Little has been written about non-Eurocentric worldviews with respect to the subject of socio-cultural harmony and interpersonal relations such as Ubuntu, Africa’s indigenous philosophy and its relevancy. This philosophy teaches the importance of maintaining good human relations and sensitivity to the wellbeing of other people both as individuals and collectively. However, the complexities of culture within organizations, communities and countries may not always be understood within these cultural frameworks and models. Assumptions of culture based or reliant on models alone can impede the successful applications of OD. The author discusses the role of cultural translations of OD techniques within a southern African context. It examines the approach of western consultants in a southern African environment as well as the approach of local southern African consultants as they interact with western developed OD applications in their own local environments. Drawing on the experiences of the United Kingdom and the United States (vis-à-vis efforts to attain an effective global legal framework on foreign judgments), this book undertakes a comparative analysis of how South African and Nigerian courts can promote the recognition and enforcement of foreign judgments in a fair manner. This comparative analysis is made considering both African countries as paradigms of their respective legal traditions. The author, a legal consultant and academic in private international law analyses, stage by stage, the challenging process that litigants face when they seek to enforce foreign judgments in South Africa and Nigeria. This analysis includes insightful consideration of broader issues such as the following: how challenges faced by judgment creditors may be circumvented; practical issues impeding the free movement of foreign judgments; impact of globalisation, increase in international commercial transactions, and regionalism on private international law; application of ‘fairness’; how territorial sovereignty and State interests in international commerce impede the free movement of foreign judgments; and ‘qualified obligation’, under which courts would presumptively enforce foreign judgments subject to certain exceptions and to the balancing of competing interests between private litigants and the State. The comparative analysis is undergirded by relevant case law – spanning decades in Africa and centuries in Europe and the United States. In summary, the author projects a clear case for predictability and certainty in the recognition and enforcement of foreign judgments, as well as how to go about it, thus offering lawyers a strategic position to weigh their options in contemplating enforcement of foreign judgments in any jurisdiction even beyond the African region. This innovative approach will also be of particular value to policymakers at national levels, international and regional economic organisations, as well as scholars in private international law and international commercial law generally. His poetry explored the conditions for animating the past and making lost worlds or people haunt the present. Yet he also described himself as “a poet of the future generations.” Indeed, his writings address concerns and desires that permeate the twentieth and twenty-first centuries. How does poetry concerned with the past, memory, loss, and death, carry futurity? How does it haunt, and how is it haunted by, future presents? Specters of Cavafy broaches these questions by proposing spectral poetics as a novel approach to Cavafy’s work. Drawing from theorizations of specters and haunting, it develops spectrality as a lens for revisiting Cavafy’s poetry and prose, fiction and nonfiction, as well as his poetry’s bearing on our present. By examining Cavafy’s spectral poetics, the book’s first part shows how conjurations work in his writings, and how the spectral permeates the entanglement of modernity and haunting, and of irony and affect. The second part traces the afterlives of specific poems in the Western imagination since the 1990s, in Egypt’s history of debt and colonization, and in Greece during the country’s recent debt crisis. Beyond its original contribution to Cavafy studies, the book proposes tools and modes of reading that are broadly applicable in literary and cultural studies.
