. The EWS was introduced in response to the perceived 'democratic deficit' of the EU and its 'creeping' competences, and represented one of the landmark reforms of the Lisbon Treaty. The purpose of this book is to present and critically analyse the functioning of the new mechanism of subsidiarity review and the role that national parliaments have played within this system. Compared to the existing leading publications on the Europeanisation of national parliaments and contributions on the EU principle of subsidiarity, this book offers – for the first time – a profound legal analysis of the procedure enriched by a comprehensive empirical analysis of the activities of national parliaments. It is directed at scholars of EU law and policy, European and national officials, and legal practitioners working in and with the national legislatures.

It welcomes proposals for an Investment Plan for Europe and for a Capital Markets Union. Yet the responsibility for promoting growth and prosperity lies not only with the Commission but with every Member State. The UK has the largest financial sector in the EU, and the implications of these reforms for this country are therefore immense. Yet the Committee finds that the UK's influence over the EU financial services agenda is diminishing. It calls on the Government and all UK authorities to take urgent steps to correct this. The prosperity of the City of London, and the financial services industry it hosts, is in the interests not only of the UK but of the EU as a whole.

This book was released on 2014 with total page 64 pages. Available in PDF, EPUB and Kindle. Book excerpt: The FCO designated 28 countries of concern in its 2013 report, where it judged the gravity of the human rights abuses to be so severe that a particular focus should be applied. The Committee concentrated attention on three of these countries: Sri Lanka, Burma, and Israel and the Occupied Palestinian Territories. Favourable trade concessions to the EU market should be removed from Sri Lanka if the Government of Sri Lanka continues to deny the OHCHR investigation team access into the country. The Government should advocate re-imposition of sanctions by the EU if there is no improvement in the human rights situation in Burma. The human rights of Israeli, Palestinian and Bedouin citizens living in Israel and the Occupied Palestinian Territories continue to be of serious concern to the UK.
