Book excerpt: Almost fifty years have passed since the adoption of the Convention Concerning the Protection of the World Cultural and Natural Heritage (the UNESCO World Heritage Convention). With its 194 States Parties, it is the most widely ratified convention within the family of UNESCO treaties on the protection of cultural heritage. The success of this Convention and its almost universal acceptance by the international community of states is due to the great appeal that recognising certain properties as "world heritage" has for national governments. Since the publication of the first Commentary, new problems have arisen in the management of world heritage sites. It has become increasingly difficult to properly monitor the conservation of the ever-growing mass of sites inscribed in the World Heritage List, and to resolve disputes over the formal designation of contested world heritage properties - a problem that has led to the withdrawal of the United States and Israel from UNESCO. New frontiers are now being explored for the expansion of the world heritage idea over marine areas beyond national jurisdiction, and the monopoly of the State in the identification, delineation, and presentation of world heritage properties is being increasingly challenged in the name of indigenous peoples' rights and by local communities claiming ownership over contested cultural sites. At the same time, the regime of world heritage protection has infiltrated other areas of international law, especially international economic law, investment arbitration, and the area of international criminal law. This second edition critically examines the World Heritage Convention against this dynamic evolution of international heritage law to help academics, lawyers, diplomats, and officials interpret and apply the norms of the Convention after half a century of uninterrupted implementing practice by State Parties and Treaty Bodies.

While ICH has always existed, a legal framework for its protection only emerged in 2003 with the UNESCO Convention for the Safeguarding of Intangible Cultural Heritage. In Stored in the Bones, Agnieszka Pawłowska-Mainville details her work with Anishinaabeg and Inninuwag harvesters, showcasing their cultural heritage and providing a new discourse for the promotion and transmission of Indigenous knowledge. The book focuses on lived experiences of the akiwenziyag and kitayatisuk, “men of the land” in Anishinaabemowin/Ojibwe and Inninumowin/Cree, respectively. These men shared their dibaajimowinan and achimowinak (life stories)—from putting down tobacco to tending traplines—with Pawłowska-Mainville during her fifteen years of research in Manitoba and northwestern Ontario. Heritage and tourism are strongly related to each other in that heritage gives rise to tourist attractions and activities, and tourism enhances the designation of heritage sites. A post-humanist perspective the moral valuation of equality between humans and other animals demands that both are sentient beings and self-aware of their pain and pleasure. Thus, the involvement of animals as heritage elements by themselves or as an element of tourist consumption in heritage sites implies their commodification and lack of agency. As such, these practices are usually unethical, since they threaten the animals' primary interests: not to suffer, not to feel pain and to be able to live their freedom. This book contains chapters that reveal both the unethical interactions between humans and animals within heritage tourism, and those that show experiences in which efforts are made to minimize damage within the commercialization of animals involved as heritage themselves.

Over 130 individuals were buried on Saddle Island during the Basque whaling enterprise that would see thousands of men pursue whales to collect train oil for European markets for more than 50 years along the south coast of Labrador. These remains were excavated in the early 1980s and have been largely unstudied until this time. This thesis examines the human skeletal remains, archaeological contexts, and burial artefacts to help reconstruct past biological, cultural, and historical conditions. The study of the human remains and mortuary behavior from Saddle Island provides personal stories of life and death of a sixteenth-century whaler and offers us a rare and unique opportunity to understand the men who sailed annually from the Basque Country to hunt whales to light the streets of Europe.
