Tradicionalmente se ha convertido la trata como un asunto exclusivamente criminal. El resultado de este enfoque ha sido deficiente tanto en la violación de los propios derechos de los seres humanos que las padecen, como en la incompetencia de la persecución del delito, convirtiéndose en la actualidad, en la segunda fuente de ingresos para las organizaciones delictivas después del tráfico de estupefacientes. Sin embargo, el incremento de este delito ha provocado un cambio de orientación hacia un enfoque integral basado en los derechos humanos, es decir, el abordaje victimocéntrico. Este viraje en el rumbo lo marcaría el Protocolo de Palermo I en el año 2000, atendiendo a las necesidades de las víctimas a través de la llamada política de las 3P. En nuestro ordenamiento jurídico, esta transformación se logra con la aprobación de la LO 5/2010 de 22 de junio por la que se modifica la LO 10/1995, de 23 de noviembre, del Código Penal. Se introduce por primera vez el delito de trata de seres humanos de forma independiente en el Título VII bis en un único precepto, el artículo 177 bis. Sin embargo, cinco años después, con la LO 1/2015, de 30 de marzo, de reforma del Código Penal, el legislador se ve abocado a su modificación, no sólo con el objetivo de cumplir con la completa transposición de la normativa europea, tanto en las formas de comisión del delito exigidas como en la finalidad para tipificar el delito de Trata de Seres Humanos, sino por la necesidad de introducir mejoras técnicas. Si bien la nueva reforma no ha dejado de añadir elementos que dificultan aún más la decisión judicial. Mónica Cabanes Ferrando.
