The human rights of women are a revolutionary notion that has opened the way for the definition, analysis, and articulation of womenâ (TM)s experiences of widespread violence, degradation, discrimination, and marginality. Globally, womenâ (TM)s land rights are becoming an area of increasing urgency and concern as discrimination against women over land, property and inheritance rights continues to keep them in a subordinate position even today. Land empowers, and equality in land rights is an indicator of womenâ (TM)s economic empowerment and at the same time helps in poverty reduction. Many Indian writers, especially Indian English women novelists, have dealt with issues of land, dispossession, hunger and poverty in rural India in particular, but none have explicitly referred to womenâ (TM)s land rights. For men, land is an essential element of their identity as â ~providerâ (TM), but for women it is a demand for recognition as a human being. However, women in India are rarely landowners, and in most Indian families women do not own any property in their own names. They are usually refused a share in the paternal property, although, according to the Indian Succession Act, 1925, everyone is entitled to equal inheritance. Unfortunately in India, law and society conspire to deny women their right to land ownership, although there have been several legal amendments to redress this gender inequality. This book deals with the gap that lies between womenâ (TM)s land rights in India and the actual ownership of land.

It combines theory and practice from researchers, lawyers and judges, each with track records of working on women and rights concerns. The nexus between the reluctance to recognize and materialize women's right to land, and the increasing feminization of poverty is undeniable. The problem assumes special acuity in an essentially agrarian context like Cameroon, where the problem is not so much the law as its manner of application. That this book delves into investigating the principal sources and reasons for this prevalent injustice is particularly welcome. As some of the analyses reveal, denying women their right to land acquisition or inheritance is sometimes contrary to established judicial precedents and even in total dissonance with the country's constitution. Traditional and cultural shibboleths associated with land acquisition and ownership that tend to stymie women's development and fulfilment, must be quickly shirked, for such retrograde excuses can no longer find comfort in the law, morality nor in "modern" traditional thinking. The trend, albeit timid, of appointing women to Land Consultative Boards and even as traditional authorities, can only be salutary. These are some positive practical steps that can translate the notion of equal rights into "equal power" over land for both sexes; otherwise "equality" in this context will remain an unattractive slogan.

Yet we know little about their capacity to upend entrenched social, political, and economic hierarchies. Women, Power, and Property explores this question within the context of India, the world's largest democracy. Brulé employs a research design that maximizes causal inference alongside extensive field research to explain the relationship between political representation, backlash, and economic empowerment. Her findings show that women in government – gatekeepers – catalyze access to fundamental economic rights to property. Women in politics have the power to support constituent rights at critical junctures, such as marriage negotiations, when they can strike integrative solutions to intrahousehold bargaining. Yet there is a paradox: quotas are essential for enforcement of rights, but they generate backlash against women who gain rights without bargaining leverage. In this groundbreaking study, Brulé shows how well-designed quotas can operate as a crucial tool to foster equality and benefit the women they are meant to empower.

Throughout this publication the phrase womens rights to land must be understood holistically and in a manner which is grounded in the international human rights framework, and in the context of intersecting forms of discrimination. While this publication focuses on womens rights to land, it is also recognized that land is inextricably linked to womens access to, use of and control over other productive resources, such as property, fisheries, livestock and game. Therefore, the publication also uses the phrase womens rights to land and other productive resources to reflect this broader context.

Book excerpt: The failure to include gender in the economic history of rural development has severely limited our understanding of privatizing, collectivist and colonial economic policies that disrupted and transformed the lives of rural women and men in the modern world. This book is unique in its focus on female economic agency, and in its exploration of the latter virtue in comparative historical perspective. It presents the apparently disparate cases of 17th-century England, 20th-century Russia and the Soviet Union, and 20th-century Kenya, as their top-down modernization projects were implemented in similar fashion --particularly in the case of women. The female half of the population was largely absent from contemporary economic databases, but nevertheless stereotyped as obstacles to rational economic decision-making. Introducing rural women and their innovations into male-centered narratives of economic history lays the foundation for a more demographically balanced and realistic understanding of rural behavior and rural development. In this study, women’s labor and land claims are the lens through which both female agency and the delegitimizing of women’s land claims become more visible. Both policy-makers and their leading critics deployed virtually identical language to describe backward, unruly and invariably “unsightly” peasant women.

Rooted in 1970s feminist politics, they continue to thrive in a range of ways, from urban households to isolated rural communes, providing spaces where ideas about gender, sexuality, and sociality are challenged in both deliberate and accidental ways. Herlands, a compelling ethnography of women’s land networks in the United States, highlights the ongoing relevance of these communities as vibrant cultural enclaves that also have an impact on broader ideas about gender, women’s bodies, lesbian identity, and right ways of living. As a participant-observer, Keridwen N. Luis brings unique insights to the lives and stories of the women living in these communities. While documenting the experiences of specific spaces in Massachusetts, Tennessee, New Mexico, and Ohio, Herlands also explores the history of women’s lands and breaks new ground exploring culture theory, gender theory, and how lesbian identity is conceived and constructed in North America.
