Welfare rights and responsibilities is a response to this, focusing on welfare reform and citizenship. Specifically it explores three issues central to citizenship's social element: provision, membership and the link between welfare rights and responsibilities(conditionality). Part 1 discusses competing philosophical, political and academic perspectives on citizenship and welfare. Book excerpt: Welfare to work programmes aim to assist the long-term unemployed in finding work; increasing labour market flexibility, eliminating dependency, and tackling social exclusion. They have been implemented in many Western countries. This book focuses on an important and novel feature of these programmes: they replace the rights-based entitlements that have characterized the welfare state for decades with conditional rights dependent on the fulfilment of obligations: conditions are attached to the benefits received. This new type of social contract between the claimant and the State carries with it a new construction of the relationship between rights and responsibilities, and a new interpretation of citizenship. Paz-Fuchs examines the theoretical underpinnings of welfare-to-work programmes, incorporating a comparative analysis of the UK and USA, where the ideal of social citizenship is being curtailed through welfare reforms. He argues that when the rhetoric of the social contract is used to imply a continuous contract between citizens and the state, a vast array of conditions on welfare can be legitimated, including workfare; the obligation to accept any job offer; and moral and social preconditions that are based on a vague notion of reciprocity. Paz-Fuchs argues, by contrast, that conditional welfare undermines civil rights such as the right to privacy and family life by requiring welfare claimants to change their behaviour. He contends that strengthening welfare rights and relaxing preconditions on entitlement would better serve the objectives that welfare to work programmes are supposed to advance.

In fact, it would be difficult to find a major domestic policy area in which statutory interpretation by the federal courts has not played a significant role in shaping the activities of government. In most important cases, judges base their interpretation not on the letter of the law, but on their reading of its history, purpose, and spirit. What judges discover between the lines of statutes often has major policy consequences. This book examines how statutory interpretation has affected the development of three programs: Aid to Families with Dependent Children, education for the handicapped, and food stamps. It explores how these decisions have changed state and national policies and how other institutions—especially Congress—have reacted to them. Although these three programs differ in several important ways, in each instance court action has expanded program benefits and increased federal control over state and local governments. R. Shep Melnick ties trends in statutory interpretation to broader policy developments, including the expansion of the agenda of national government, the persistence of divided government, and the resurgence and decentralization of Congress. He demonstrates that Congress frequently modifies or overturns court rulings, and he explains why statutory interpretation became so controversial in the 1980s. Between the Lines also explores the understanding of welfare rights that has guided the development of welfare policy over the past fifty years. What basic beliefs about the welfare state underlie court decisions interpreting these statutes? To what extent do members of Congress share these views?
