Chapter 9 provides an analytical enquiry into judicial precedent, examining a variety of ideal-typical systems in terms of their normative or de iure relevance. Chapter 10 addresses defeasibility and legal indeterminacy. In closing, Chapter 11 highlights the central tenets of a realistic theory of legislation.

Archeological Layering [Foucault] is an extension of this mental process - on the level of and in, an on-going development project. This effort is about understanding polymorphism and the polymorphic algorithms that the mind uses to process information. In the brain, pictures are a very important part of information processing; but computer processing is approaching that state now as well. Here the mind is the program. That mind uses different algorithms in its programming to solve its “problems”. The Search and Sort processing, which is some part of most mental activity, uses polymorphism to make the search and sort efforts both faster and more efficient. Recognizing and explaining the capability of these algorithms is our desire for this study. Much of the arguments depend on pictures for understanding because these algorithms are easier to understand using pictures.
