Available in PDF, EPUB and Kindle. Book excerpt: The 2017 Operational Law Handbook (OPLAW) is a focused collection of diverse legal and practical information. Used by Department of Defense Judge Advocates as a "how to" guide, the handbook provides references and describes tactics and techniques for the practice of operational law. The handbook is intended to help the reader recognize, analyze, and resolve the problems encountered in an operational context and make a determination to use force abroad. The Operational Law Handbook covers the law of armed conflict, rules of engagement, intelligence law and interrogation operations, cyberspace operations, non-combatant evacuation operations, detainee operations, fiscal law, military justice, and the military decision-making process and operational plans. The discussion on the lawful use of lethal force (jus ad bellum) is particularly enlightening. Understanding these principles will enable commanders to plan their missions, structure public statements, and conform the conduct of military operations to national policy. It also will assist commanders in understanding and drafting mission-specific rules of engagement consistent with national security and policy objectives. Why buy a book you can download for free? We print this book so you don't have to. First you gotta find a good clean (legible) copy and make sure it's the latest version (not always easy). Some documents found on the web are missing some pages or the image quality is so poor, they are difficult to read. We look over each document carefully and replace poor quality images by going back to the original source document. We proof each document to make sure it's all there - including all changes. If you find a good copy, you could print it using a network printer you share with 100 other people (typically its either out of paper or toner). If it's just a 10-page document, no problem, but if it's 250-pages, you will need to punch 3 holes in all those pages and put it in a 3-ring binder. Takes at least an hour. It's much more cost-effective to just order the latest version from Amazon.com This book is published by 4th Watch Publishing Co. and includes copyright material. Book excerpt: The Operational Law Handbook is a “how to” guide for Judge Advocates practicing operational law. It provides references and describes tactics and techniques for the practice of operational law. The Operational Law Handbook is not a substitute for official references. Like operational law itself, the Handbook is a focused collection of diverse legal and practical information. The handbook is not intended to provide “the school solution” to a particular problem, but to help Judge Advocates recognize, analyze, and resolve problems they will encounter in the operational context. Similarly, the Handbook is not intended to represent official U.S. policy regarding the binding application of varied sources of law, though it may reference source documents which themselves do so. The Handbook was designed and written for Judge Advocates practicing operational law. Simply put, the Handbook is made for the Soldiers, Marines, Sailors, Airmen, and Coast Guardsmen of the military Judge Advocate General's Corps, who serve alongside their clients in the operational context. Accordingly, the Operational Law Handbook is compatible with current joint and combined doctrine.

Rule of Law (RoL) promotion takes place in a variety of operational environments, from active combat to stable peace and everything in between and is central to counterinsurgency (COIN) operations. RoL allows people to plan their affairs with reasonable confidence that they can know in advance the legal consequences of various actions and provide guarantee against some types of official arbitrariness. The RoL is more than a safe and secure environment. It requires the security of individuals and institutions and accountability for crimes. The 2015 Rule of Law Handbook covers the interagency approach to Reconstruction and Stabilization, Strategic Planning Framework, Operational Planning, Tactical Rule of Law Planning, Deployment Planning and Metrics. The handbook also discusses: Fiscal Law, DoD Appropriations, Department of State Appropriations for Rule of Law Activities, In-Theater Rule of Law Resources and Enablers, Host Nation Enablers Human Terrain Teams, US Tactical Enablers, Written Resources, Rule of Law and Judge Advocates, Rule of Law Training and Rule of Law and the Military Planning Process. Book excerpt: The Commander's Handbook on the Law of Naval Operations August 2017 Edition NWP 1-14M MCTP 11-10B COMDTPUB P5800.7ASCOPEThis publication, The Commander's Handbook on the Law of Naval Operations August 2017 Edition, sets out those fundamental principles of international and domestic law that govern U.S. naval operations at sea. Chapters 1 through 4 relate to peacetime naval operations. They provide an overview and general discussion of the law of the sea, including definitions and descriptions of the jurisdiction and sovereignty exercised by States over various parts of the world's oceans; the international legal status and navigational rights of warships and military aircraft; protection of persons and property at sea; and the safeguarding of national interests in the maritime environment. Chapters 5 through 12 relate to naval warfare. They set out principles of law of special concern to the naval commander during any period in which U.S. naval forces are engaged in armed conflict. Although the primary emphasis of these chapters is on the conduct of naval warfare, relevant principles and concepts common to the whole of the law of war are also discussed.PURPOSEThis publication is intended for the use of operational commanders and supporting staff elements at all levels of command. It is designed to provide officers in command and their staffs with an overview of the rules of law governing naval operations in peacetime and during armed conflict. The explanations and descriptions in this publication are intended to enable the naval commander and his staff to comprehend more fully the legal foundations upon which the orders issued to them by higher authority are premised, and to understand better the commander's responsibilities under international and domestic law to execute his mission within that law. This publication sets forth general guidance. It is not a comprehensive treatment of the law nor is it a substitute for the definitive legal guidance provided by judge advocates and others responsible for advising commanders on the law. Officers in command of operational units are encouraged to utilize this publication as a training aid for assigned personnel. This publication provides general information and guidance. It is not directive, and does not supersede guidance issued by the chain of command.INTERNATIONAL LAWFor purposes of this publication, international law is defined as that body of rules that States consider binding in their relations with one another. International law is created by States. It derives from the practice of States in the international arena and from international agreements between States. International law provides stability in international relations and an expectation that certain acts or omissions will result in predictable consequences. If one State violates the law, it may expect that others will reciprocate. Consequently, failure to comply with international law ordinarily involves greater political and economic costs than does observance. In short, States comply with international law because it is in their interest to do so. Like most rules of conduct, international law is in a continual state of development and change. This publication seeks to accurately describe the state of international law on the date of the publication's issuance.Practice of StatesThe general and consistent practice among States with respect to a particular subject, which over time is accepted by them generally as a legal obligation, is known as customary international law. Customary international law is the principal source of international law and is binding upon all States.

Book excerpt: During the past eight years the Department of Defense has initiated a series of fundamental changes -in both culture and operational capability -in order to better protect the U.S. homeland from catastrophic events, natural and manmade. By necessity, these changes are closely linked to an evolving assessment of the 21st century threat environment. The legal implications associated with these changes are inevitably profound. Indeed, they go to the very definition of the military's proper role within domestic society -reigniting in the process a public policy debate that is as old as the Republic itself. For lawyers within the Department of Defense the professional challenge is immediate and rewarding -the stakes involve core questions of national security, public safety and the preservation of essential liberty. In my judgment, this new edition of the Domestic Operational Law Handbook is the seminal compilation of legal authorities (and related analysis) relevant to DOD's homeland defense and civil support missions. For most of our nation's history the United States was effectively buffered by two great oceans and secured by the war fighting capabilities of forward deployed combat forces. Moreover, a significant threat to our country's security generally required the collective resources and manpower of an adversarial nation state -or frequently, a coalition of hostile nation states. The CBRNE technology of the 21st Century has shattered that paradigm. The brutal attack of September 11, 2001, should not be seen as an isolated event, but rather, as a case study in modern conflict. While DOD must remain ever vigilant in guarding against the continuing threat from aggressive nation states, it's now clear that the asymmetric threat from terrorist organizations -or even isolated individuals -when strengthened by WMD destructive power, can pose a fundamental challenge to public safety and our vital institutions of government.
