Book excerpt: In the late 20th century, it has become widely accepted that States need to cooperate in order to pursue effectively their interests within the increasingly interdependent world order. At the same time, the principle of sovereignty is still often invoked as a claim for independence and a justification for non-cooperation. This book goes beyond that traditional understanding to develop a new theory which holds that cooperation between States is not an independent principle supplementing State sovereignty or even a counterweight to State sovereignty. Rather, cooperation should be conceived an element of the very notion of sovereignty itself. Sovereignty is not a negative principle meaning merely State independence and freedom, but it also inherently includes a positive element which stresses a State's innate membership in the international community and its authority, its responsibility, its duty to participate actively in that community. In short, sovereignty not only means independence, it also means a responsibility to cooperate. The first part of the book traces the history of the principle of sovereignty from the theories of Grotius and Francisco de Vitoria to the modern understanding of the principle in the light of the United Nations system. The second part of the book poses challenges to the traditional concept of sovereignty in the light of the 20th century interdependence, and the third part goes on to formulate a new theory which takes into account the principles of customary law and treaty law. The conclusions drawn on by the author are refreshing, but may also be controversial, and this book will most definitely contribute to the discussion and development of the principle of sovereignty in international law.

Book excerpt: Inputs of nitrogen to terrestrial and aquatic ecosystems have increased several-fold over the last one hundred and fifty years, with the steepest increases during the last four decades. The expansion of fertilizer manu facture and use, the increase in fossil fuel combustion, the intensification of animal husbandry, and widespread cultivation of N2 fixing crops have all contributed to the dramatic increase in N inputs. The increase has been most rapid in Northern Hemisphere (NH) temperate ecosystems, but presently subtropical and tropical regions of Asia are also experiencing an explosive increase in N inputs to terrestrial ecosystems (W. Chameides, pers. comm. ; Galloway et al. 1996). Projected increases in N deposition for these trop ical and subtropical regions, with a high natural background of N inputs, exceed increases projected for temperate and arctic regions (Cleveland et al. submitted; Galloway et al. 1994; Holland & Lamarque 1997a). Compared to biological N fixation, N deposition is becoming a proportionately greater source of N to terrestrial and aquatic ecosystems worldwide (Vitousek et al. 1997). 6 The nitrogen contained in the atmosphere as N , 3. 9 * 10 Tg (Tg = 2 12 10 g), is the largest reservoir of N in the Earth system (Warneck 1988). However, this paper focuses on the nitrogen emissions and deposition that have been transformed from N2 into reactive forms that are biologically avail able (e. g. Vitousek et al. 1997).

Book excerpt: This book is among the few to develop in detail the proposition that international law on the subject of interstate force is better derived from practice than from treaties. Mark Weisburd assembles here a broad body of evidence to support practice-based rules of law on the subject of force. Analyses of a particular use of force by a state against another state generally begin with the language of the Charter of the United Nations. This approach is seriously flawed, argues Weisburd. States do not, in fact, behave as the Charter requires. If the legal rule regulating the use of force is the rule of the Charter, then law is nearly irrelevant to the interstate use of force. However, treaties like the Charter are not the only source of public international law. Customary law, too, is binding on states. If state behavior can be shown to conform generally to what amount to tacit rules on the use of force, and if states generally enforce such rules against other states, then the resulting pattern of practice strongly supports the argument that the use of force is affected by law at a very practical level. This work aims to demonstrate that such patterns exist and to explain their content. Weisburd discusses over one hundred interstate conflicts that took place from 1945 through 1991. He focuses on the behavior of the states using force and on the reaction of third parties to the use of force. He concentrates upon state practice rather than upon treaty law and does not assume a priori that any particular policy goal can be attributed to the international legal system, proceeding instead on the assumption that the system's goals can be determined only by examining the workings of the system.
