Using data from 17 OECD countries, we show that there exists an inverse U-shape relationship between employment protection and economic growth. Using a simple theoretical model with non-contractible specific investments, we show that over some range increasing employment protection does indeed raise welfare. We also show that the optimal level of employment protection depends on other labour market features, such as the bargaining power of workers and the existence of wage rigidities like the minimum wage.

Book excerpt: We study the welfare implications of employment protection for older workers, exploiting recent bans on mandatory retirement across Canadian provinces. Using linked employer- employee tax data, we show that the bans cause large and similar reductions in job separation rates and retirement hazards at age 65, with further reductions at higher ages. The effects vary substantially across industries and firms, and around two-fifths of the adjustments occur between ban announcement and implementation dates. We find no evidence that the demand for older workers falls, but the welfare effects are mediated by spillovers on savings behavior, workplace injuries, and spousal retirement timing.

Proponents argue that they protect workers. Opponents believe that they spawn inefficiency and harm workers. Yet all agree that their welfare implications depend on their degree of enforcement.This Article challenges the conviction that the welfare implications of such restrictions depend on enforcement. We show experimentally that unenforced restrictions cause workers' reservation wages to rise, i.e., workers charge higher wages when offered contracts that violate such restrictions. This observation is important to both proponents and opponents of such restrictions. We establish this claim experimentally by measuring the effects of unenforced restrictions on workers' reservation wages. Then we investigate several hypotheses as to why these effects are generated. Last, we point out that our findings have important implications in other contexts of contractual regulation, such as in the domain of consumer protection.

We show that firing costs and temporary employment have opposite effects on educational choices. We furthermore demonstrate that a laissez faire economy with no regulation is inefficient as it is characterized by insufficient educational investments leading to excess job destruction and inadequate job creation. By stabilizing employment relationships, firing costs may spur educational investments and therefore lead to welfare and productivity gains, though a first-best policy would be to subsidize education. However, there is little chance for a dual labor market, as is common in many European countries, with heavily regulated long-term contracts and more flexible short-term contracts to raise the incentives to schooling and aggregate welfare.

Book excerpt: This thesis explores in three chapters the impacts of employment protection and related labor market institutions on workers stress, work hours and consumption, using a mainly empirical approach. Chapter one examines how labor market displacements affect household consumption. The consumption reactions of representative workers are modeled to compare their reactions with real data, compute welfare losses associated with each outcome and conduct policy experiments regarding unemployment insurance. The second chapter investigates the impact of employment protection on work hour variability and overtime. In a theoretical model, a firm chooses between workers and hours per worker as productive inputs. If there are hiring and firing costs, variations in output demand generate variability in work time. This link is validated empirically on Canadian data. The impact of the employment rate on overtime use is positive and significant for provinces with lengthy individual notice, but negligible when notice requirements are short. Finally, chapter three looks at the effects of employment protection laws on workers' stress and well-being. Such laws should be beneficial to permanently employed workers by lowering the risk of job loss, but may also have adverse effects. An exhaustive empirical analysis is undertaken to verify whether employment protection increases or decreases stress using seven surveys from OECD countries and the Canadian National Population Health Survey. Employment protection has a positive and significant effect on work stress in high turnover sectors relative to low turnover sectors, which can be interpreted as causal.
